23 CALL TO ORDER

24 The Hon. Thomas A. Pua Jr., Municipal Vice Mayor and Presiding
25 Officer, called the session to order at nine fifty (9:50) in the
26 morning.

27 PRAYER

28 The Presiding Officer called on those present to dispose


29 themselves for a prayer led by the Hon. Ruben P. Furigay, Sectoral
30 Representative-Labor.

31 ROLL CALL

32 The Presiding Officer then tasked Atty. Ruben M. Dumlao,


33 Sangguniang Bayan Secretary (SB Secretary), to conduct a call of
34 the roll of the members to ascertain the presence of a quorum. The
35 SB Secretary certified that quorum is present as evidenced by the
36 presence of all the members of the Sanggunian and that they may
37 proceed to do business.

38 READING OF THE MINUTES OF THE PREVIOUS SESSION

39 The SB Secretary was called upon to read the Minutes of the


40 Previous Session (March 29, 2021).

41 A motion was made by the Hon. Rufidel A. Alaska, Sangguniang


42 Bayan Member, to have the Reading of the Minutes of the Previous
43 Session be dispensed with since copies of the same were furnished
44 in advance to all the SB Members. Duly seconded by majority of the
45 members present, the motion was approved and the Reading of the
46 Minutes of the Previous Session was dispensed with.

47 CONSIDERATION OF THE MINUTES OF THE PREVIOUS SESSION

48 The Presiding Officer then submitted the Minutes of the


49 Previous Session before the august body for approval. The Minutes
50 was approved without changes and/or amendments made with eleven
51 (11) votes in the affirmative and no vote in the negative.

52 QUESTION HOUR

53 The Presiding Officer asked the SB Secretary if there are


54 guests who were invited for the day’s session. The SB Secretary
55 told that there are four (4) invited guests for the day’s session
56 as agreed upon by the members of the august body during the
57 previous session.

58 The Presiding Officer then requested a member of the


59 Sanggunian to move for the suspension of the rules to accommodate
60 the guest during the Question Hour. A motion was made by the
61 Honorable Alaska to suspend Section 12 of Rule X of the Internal
62 Rules of Procedure (IRP) to accommodate non-members of the
63 Sanggunian during the Question Hour. Duly seconded by majority of
64 the members present, the Presiding Officer thereby ordered the
65 suspension of the said provision of the IRP.

66 1. With PLT Alvin Rodolfo D. Tiu, Deputy Chief of Police (DCOP),


67 Delfin Albano Police Station (DAPS):

68 After the usual exchange of pleasantries, discussions were


69 made and the following were noted:

70 The Hon. Elli John G. Cañero, Sangguniang Bayan Member,


71 informed the guest that as per invitation of the Sanggunian, the
72 Chief of Police (COP) of the DAPS should be attending the session.
73 He then inquired why the COP is unavailable considering the
74 invitation of the Sanggunian. The DCOP informed the body that the
75 COP was tested positive of COVID-19 and is currently undergoing
76 quarantine at DAPS which resulted in his inavailability for the
77 day’s session. Also, personnel of DAPS are continuously monitored
78 by their Station Nurse of their health condition.

79 On impounded vehicles involved in accidents, the Hon. Joel A.


80 Talamayan, Sangguniang Bayan Member, inquired to the guest on the
81 possibility of releasing said involved vehicles by PNP personnel
82 without the knowledge of the aggrieved party and without the
83 presence of an agreement. The DCOP told the body that when there
84 is no filed case against the offender, the said involved vehicle
85 will be released.

86 The Honorable Furigay informed the guest that there is a


87 practice of the Sangguniang Bayan that whenever there is a new COP
88 and/or DCOP assigned to the Municipality, the said PNP Official
89 will be invited before the Sanggunian to introduce himself/herself
90 and present his/her plans, programs, and activities (PPAs) in
91 relation to maintenance of peace, order, and public safety (POPS)
92 in the Municipality. The DCOP properly introduced himself before
93 the body. Also, he presented the following PPAs of the COP:

94 1. Strict implementation of COVID-19 health protocols;

95 2. Assistance in the establishment of barangay checkpoints in
96 all barangays of the Municipality;
97 3. Strict enforcement of curfew hours especially to minors;
98 4. Strict implementation of the “No Face Mask, No Travel” policy;
99 5. Strict implementation of the “No Helmet, No Travel” policy;
100 6. Strict implementation of the “Anti-Noisy Muffler” policy; and
101 7. Dissemination to public of their 24/7 hotline numbers.

102 With regard anti-criminality operation in the Municipality,


103 he told that the situation is manageable.

104 Note: The Hon. Jay B. Caliguiran, LMB President, left the SB
105 Session Hall to see the Local Chief Executive (LCE) for an
106 important matter.

107 With regard ISMART apprehensions in the Municipality, the


108 Honorable Furigay inquired to the guest if the tickets of the LGU
109 can be used in the said apprehension. The DCOP duly noted the
110 inquiry and told that he will clarify the concern. He told that
111 ISMART is deputized by LTO and LTO tickets are being used by them.

112 The Honorable Alaska inquired to the guest on the strength of


113 DAPS personnel who are active and who are subject for quarantine.
114 The DCOP informed the body of the following:

115 1-personnel (COP) quarantined at DAPS


116 10-personnel (positive) quarantined at the municipal
117 quarantine facility
118 16-personnel (close contact) strict quarantine
119 14-active personnel who are in alternate duty

120 The Honorable Alaska inquired to the guest on the strategies


121 of DAPS in sustaining peace and order situation in the Municipality
122 amid inadequate personnel. The DCOP informed the body that there
123 is a good reporting mechanism of Barangay Officials to the Police
124 Station which gives more time in their other tasks. Also, he told
125 that there is a good relationship between Barangay Officials and
126 DAPS personnel.

127 Finally, the Presiding Officer then thanked the guest for
128 acceding to the invitation of the Sanggunian.

129 2. With Dr. Jennifer C. Begonia, Doctor-To-The-Barrios (DTTB),


130 Rural Health Unit (RHU):

131 After the usual exchange of pleasantries, discussions were


132 made and the following were noted:

133 The Hon. Sheila B. Cristobal, Sangguniang Bayan Member,


134 inquired to the guest to present her plans, programs, and
135 activities (PPAs) to be implemented as the newly installed DTTB in
136 the Municipality. The DTTB presented the following PPAs:

137 1. RHU Staff monthly meeting


138 2. Information Education Campaign (IEC) on Vaccination
139 Deployment Program to 10 Barangays
140 3. Proposed vaccination site at San Juan Covered Court for
141 the general population as RHU as the designated vaccination
142 center of the Municipality is in its full capacity

143 4. Proposed construction of building as Communicable
144 Isolation Unit for COVID-19 patients
145 5. Scheduling of visitation to Barangay Health Clinics every
146 2nd and 3rd Wednesdays of each month, if feasible
147 6. Conduct BHERTs meetings/orientations for contact tracing
148 7. Quarterly bloodletting activity, if feasible
149 8. Annual Buntis Congress, if feasible
150 9. Annual oral health and nutrition (Dental Care), if feasible
151 10. Conduct non-communicable disease program
152 11. Conduct screening of hypertensions, diabetic, etc.
153 12. Conduct dengue search and destroy program
154 13. And other significant medical-related programs

155 The Honorable Cristobal inquired to the guest on the status


156 of COVID-19 in the Municipality. The DTTB told the body that as of
157 18 April 2021 @ 7:45 PM, the Municipality, thru the RHU, noted the
158 following COVID-19 cases:

159 For patients:


160 166-confirmed cases
161 56-active cases
162 5-new positive cases
163 23-awaiting codes from DOH
164 102-total recoveries
165 12-new recoveries
166 6-awaiting codes from RESU
167 8-total deaths

168 For barangays: 18 barangays affected with 58 active cases

179 The DTTB informed the body that she requested the
180 Administration of the Ragan Sur National High School which will
181 serve as an isolation facility of RHU staff for their better
182 isolation after their duty at the quarantine facility. Further,
183 she told that Barangay Isolation Units shall be used by LSIs and
184 ROFs who cannot provide RT-PCR test results.

185 The Hon. Alex M. Macarilay Jr., Sangguniang Bayan Member,


186 inquired to the guest on the management of the RHU on COVID-19
187 patients in the Municipality. The DTTB discussed to the body the
188 management of RHU is implementing to COVID-19 patients in the
189 Municipality. The Honorable Macarilay inquired to the guest on the
190 management of Tuberculosis (TB) in the Municipality. The DTTB told
191 the body that as of date, there is no consultation in the RHU. She
192 told that medications to treat TB are readily available to
193 patients, who will be assisted and provided fully.

194 The Hon. Grace M. Gabuyo, Sangguniang Bayan Member, inquired
195 to the guest with regard persons who were vaccinated if there were
196 any adverse symptoms and if what kind of vaccine/s used. The DTTB
197 informed the body that there was no reported case of severe adverse
198 effects to personnel who were vaccinated. But she informed that
199 there were two (2) reported minor adverse effects: one (1) who was
200 vaccinated with AstraZeneca and had a fever for two (2) days; and
201 one (1) who was vaccinated with Sinovac and had body pains and
202 pain on the side of the injected portion of the body. She reported
203 that the total persons who were vaccinated as of date is three
204 hundred twenty (320). She told that constituents who were
205 vaccinated from outside the RHU were not yet included in the said
206 report.

207 The Honorable Furigay inquired to the guest if the SB Members


208 are now included in the vaccination list and what kind of vaccine
209 they will give. The DTTB told the body that they are included in
210 the masterlist of persons to be vaccinated and told that Sinovac
211 is readily available as AstraZeneca was already deterred for use
212 because of its severe adverse effects.

213 The Honorable Furigay inquired on the pricing of laboratory


214 tests for COVID-19. The DTTB informed the body of the laboratory
215 fees the Delfin Albano Memorial Hospital are collecting.

216 The Honorable Talamayan inquired to the guest on RHU’s


217 programs to encourage individuals to be vaccinated. The DTTB told
218 the body that Information Education Campaign (IEC) for information
219 dissemination regarding the vaccines was made and was a great help
220 and had encouraged people to get vaccinated.

221 The Honorable Talamayan inquired to the guest on the very


222 reason as to the cause of death of a patient who was tested positive
223 of COVID-19 and who has a comorbidity. The DTTB told the body that
224 it may be due to complications such as the patient’s comorbidity
225 which weakens his/her immune system while he/she is infected with
226 COVID-19. She told that COVID-19 will heighten said comorbidity,
227 such as hypertension, etc.

228 The Presiding Officer inquired to the guest that if COVID-19


229 did not occur, what then would be the diagnosis of the hospital to
230 a patient. The DTTB told the body that the hospital shall declare
231 the illness of a patient as the cause of death.

232 Finally, the Presiding Officer then thanked the guest for
233 acceding to the invitation of the Sanggunian.

234 3. With Mrs. Jocelyn A. Manibog, Municipal Budget Officer (MBO),


235 Municipal Government of Delfin Albano, Isabela:

236 After the usual exchange of pleasantries, discussions were


237 made and the following were noted:

238 The Honorable Macarilay informed the guest on the proposed


239 resolution ready to be deliberated for the day’s session re:
240 confirming and concurring her appointment as MBO of the Municipal
241 Government of Delfin Albano. With that, he inquired on her plans,
242 programs, and activities as the newly appointed MBO. The MBO told

243 the body that she will manage the financial resources of the
244 Municipal Government in implementing various plans and programs
245 that promote local development. She told that she will discharge
246 both the duties and responsibilities of a Municipal Budget Officer
247 and those of a Municipal Administrator.

248 The Honorable Furigay made a manifestation that the newly


249 appointed MBO can discharge well the duties and responsibilities
250 of both offices as above-mentioned.

251 Finally, the Presiding Officer then thanked the guest for
252 acceding to the invitation of the Sanggunian.

253 At the conclusion of the Question Hour, the Honorable Alaska


254 moved for the lifting of the suspension of Section 12, Rule X, of
255 the IRP. Duly seconded by majority of the members present, the
256 Presiding Officer declared the resumption of the session.

257 READING AND REFERRAL OF PROPOSED MEASURE

258 Proposed measures included for first reading are as follows:

259 1. Draft Resolution No. 017-2021, entitled: “A RESOLUTION


260 AUTHORIZING THE OFFICE OF THE LOCAL CHIEF EXECUTIVE, THE HON.
261 ARNOLD EDWARD P. CO, TO ENTER INTO AND SIGN FOR AND ON BEHALF OF
262 THE MUNICIPAL GOVERNMENT OF DELFIN ALBANO, ISABELA, A MEMORANDUM
263 OF AGREEMENT (MOA) WITH THE DEPARTMENT OF HEALTH (DOH)–CAGAYAN
264 VALLEY CENTER FOR HEALTH DEVELOPMENT (CVCHD), HEREIN REPRESENTED

282 Health, and Social Welfare.

283 The Presiding Officer ruled that since the proposed

308 The Presiding Officer ruled that since the proposed

312 READING AND REFERRAL OF PETITIONS, LETTERS, AND OTHER


313 COMMUNICATIONS

314 The communications received were read before and noted by the
315 body:

316 1. LCE’s letter dated 26 March 2021 re: request to adopt a


317 resolution authorizing his office to enter into a MOA with DOH RO2
318 for the implementation of Administrative Order No. 2020-0054,
319 providing life insurance, accommodation, transportation, and meals
320 to eligible workers; and

321 2. LCE’s letter dated 12 April 2021 re: request to adopt a


322 resolution authorizing his office to enter into a MOA with the
323 Office of the President for the implementation of the Financial
324 Assistance to LGU-Delfin Albano, affected by Typhoon Ulysses.

325 The Presiding Officer duly noted the read communications and
326 ruled that the same be referred to the concerned committees.

327 COMMITTEE REPORTING

330 1. Draft Resolution No. 014-2021

331 A motion was made by the Hon. Darwin D. Agas, SK Federation


332 President, to take out from the table and make as part of the
333 deliberation for the session Draft Resolution No. 014-2021
334 entitled “A RESOLUTION INTERPOSING NO OBJECTION AND EARNESTLY

335 SUPPORTING THE FIRST TIME VOTERS (FTV) NETWORK IN THE CONDUCT OF
336 ORIENTATION CUM VOTERS EDUCATION CAMPAIGN/SEMINAR TO YOUTH
337 PARTICIPANTS IN THE MUNICIPALITY OF DELFIN ALBANO, ISABELA”,
338 introduced by the Hon. Elli John G. Cañero and sponsored by the
339 Committee on Youth and Sports Development and was laid on the table
340 on 22 March 2021.

341 It being moved and duly seconded, and there being no


342 objection, the Presiding Officer approved the inclusion for
343 deliberation of the said measure.

344 2. Draft Resolution No. 015-2021

345 A motion was made by the Honorable Macarilay to take out from
346 the table and make as part of the deliberation for the session
347 Draft Resolution No. 015-2021 entitled “A RESOLUTION CONFIRMING
348 AND CONCURRING THE APPOINTMENT OF MRS. JOCELYN A. MANIBOG AS
349 MUNICIPAL BUDGET OFFICER I, THIS MUNICIPALITY, WHICH APPOINTMENT
350 IS HEREBY MADE SUBJECT TO ALL LAWS AND CIVIL SERVICE RULES AND
351 REGULATIONS”, sponsored by the Committee on Good Government,
352 Public Ethics, and Accountability and was laid on the table on 29
353 March 2021.

354 It being moved and duly seconded, and there being no


355 objection, the Presiding Officer approved the inclusion for
356 deliberation of the said measure.

357 BUSINESS FOR THE DAY

358 1. Draft Resolution No. 014-2021

359 The Honorable Agas and the Honorable Cañero took the floor
360 and delivered the sponsorship speech and introductory speech of
361 the said measure, respectively. After the sponsorship speech on
362 said measure, the Presiding Officer then submitted the same for
363 deliberation.

364 The Honorable Gabuyo inquired to the proponent and the members
365 of the sponsoring committee particularly on the first whereas
366 clause specifically the organizations and youth volunteers
367 involved in the First Time Voters (FTV) Network. The Honorable
368 Cañero enumerated names of organizations included in the said
369 network, one of which is the Akbayan Youth. The Honorable Gabuyo
370 manifested that Akbayan Youth is an alliance of the League of
371 Filipino Students which, accordingly, is a front organization of
372 the leftists. Also, she informed the body that this Sanggunian
373 approved an ordinance banning the political organizing works of
374 the CPP-NDF-NPA in the Municipality. She then inquired if said FTV
375 Network has a juridical personality to transact business and if it
376 is a registered organization to any government agency. The
377 Honorable Cañero told that some members of the Akbayan Youth in
378 the Province of Isabela are his acquaintance, workers of the
379 government, and volunteers in civic works. He then manifested that
380 the impression of the Honorable Gabuyo may be not absolute. On the
381 concern on the FTV Network’s registration to any government agency,
382 he told that they are not yet registered. He informed that he
383 conducted a research on the said network and found that they were

384 featured in Rappler for the 2016 Elections. He told that they
385 partnered with National Youth Commission (NYC) and the Education
386 and Information Department (EID) of the Commission on Elections
387 (COMELEC) to conduct first time voters advocacy. The Honorable
388 Gabuyo manifested that she is not questioning the advocacy of the
389 leftists which she knows that they have good intentions in helping
390 people especially the poor. Further, she is concerned on the
391 entirety of the proposed measure as it involves the youth sector
392 who are vulnerable to simple infusion of ideologies. She told that
393 a legal basis is necessary in granting authority for the FTV
394 Network to conduct orientation and the like. The Honorable Cañero
395 told that youth officials in the Municipality shall be the
396 facilitators to the orientation for the first time youth voters.

397 On the second whereas clause, the Honorable Gabuyo asked if


398 there is as a proof that said network has partnered with COMELEC.
399 The Honorable Cañero reiterated that he does not hold any document
400 of the network. He told that he only conducted research about the
401 said network.

402 The SB Secretary made a supplementation that with or without


403 the resolution, youth members in the Municipality may participate
404 in an online platform of the said network.

405 The Honorable Macarilay inquired on who will be the set of


406 speakers and facilitators in the orientation. The Honorable Cañero
407 told that the Sangguniang Kabataan Officials of the Municipality
408 shall serve as facilitators and some Student Leaders of ISU-Echague
409 Campus.

410 The Honorable Furigay reiterated the inquiry of the Honorable


411 Gabuyo if there was a request made to draft the said measure. He
412 informed that the proposed measure was introduced by the Honorable
413 Cañero. Further, he told that any Member of the Sanggunian may
414 introduce a proposed measure even if there is no request made from
415 the Executive Department. Also, he is in support to the
416 supplementation of the SB Secretary that with or without the
417 resolution, youth members in the Municipality may participate in
418 the online seminars without violating Ordinance No. 62-2020 or the
419 CPP-NDF-NPA Ban Ordinance of 2020.

420 The Honorable Furigay moved for the declaration of a five-


421 minute recess at twelve seventeen (12:17) in the afternoon. Duly
422 seconded by majority of the members present, the Presiding Officer
423 declared a five-minute recess.

424 The Presiding Officer declared the resumption of the session.

425 There being no further questions and amendments raised, the


426 same was submitted for adoption.

427 The measure was disapproved with three (3) votes in the

512 WHEREAS, Republic Act (RA) 11494 known as “Bayanihan to


513 Recover as One Act” affirmed the existence of a continuing national
514 emergency in view of the unabated spread of COVID-19 and the
515 economic disruption ensuing from it;

516 WHEREAS, pursuant to Section 4(l) of RA No. 11494, there must


517 be a provision of life insurance, accommodation, transportation,
518 and meals to all public and private health workers during the state
519 of national emergency;

520 WHEREAS, the Department of Health (DOH) issued Administrative


521 Order (AO) No. 2020-0054 dated November 25, 2020, providing the
522 guidelines on the provision of life insurance, accommodation,
523 transportation, and meals to eligible health workers (HWs);

524 WHEREAS, under Section VII.B.3 of DOH AO 2020-0054, the DOH-
525 CVCHD shall enter into a Memorandum of Agreement (MOA) with LGUs

527 provision of life insurance, accommodation, transportation, and
528 meals to eligible HWs;

529 WHEREAS, under Department Order (DO) No. 2020-0802, the DOH-
530 CVCHD shall transfer funds in the total amount of Four Hundred Ten
531 Thousand Three Hundred Fifty-Eight Pesos and Sixty Centavos
532 (PhP410,358.60) to the Municipal Government of Delfin Albano,
533 Isabela, to cover the cost for the provision of meals,
534 accommodation, and life insurance, chargeable against the

628 WHEREAS, the late Hon. Guan Siong Jao Pua, resident of
629 Barangay San Antonio, died at the age of ninety (90) on 13 April

631 WHEREAS, the late Honorable Pua had served the Municipality
632 of Delfin Albano as Member of the Sangguniang Bayan for three terms
633 (3) terms: from 2 February 1988 to 28 February 1991, 1 July 2001
634 to 30 June 2004, and from 1 July 2004 to 30 June 2007, with honor
635 and dignity;

636 WHEREAS, the late Honorable Pua also served the Municipality
637 as appointed Municipal Vice Mayor, a key position, from 1 March
638 1991 to 30 June 1992;

639 WHEREAS, during his term as Sangguniang Bayan Member, he had


640 authored various resolutions and ordinances geared towards the
641 economic and social development of the Municipality and had been
642 an epitome of a statesman who exhibited professionalism and
643 integrity;

644 WHEREAS, he now departs from us but he would always be


645 remembered as a responsible and dedicated man to his duties and
646 responsibilities as a public servant, and as a source of love and
647 inspiration to his family, peers, and countless friends;

648 WHEREAS, the high esteem in which the late Honorable Pua is
649 held by both family and friends stands as a testament for others
650 to mirror and emulate in both their private and public life; hence,
651 his memories will forever live;

652 WHEREAS, the municipal officials and employees of the

686 WHEREAS, such event brought heavy rainfall that caused rapid
687 and extensive flooding in various areas of the Province, and the
688 extent of devastation it wrought was gleaned from the destroyed
689 homes and the damaged crops of the farming folks;

690 WHEREAS, the roll of municipalities considered hard-hit by


691 the effects of typhoons and flood included this Municipality;

692 WHEREAS, a number of houses within the Municipality had been


693 badly damaged and the agricultural crops have been rendered
694 unharvestable by the said flood;

695 WHEREAS, His Excellency, President Rodrigo Roa Duterte, sees


696 the need to provide financial assistance to LGU-Delfin Albano,
697 Isabela, which was affected by Typhoon Ulysses;

698 WHEREAS, the assistance shall be used to cater and address


699 the immediate needs of the people affected by the typhoon as well
700 as to implement long-term solution and undertake future evacuation
701 of people living in the hazard areas in the Municipality;

702 WHEREAS, Article I, Section 25 (c) of Republic Act No. 7160


703 (R.A, No. 7160) otherwise known as the Local Government Code of
704 1991 so provides that:

705 “The President may, upon request of the local
706 government unit concerned, direct the appropriate
707 national agency to provide financial, technical, or
708 other forms of assistance to the local government unit.
709 Such assistance shall be extended at no extra cost to

711 WHEREAS, Section 17 (f) of the same R.A No. 7160 states that:

712 “The national government or the next higher level


713 of local government unit may provide or augment the basic
714 services and facilities assigned to a lower level of
715 local government unit when such services or facilities
716 are not made available or, if made available, are
717 inadequate to meet the requirements of its inhabitants.”

718 WHEREAS, in his letter request dated 12 April 2021, the Local
719 Chief Executive requested this Sanggunian to grant him authority
720 to enter into and sign for and on behalf of the Municipal
721 Government of Delfin Albano, Isabela a Memorandum of Agreement
722 (MOA) with the Office of the President;
