Attorney’s Office and unto this Honorable Court, most respectfully
avers;

That, in an open Court Order dated 31 May 2019, the above-

named Movant was ordered to submit Affidavit of Undertaking and
Photographs in addition to the Official Receipt and Certificate of
Registration (OR/CR) attached to the Motion to Release Motor
Vehicle filed by herein movant on 26 February 2019 in relation to the
aforementioned case;

That, in compliance with the said Order, the movant

respectfully submitting the AFFIDAVIT OF UNDERTAKING WITH
PRAYER TO RELEASE CONFISCATED VEHICLE and
PHOTOGRAPHS hereto attached and marked as Exhibit “1” and
Exhibit “2”, respectively.

AFFIDAVIT OF UNDERTAKING WITH PRAYER

TO RELEASE CONFISCATED MOTOR VEHICLE

I, MICHAEL SAMAL CABO, of legal age, married, Filipino

citizen, a resident of Purok 1, Brgy. San Jose, General Santos City,
after having been duly sworn to in accordance with law, hereby
depose and states:

That, herein affiant is the registered owner of a motor vehicle in

Criminal Case No. 01115-19 & 01116-19 for Violation of Section 28(a)
in relation to Section 28 (e)(1) of RA 10591 pending before Regional
Trial Court-Branch 50, Alabel, Sarangani Province;

That, the motor vehicle was confiscated by Alabel Municipal

Police Station in connection with the arrest of Mohammad Zakizul
Karnaen Harid for the above-entitled case;

That, the herein affiant is asking the consideration of the

authorities concerned to please release the said motor vehicle to the
herein affiant and that he undertakes that during the pendency of the
case he is also willing to present said vehicle when required to do so.
