COMES NOW, Respondents, through counsel from the Public

Attorney’s Office, and unto this Honorable Office, most respectfully
states that,

1. On 09 February 2021, herein respondents received a Subpoena

from this Honorable Office notifying them that a complaint for
Frustrated Murder was filed against them and directing them
to submit their Judicial Counter-Affidavit and that of their
witness/es within ten (10) days from receipt;

2. On 15 February 2021, herein respondents filed a Motion for

Extension to file Counter-Affidavit because there are still
material evidence and/or witness/es that they have to secure;

3. Thus, herein respondents are respectfully submitting their

Counter-affidavit and praying for the DISMISSAL of the case
filed against them.

WHEREFORE, it is most respectfully prayed of this Honorable

Office that the case filed against respondents be DISMISSED for lack
of probable cause.
