AFFIDAVIT OF WITNESS
(NPS DOC NO. XII-07-INV-19E-00116)

I, JOHN LLOYD BACUS, both of legal age, both single, both

Filipino and both residents of Brgy. Poblacion, Glan, Sarangani
Province after having been duly sworn to in accordance with law,
hereby depose and state;

1. Herein affiant is the witness in NPS DOC NO. XII-07-INV-19E-

00116 for Physical Injuries and Grave Threat filed against PHILIP
MENDOZA and JEORGE PONTILAR. Herein affiant vehemently
denied the accusations hurled against the respondents, the truth
being that;

3. That, on 03 February 2019 at around 10 o’clock in the

evening, I was at the Redzone Internet Shop playing internet games. I
finished the game on or about 2 o’clock in the morning. As I finished
the game, I went to the caretaker of the said internet shop for a talk
then after several minutes, Philip Mendoza and Jeorge Pontilar
arrived. Kent Navarro, Earl Jesther Tarog and a certain Jay-r also
arrived after a minute who were so furious and drunk. They were
looking for Nelvin Roy D. Gomez a.ka. praning and a certain “datu”
to get an item which is called a motorcycle exhaust pipe. I saw Philip
Mendoza looked at Earl Jesther Tarog then Earl Jesther suddenly
blocked Philip Mendoza and said “Tabis ka bai? but the latter
ignored it and went ahead. Then Earl Jesther suddenly boxed the
nape of Philip Mendoza’s neck. Philip Mendoza tried to fight back
but was stopped by Jeorge Pontilar. Kent Navarro then joined to box
Philip Mendoza. Then all of a sudden, Earl Jesther strike Jeorge
Pontilar using a big stone at hi s left side. Then, the fight ensued.

4. That, the allegation of Kent Navarro and his witness was all
patently baseless, fabricated, unfounded and a complete lie. It is not
true that respondents uttered curses and threatening words. Those
were just fabricated to indict respondents to false charges. In fact, the

complainant and his witness were the ones who started the fight and
caused the trouble.

5. That, I am executing this affidavit to inform the authorities concerned

that the complaint filed against the respondents is merely fabricated,
baseless and unfounded.

6. IN WITNESS WHEREOF, I have hereunto set our hand this
