AFFIDAVIT OF WITNESS

I, ROGER NATAD, of legal age, married, Filipino, resident of Poblacion,

Malungon, Sarangani Province, after having been duly sworn to in
accordance with law, hereby depose and state;

1. Herein affiant is the witness in NPS DOC NO. XII-07-INV-18D-00164

for RECKLESS IMPRUDENCE RES. IN HOMICIDE AND DAMAGE TO
PROPERTY. Herein affiant vehemently denied the accusations hurled
against ARNEL DIONES, the truth being that;

2. On or about 7:00 in the morning of March 18, 2018, I went to the

house of Arnel Diones (Arnel for brevity) to look for a goat for my wife’s
birthday. There was no available goat at that time so Arnel accompanied
me to his mother-in-law at Sitio Magdulog, Brgy. San. Isidro, Malalag,
Davao Del Sur.

3. Because we have not much money, Arnel asked the driver of a

Shacman Ten Wheelers Dump Truck, Rene Sadeño Salilin (Rene for
brevity), whether we can took a ride for free until the nearest place where
we are heading to because Rene was going to a quarry at Brgy. Rizal,
Malalag, Davao Del Sur, in which Rene had acceded. We just thought that
after reaching the nearest place to Sitio Magdulog, we will just ride a
habal-habal going there. I and Arnel sat at the passenger side and it was
Rene who drove the dump truck.

4. On or about 11:30 in the morning of the same date, when we are

about to turn left so we can get down from the dump truck, a motorcycle,
all of a sudden, collided the dump truck we are riding. The driver of the
motorcycle and his backrider sustained serious injuries because of the
collision.

5. The allegations of the complainant and his witness were all lies and
fabricated. It is crystal clear that all the reports and Sinumpaang Salaysay
indicted Rene Sadeño Salilin as the driver of the Shacman Ten Wheelers
Truck. There was no allegations pertaining to Arnel Diones. It is only after
the first complaint was dismissed before the Office of the Prosecutor that
Arnel became, all of a sudden, the driver of the Shacman Ten Wheelers
Truck. The truth is that we were only the passengers of the dump truck
who just took a ride for free to save money.

 6. That, I am executing this affidavit to inform the authorities
concerned that the complaint filed against the respondent is merely
fabricated.
