PETITION

PETITIONER, by and through her counsel, unto this Honorable

Court, most respectfully avers:

1. Herein Petitioner, Juana S. Dela Cruz, is a Filipino, of legal

age, widow and currently residing in Sitio Batongbakal,
Barangay __, Municipality of Cainta, Province of Rizal.

2. Herein Respondent Register of Deeds of Antipolo City which

has an official address at M.L. Quezon Extension, Antipolo,
Rizal where it may be served with summons and other court
processes at the given address.

3. Petitioner is applying for the registration of the unregistered

land situated in Barangay __, Cainta, Rizal.

4. Petitioner, together with her family, has continuously

occupying the aforesaid parcel of land for eleven (11) years
since January 31, 2010 up to the present.

5. The subject lot is herein below more particularly described

and bounded as follows:

“A parcel of land situated in the Barangay of

__, containing an area of Eighty (80) square
meters, more or less, bounded on the NE.,
along line 1-2 by Lot 7, Block 6, (LRC)PCS-
2514; on the SE., along line 2-3 by Lot 10,
Block 6, (LRC)PCS-2514; on the SW., along
line 3-4by Road Lot 4, (LRC)PCS-2514; and
on the NW., along line 4-1 by Lot 6, Block 6,
(LRC)PCS-2514”

The necessary examination, evaluation and surveying on the

property was conducted by Engr. Juan Cruz, Jr., a duly
licensed Geodetic Engineer employed by herein petitioner.

A copy of the Land Survey bearing the technical description

above-stated parcel of land, prepared by Engr. Juan Cruz,
Jr. is hereto attached as Annex “A” and made an integral
part hereof.

6. Petitioner and her successors-in-interest has acquired

ownership of the above-described land by effective
occupation and had been in an open, exclusive, peaceful,
continuous, uninterrupted possession since time
immemorial.

Copies of the petitioner’s Barangay Certificate of

Residency and Barangay Certification, both issued at
Barangay __, Cainta, Rizal, are hereto attached as Annexes
“B” and “C” respectively, and made integral parts hereof.

7. To further support the fact of occupancy and possession of

the petitioner of the subject parcel of land situated in Cainta,
Rizal, copies of Joint Affidavit of Adjoining Lot Owners
and Joint Affidavit of Two Disinterested Persons are
hereto attached as Annexes “D” and “A” and made integral
parts hereof.

PRAYER

WHEREFORE, it is respectfully prayed upon this Honorable Court

that the Register of Deeds of Antipolo City issue an
Original Certificate of Title (OCT) for the parcel of land situated at No.
31 Volleyball Street, Barangay Muzon, Taytay, Rizal, in favor of
herein petitioner.
  
Other just and equitable reliefs are likewise prayed for.

1. I am the petitioner/applicant in the above-stated Petition for
Registration of Unregistered Land;
2. I caused the preparation of the foregoing petition;
3. I have read the contents thereof and the facts stated therein
are true and correct of my personal knowledge and/or on the
basis of copies of documents and records in my possession;
4. I have not commenced any other action or proceeding
involving the same issues in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;
5. To the best of my knowledge and belief, no such action or
proceeding is pending in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;
6. If I should thereafter learn that a similar action or proceeding
has been filed or is pending before the Supreme Court, the
Court of Appeals, or any other tribunal or agency, I undertake to
report that fact within five (5) days therefrom to this Honorable
Court.
