AFFIDAVIT

I, JIMMY C. CABBIGAT, of legal age, retired government employee

Filipino citizen and resident of Yayud, Poblacion, Banaue, Ifugao, after having been duly
sworn to in accordance with law, depose and state THAT:

1. Sometime in the year 1972, a project was initiated by the Department of

Agriculture – Region based at Tuguegarao, Cagayan. The project was entitled
“Save the Rice Terraces Program – STP”;

2. Being the Municipal Agriculture Officer that time, I was designated as manager to
oversee the said project;

3. The rice field located at Ipayyaya, Poblacion, Banaue, Ifugao, not planted with
rice crop was selected as the project site. This rice field is owned by Mrs. Jacinta
Kimmayong – Adchao;

4. A Memorandum of Agreement was then made and executed by the parties as a

basis of the rental payments. The said project was terminated in the year 1986;

5. Thereafter, in the later part of the year 1986, the said rice field was mortgage to
the undersigned and was later redeemed by Adchao’s daughter, Genietess Adchao;

6. When I was the Lupon Chairman of Barangay Poblacion, Banaue, Ifugao, a

complaint against Teresa Puddunan and Ian Puddunan was filed by Dominga
Adchao, daughter of Mrs. Jacinta Kimmayong – Adchao, since Teresa Puddunan
refused to turn over possession of the above – mentioned lot to Dominga Adchao;

7. Initially, an agreement was proposed by the complainant and respondent but

Teresa Puddunan later wilfully refused to sign the amicable settlement that was
agreed by the parties;

8. It appears in our investigation that the above – mentioned lot was used as a
collateral of the loan of Teresa Puddunan from Teresa Diagan. When Teresa
Puddunan failed to pay the loan, they asked permission from Mrs. Jacinta
Kimmayong – Adchao for Mrs. Diagan to put up a concrete house to be used as a
store;

9. I am executing this Affidavit to attest the truth of the foregoing and in support of
the claim Dominga Adchao and for all legal intents and purposes it may serve.
