JUDICIAL AFFIDAVIT

This Judicial Affidavit is being taken by ATTY. OSCAR D. BAYOG for

Defendants in his Law Office at 2/F Girl Scout Bldg. Quirino Drive, Kidapawan
City in the language known to the Plaintiff.

I, VICENTE TAGARAO TACAYON, of legal age, Filipino, married to

Mariamin Tadiaque Tacayon, and a resident of 534, Prk 6, Tambac, Tulunan,
Cotabato, after having been duly sworn to in accordance to an oath in accordance
with law, depose and say:

The following questions were ask and may the following answers thereto, as
follows.

Q1: Are you freely conscious and aware that you are executing this
affidavit under oath and that you may be liable for criminal
liability for perjury or false testimony.

A1: Yes sir.

 Q2: Good day Sir, could you please tells us why you are here
to testify for the defendant’s case?

A2: I am here to testify in connection with the case filed by the

defendants.

Q3: Do you know that the family of the Rev. Loreto Juson has a parcel of
land somewhere in Tulunan, Cotabato?

A3: Yes sir, I personally know because I am residing since 1994 and has
been on the land owned by the family of the Rev. Loreto Juson
since February 1995, as designated tenant with an area of One (1)
hectare, more or less, up to the present time.

Q4: Do you know the Lot No. of their property?

A4: Yes sir. It is identified as Lot ________________ with an area of

___________________________ ( ________ ) square meters,
more or less;

Q5: Why do you know that Defendants owned a parcel of land

located in Tulunan, Cotabato?

A5: I know they owned a parcel of land because I am one of the

overseer and tenants of Rev. Loreto Juson.

Q6: Since when have occupied and cultivated the said parcel of land?

A6: Since 1974, that as share tenant I was receiving ¾ share in the harvest
until __________ but after that said land was Mortgage to P
50,000 to me, I was not giving anymore share up to the present time.

Q7: What is your complaint?

A7: That I hereby declare that the true owner is the late Rev. Loreto Juson
and now represented by his Heirs, who his children, Gideon
Juson and Grace Juson Pendaton.

Q8: Were you forced or coached to give this statement?

A8: No sir, that I was not promised any money consideration in the
execution nor I was forced or intimidated in the execution
hereof.

AFFIANT SAYETH NONE.
