Tutorial. Submission made between 4:46 PM – 05:00PM will lead to deduction of 5
marks from the marks obtained in Tutorial. No submission will be accepted after
05:00PM.

Question1. Chilcott Aqua, a multinational aquaculture company has set up many of its industrial
plants which are engaged in shrimp farming in brackish water in Alamauri, a coastal district of
Tamil Nadu. The plants have converted vast stretches of green areas and fertile agricultural land
into shrimp farms resulting in serious environmental degradation. The salt water intrusion into
fresh water aquifers is depriving the local people of fresh water for drinking and irrigation
purposes. The discharge of toxic effluents into the fields and water sources is destroying the
fertility of the soil and depleting the already scarce water resources of the region. Intensive
aquaculture is also posing a threat to the livelihood of thousands of fisher folks of whose access
to the sea has been cut off by imposing barricades, jetties and other structures of Chilcott Aqua.
The concerned NGO has approached you for legal advice in the interest of the people of
Alamauri. Give suitable legal remedies to be available to rescue the damage and further
protection from environmental degradation. Support your answer with relevant statutory
provisions and relevant case laws. What according to you are the key international principles
applicable in the above-stated situation? Discuss the involvement of Supreme Court of India in
the protection and conservation of India’s coastal environment. (10 Marks)
Question 2. In Rajasthar, a municipal town, a dirty stream is flowing which is in the middle of
the main road of the town. In this stream many a time dirty and filthy water of alcohol plant
having chemical and obnoxious smell is discharged. This stream also produces filth which causes
breeding of mosquitos. There are many other insanitation problems because of the dirty water of
the stream. Due to which people of the town especially the nearby locality is unable to live and
take rest in their respective houses. The filth in the stream is affecting the health of the residents.
In the above-stated situation answer the following questions:
a) What measures can be taken to solve the problem? Suggest suitable remedies to be
available to the residents of Rajasthar with the help of relevant statutory provisions and
case laws. (5 Marks)

b) Whether the law of nuisance under the general laws has been repealed by the coming into
force of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and
Control of Pollution) Act, 1981? Support your answer with the help of relevant case laws.
