WARRANTY CONDITIONS

SUPPLY, DELIVERY, AND INSTALLATION OF SOLAR STREET LIGHTS IN THE

BANGSAMORO GOVERNMENT CENTER

Warranty Conditions offered by Silver Hammer Construction & Supplies for the Supply, Delivery
and Installation of Solar Street Lights in the Bangsamoro Government Center in Cotabato City.

I. GENERAL CONDITIONS
 Silver Hammer Construction & Supplies Guarantees ONE (1) YEAR to repair or replace parts
covered by the above stated project, effective upon issuance of Certificate of Acceptance, based on the
Warranty Conditions stipulated herein.

II. WARRANTY CONDITIONS 

This warranty will be effective only provided that:

 User utilizes Silver Hammer Construction & Supplies’ product according to the product
maintenance and usage.
 User has not modified the Solar Streetlight and/or no repairs have been performed without the
written authorization of Silver Hammer Construction & Supplies’ Technical Department.

III. EXCLUSIONS
Warranty does not cover the following:
 Damage caused by FORCE MAJEURE event.
 Damage caused by negligence, lack of maintenance, or attempts to repair by unqualified and
unauthorized personnel.
 Premeditated damages caused by third party.

IV. APPLICATION OF THE WARRANTY

 All product defects reported by the PROCURING ENTITY/USER, will be repaired or replaced
within the guaranteed period except force majeure damages and third party premeditated
damages.

  Silver Hammer Construction & Supplies reserves the right to replace a defective product with
the same or another product with a similar or better specifications and performance.
 Replacement products retain the terms of the original warranty.
 Non-conforming or defective products will become the property of Silver Hammer Construction
& Supplies as soon as they are replaced.
 Defects of the Solar Streetlight will be evaluated by Silver Hammer Construction & Supplies
Technical Group together with the Engineering Department, who will determine whether they
are covered by the warranty conditions set out herein.
 The warranty is offered to the PROCURING ENTITY/USER and is valid for the first
installation of the LED Streetlight.  Subsequent installations of said LED Streetlight after
expiration of contract are not covered by this warranty.
 The contract warranty set out herein is effective only if the User contacts and submits/e-mails a
written complaint to Silver Hammer Construction & Supplies.
