Mishnah peah 2

‫ׁשבִיל ַהּיָחִיד ַה ָּקבּו ַע ּבִימֹות ַהחַּמָ ה‬

ְ ‫ ּו‬,‫ׁשבִיל ה ַָרּבִים‬
ְ ‫ ּו‬,‫ וְדֶ ֶרְך ה ַָרּבִים‬,‫ וְדֶ ֶרְך ַהּיָחִיד‬,‫ּׁשלּולִית‬
ְ ‫ ְו ַה‬,‫ ַהּנַחַל‬.‫וְאֵ ּלּו ַמ ְפסִיקִין ַלּפֵָאה‬
‫ אֶ ּלָא‬,‫ אֵינֹו מַ ְפסִיק‬,‫ ַו ֲח ָכמִים אֹומ ְִרים‬.‫ ּדִ ב ְֵרי ַרּבִי ֵמאִיר‬,‫ׁשחַת ַמ ְפסִיק‬ ַ ‫ ְוהַּקֹוצֵר ְל‬.‫ ְוז ֶַרע ַאחֵר‬,‫ ְו ַהּנִיר‬,‫ ְוהַּבּור‬,‫ׁשמִים‬ָ ‫ּובִימֹות ַה ְּג‬
‫אִ ם ּכֵן ח ָָרׁש‬: The following divide a field for peah: a stream, a pool, a private road, a public road, a
public path, a private path in constant use in summer and the rainy season, fallow land, a plowed
field and a different seed. One who harvested for animal fodder, [the plot] serves divides, the
words of Rabbi Meir. But the sages say: it does not stop for peah unless it is plowed.

‫ ַאף עַל ּפִי ׁשֶ אֵ ין‬,‫ וְכ ֹל ֶהה ִָרים אֲ ׁשֶר ַּב ַּמעְּדֵ ר יֵעָדֵ רּון‬.‫ ַמ ְפ ֶסקֶת‬,‫ ַרּבִי י ְהּודָ ה אֹומֵר‬,‫ׁשאֵינָּה י ְכֹולָה ְל ִה ָּקצֵר ּכְַאחַת‬
ֶ ‫אַּמַת ַה ַּמי ִם‬
‫ הּוא נֹותֵ ן ּפֵָאה לַּכ ֹל‬,‫ ַה ָּבקָר י ָכֹול ַלעֲב ֹר ְּב ֵכלָיו‬: A water channel that makes harvesting [on one side]
impossible [while standing on the other side], Rabbi Judah says: it divides. But all of the hills
that can be tilled with a hoe, even though cattle cannot pass over it in with their equipment, [is
regarded as part of the field] he gives one peah from it all.

‫ ֶאּלָא נֹותֵ ן ּפֵָאה לַּכ ֹל‬,‫ אֵינֹו ַמ ְפסִיק‬,‫ׂשעָר ּכֹותֵ ׁש‬

ֵ ‫ ְואִם ָהי ָה‬.‫ ְואֵינֹו ַמ ְפסִיק ָלאִילָן אֶ ּלָא גָדֵ ר‬,‫ הַּכ ֹל ַמ ְפסִיק ַלּז ְָרעִים‬: All of
these divide in the case of a field [planted] with seeds, but in the case of trees nothing divides
except a fence. Should the branches intertwine [on top of the fence], then it does not divide and
he gives one peah for the whole field.

,ַ‫ׁשהָיּו ָלהֶם ְּבכָל רּוח‬

ֶ ‫ נֹותְ נִין ּפֵָאה ַאחַת ַלּז ֵיתִ ים‬,‫ נֹו ֲהגִין הָיּו ּבֵית ַאּבָא‬,‫ ָאמַר ַרּבָן ַּג ְמלִי ֵאל‬.‫ ּכָל הָרֹואִין ז ֶה אֶת ז ֶה‬,‫ְו ֶלחָרּובִין‬
‫ׁשהָיּו ָלהֶם ְּבכָל ָהעִיר‬
ֶ ‫ ַאף ֶלחָרּובִין‬,‫ ַרּבִי ֱאלִי ֶעז ֶר ּב ְַרּבִי צָדֹוק אֹומֵר ִמּׁשְמֹו‬.‫ ּכָל הָרֹואִין ז ֶה אֶת ז ֶה‬,‫ ְו ֶלחָרּובִין‬: As for
carob trees, [they are not divided] as long as they see one another. Rabban Gamaliel said: we had
this custom in the house of my father. We would give separate peah from the olive trees in each
direction and [one peah] for all the carob trees that saw one another. Rabbi Elazar bar Zadok said
in his name: also for the carob trees they had in the whole city [they only gave one peah].

‫ ַאף עַל ּפִי ׁשֶ עֲׂשָ ָאן ּג ֶֹרן‬,‫ׁשנֵי מִינִין‬

ְ ‫ ז ְָרעָּה‬.‫ נֹותֵן ּפֵָאה ַאחַת‬,‫ׂשהּו ׁשְּתֵ י ג ְָרנֹות‬
ֵ ‫ ַאף עַל ּפִי ׁשֶהּוא עֹו‬,‫ַּזֹור ַע אֶת ׂשָדֵ הּו מִין ֶאחָד‬
ֵ ‫ה‬
‫ נֹותֵ ן ׁשְּתֵ י פֵאֹות‬,‫ ׁשְּתֵ י ג ְָרנֹות‬.‫ נֹותֵן ּפֵָאה ַאחַת‬,‫ׂשָאן ּג ֶֹרן ַאחַת‬
ָ ‫ ֲע‬,‫ׁשנֵי מִינֵי ִחּטִין‬
ְ ‫ַּזֹור ַע אֶת ׂשָדֵ הּו‬
ֵ ‫ ה‬.‫ נֹותֵ ן ׁשְּתֵ י פֵאֹות‬,‫ַאחַת‬:
He who plants his field with one kind of seed, even though he makes up of it two threshing-
floors, he gives only one peah [for the lot]. If he plants it of two kinds, even though he makes up
of it one threshing-floor, he must give two peahs. One who plants his field with two species of
wheat: If he makes up of it one threshing-floor, he gives only one peah; But if two threshing-
floors, he gives two peahs.

ַ ‫ מְ קֻ ּבָל אֲ נִי‬,‫ ָאמַר נַחּום ַה ַּל ְבלָר‬.‫ׁשָאלּו‬ ָ ‫ׁשּכַת ַה ָּגז ִית ְו‬
ְ ‫ ְועָלּו ְל ִל‬,‫ׁשמְעֹון אִיׁש ַה ִּמ ְצּפָה ִל ְפנֵי ַרּבָן ַּג ְמלִי ֵאל‬
ִ ‫ׁשּז ַָרע ַרּבִי‬
ֶ ‫מַ עֲׂשֶ ה‬
‫ אִ ם‬,‫ׁשנֵי מִ ינֵי ִחּטִין‬
ְ ‫ְזֹור ַע אֶת ׂשָדֵ הּו‬
ֵ ‫ ּב‬,‫ׁשה ִמּסִינַי‬ֶ ‫ ֲה ָלכָה לְמ‬,‫ׁש ִּקּבְלּו מִן ַהּנְבִיאִים‬ ֶ ,‫ׁש ִּקּבֵל מִן הַּזּוגֹות‬ ֶ ,‫ׁש ִּקּבֵל ֵמ ַאּבָא‬
ֶ ,‫ׁשא‬ָ ‫מְ י ָא‬
‫ נֹותֵ ן ׁשְּתֵ י פֵאֹות‬,‫ ׁשְּתֵ י ג ְָרנֹות‬.‫ נֹותֵן ּפֵָאה ַאחַת‬,‫ׂשָאן ּג ֶֹרן ַאחַת‬ ָ ‫ ֲע‬: It happened that Rabbi Shimon of Mitzpah
planted his field [with two different kinds] and came before Rabban Gamaliel. They both went
up to the Chamber of Hewn Stone and asked [about the law]. Nahum the scribe said: I have a
tradition from Rabbi Meyasha, who received it from Abba, who received it from the pairs [of
sage], who received it from the prophets, a halakhah of Moses from Sinai, that one who plants
his field with two species of wheat, if he makes up of it one threshing-floor, he gives only one
peah, but if two threshing-floors, he gives two peahs.
 ,‫ ָקצַר ֶח ְצי ָּה ְו ָקצְרּו ִל ְסטִים ֶח ְצי ָּה‬.‫ְטּורה‬
ָ ‫ ּפ‬,‫ׁשב ַָרּתָ ּה הָרּו ַח אֹו ְב ֵה ָמה‬
ְ ,‫ ק ְִרסְמּו ָה נְ ָמלִים‬,‫ קְ צָרּו ָה ִל ְסטִים‬,‫ׁש ְּקצָרּו ָה ּכּותִ ים‬
ֶ ‫ׂשָדֶ ה‬
‫ ׁשֶחֹובַת ַהּפֵָאה ּבַּקָמָה‬,‫ְטּורה‬ ָ ‫ּפ‬: A field harvested by gentiles, or harvested by robbers, or which ants
have bitten [the stalks at the roots], or which wind and cattle have broken down, is exempt from
peah. If [the owner] harvested half of it and robbers harvested half, it is exempt from peah, for
the obligation of peah is in the standing grain.

‫ קָ צַר ֶח ְצי ָּה‬.‫ הַּלֹו ֵק ַח נֹותֵן ּפֵָאה לַּכ ֹל‬,‫ ָקצַר ֶח ְצי ָּה ּו ָמכַר ֶח ְצי ָּה‬.‫ּׁש ָּקצָר‬
ֶ ‫ נֹותֵ ן ּפֵָאה ִמ ַּמה‬,‫קְ צָרּו ָה ִל ְסטִים ֶח ְצי ָּה ְו ָקצַר הּוא ֶח ְצי ָּה‬
‫ הּוא נֹותֵ ן ּפֵָאה לַּכ ֹל‬,‫ הַּפֹודֶ ה ִמּי ַד ַה ִּגזְּבָר‬,‫ ְו ִהקְּדִ יׁש ֶח ְצי ָּה‬: If robbers harvested half and the owner the other
half, he gives peah from what he has harvested. If he harvested half and sold the other half, then
the purchaser must give peah for the whole. If he harvested half and dedicated the other half,
then he who redeems it from the Temple treasurer must give peah for the whole.
