CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease of Equipment (herein referred to as the “Contract”), is made and entered
into and between:

ZAMBOANGA MATERIALS TESTING LABORATORY, a firm duly organized and established

under the laws, rules and regulations of the Republic of the Philippines, with office address at Gov.
Ramos Ave., sta. Maria Zamboanga City, represented herein by its Owner/General Manager,
ENGR. HADJI FAIZAL C. HASIMAN, hereinafter referred to as the “LESSOR”;

- and –

ALRAF CONSTRUCTION & ENT., a duly organized and existing by laws, rules and regulations of
the Republic of the Philippines, with office address at HL Building gov. Camins Avenue,
Zamboanga city, represented herein by its Owner, AL-HASSAN C. HASIMAN, hereinafter
referred to as the “LESSEE”;

WITNESSETH:

WHEREAS, the LESSOR is engaged in the business of leasing out heavy equipments and
machines (herein referred to as the “LABORATORY EQUIPMENTS”), and providing services for
the use and operation thereof;

WHEREAS, the LESSOR is willing and has agreed to lease out the equipments to the LESSEE,
subject to certain terms and conditions;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR and the
LESSEE hereby agree and bind themselves to the following terms and conditions:

1.) RENTAL RATE – the LESSOR agreed to lease to the LESSEE 1 set of BRASS
SIEVE, 1 unit SAMPLE SPLITTER 2” CHUTE COMPLETE W/ STAND & TRAYS, 1 unit
SAMPLE SPLITTER 1” CHUTE COMPLETE W/ STAND & TRAYS, 1 unit SIEVE BRUSH MADE
OF BRASS IN WOODEN HANDLE, 1 unit HARD BRISTLE BRUSH, 1 unit PAINT BRUSH 2.5
CM, 1 unit LIQUID LIMIT DEVICE, 1set PLASTIC LIMIT, 1 unit CENT. 0-GRAM BALANCE, 1
doz MOISTURE CAN, 1 UNIT GRADUATED CYLINDER,1 unit EVAPORATING DISH, 1 unit
GROOVING TOOL & SPATULA, 1 SET COMPACTION MOLD 6” & 4”, 1 unit YIELD BUCKET, 1
unit TAMPING ROD, 1unit SAMPLE EJECTOR, 1 unit WASH BOTTLE, 1 set ORGANIC
IMPURITIES TEST, 1 set LOS ANGELES ABRASION MACHINE, 1 set SAND DENSITY, 1 set
SPEEDY MOISTURE, 1 set LABORATORYT OVEN, 1 set CBR MECHANICAL LOADING & ITS
MOLD, 1 set VERTICAL CAPPING, 1 unit CONCRETE PENETROMETER, 1 set SLUMP TEST,
1 unit PLATFORM BALANCE, 1 unit CONCRETE CYLINDER MOLD 6’X12”, 1 unit BEAM
MOLD 6” X 6” X 21”, 1 unit K-SLUMP TESTER, 1 unit 225mm extension shaft, 1 unit
SPECIMEN CUTTING MACHINE, 1 unit HEAVY DUTY SOLUTION BALANCE, 1 unit TRIPLE
BEAM BALANCE, 1 set YIELD BUCKET, 1 unit ALUMINUN BOWL, and 1 bot. SODIUM
HYDROXIDE. at the rates computed on per hour basis, exclusive to tax and diesel. Inclusive of
qualified operator, repairs, servicing and maintenance and all other works necessary to keep the
equipments in good working conditions, as follows;

2.) PAYMENT TERMS – the LESSOR shall bill the LESSEE every week and payment is
expected 2 to 3 (Two to Three) days upon submission of billing. Failure to comply in the payment of
the billing, the unit will not continue in its operation and the LESSEE will be charged 2 (Two) hours
standby time per day until such time payment will be settled.

3) TERMS AND CONDITION – the LESSOR and LESSEE hereby agrees on the following:
a.) If the equipment is idle or not working due to fault of the staff of the LESSEE
as attested by the LESSOR’s Operator and LESSEE’s Supervisor, then the
LESSOR is entitled to a standby time, which however, should not exceed to
two (2) hours per day.

b.) That the LESSEE will not pay stand-by time during equipment breakdown. In
cases of no operation due to unavailability of diesel, it will still considered as
continuous operation and same shall be paid by the LESSEE.

c.) That the LESSEE shall be responsible in providing shelter and security to the
operators and helpers.
 d. ) The LESSEE agrees to provide security for the safety of the equipment.
Provided further therefore that any loses of damages caused by human factors
(terrorisms, theft, etc.) shall be for the account of the LESSEE.

4.) LESSOR’S PERSONNEL – The LESSEE shall not hire the operators, drivers and
laborers of the LESSOR.

5.) AMENDMENT – This agreement shall be valid and official after having signed by the
herein parties. Unless otherwise amended, rescinded, or terminated by way of formal notices
served by either party within period of 15 days based on the breached of contract and/ or non-
performance and/or violation by either party of any herein stipulated.

7.) EQUIPMENT AVAILABILITY – The above mentioned equipment shall be made

available upon the LESSEE’s request or upon award of any contract awarded to them.
