Agreement on Custody and Support

KNOW ALL MEN BY THESE PRESENTS:


This Agreement on Custody and Support made and entered into by and between:
JOYCE ANNE R. REVELLAME, Filipino citizen, of legal age and a resident of Rayo
St. Mambangnan, San Leonardo, Nueva Ecija, Philippines, hereinafter referred to as the
“FIRST PARTY”;
-and-
JOHN MARK IRVIN P. CENON, Filipino citizen, of legal age, and a resident of
Mangino, Gapan City, Philippines, hereinafter referred to as the “SECOND PARTY”;

WITNESSETH THAT
WHEREAS, the FIRST PARTY and the SECOND PARTY bore a child out of
wedlock named ALTHEA QUIRLYN R. CENON, hereinafter referred to as the “CHILD”.
WHEREAS, the FIRST PARTY being the biological mother of the child is currently
having the custody of the CHILD;
NOW, THEREFORE, for in consideration of the foregoing premises, and of the terms
hereinafter provided, the parties hereby agree to execute this Agreement under the following
terms and conditions:
I. GUIDING PRINCIPLES

A. Best Interest of the Child


In all decisions involving the CHILD of the parties, the best interest of
the CHILD will be the primary consideration.
B. Good faith

Both parties will honor the agreement in good faith and assume that both
parties are acting in good faith in the implementation of this agreement.

C. Recognition of Each other as Co- Parents

Both parties recognize each other as common parents of their CHILD, give
respect to their role as parents and will mutually cooperate with each other
for the best interest of the CHILD.

II. PARENTING

A. The father shall have access and visitation rights with the CHILD every week
ends starting from Friday of 5:00 P.M. to Sunday 5:00 PM, Starting
September 3, 2021;

a.1. During the vacation of the CHILD, the CHILD will stay alternately with the
FIRST PARTY and the SECOND PARTY every two weeks.

a.2 The CHILD will stay with the FIRST PARTY during Christmas Breaks and
to the SECOND PARTY during New Year’s Break.

B. Neither parent shall say anything of a derogatory nature against the other in the
presence of the CHILD. Both parents hereby agree to refrain from making

statements that may tend to dissuade the CHILD from spending time with the
other parent.

III. FINANCIAL SUPPORT OF THE CHILD

A. Both parties shall provide the necessary support for their CHILD. In the case of
Financial support, as much as possible, IT WILL BE EQUALLY DIVIDED
between the parents.

a.1. The SECOND PARTY shall be obliged to give a financial support to the CHILD
in the amount of FIVE THOUSAND PESOS (₱5,000.00) on a monthly basis starting
September 2021 by depositing the same to the Bank Account of the CHILD;

a.2. The FIRST PARTY and the SECOND PARTY shall equally share with the
payment of the tuition fee of the CHILD.

IV. MUTUAL PROVISIONS

A. This Agreement on Custody and Support is binding to both parents and


supersedes any oral or written CHILD visitation agreements;

B. In case of material breach of the terms and conditions of this agreement, the
innocent party is hereby authorized to file appropriate criminal, civil or any suit
for the purpose of compelling compliance with the terms and conditions of this
agreement or to punish any material breach thereof;

C. Parties shall undertake to keep this matter confidential and should not divulge to
anybody the terms and conditions of this agreement, except for lawful cause;

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be


executed in accordance with the laws of the Republic of the Philippines this 26 th day of
July 2021 at the Public Attorney’s Office Gapan City, Nueva Ecija.
