SP ORDINANCE NO. 5583-2018 AN ORDINANCE AMENDING SP ORDINANCE NO. 2415-2002 BY RECLASSIFYING THE LAND OWNED BY VCDU REALTY CORPORATION, REPRESENTED BY VICTOR S. UY, PRESIDENT/GENERAL MANAGER, DESCRIBED AS LOT NO. 9-A, PSD-13-024426, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. 157-2016002299, CONTAINING A TOTAL AREA OF TWO THOUSAND TWO HUNDRED EIGHTY-SIX SQUARE METERS (2,286 M’), LOCATED IN BARANGAY AMBAGO, BUTUAN CITY, FROM AGRICULTURAL TO RESIDENTIAL, AND FOR OTHER PURPOSES Page two SP Ord. EXPLANATORY NOTE WHEREAS, presented before the Honorable Sangguniang Panlungsod is Local Zoning Board of Appeal (LZBA) Resolution No. 025, series of 2018 adopted on April 11, 2018 approving the application for reclassification of a parcel of land owned by VCDU Realty Corporation, represented by Mr. Victor S. Uy, President/General Manager, described as Lot No. 9-A, Psd-13-024426, covered by Transfer Certificate of Title No. 157- 2016002299 containing a total area of Two Thousand Two Hundred Eighty-Six Square Meters (2,286m”), located in Barangay Libertad, Butuan City, from Agricultural to Residential; WHEREAS, the above-described property under BCCLUP-01-82102, as indicated in its Vicinity Map, is within the Agricultural Zone under the Zoning Ordinance of the City of Butuan adopted through SP Ordinance No. 2415-2002 specifically Section 7. Article IV thereof; WHEREAS, the SP Committee on Land Use, Zoning and Human Settlement, in its series of hearings, reviewed and duly considered all the documents presented in support to the application for reclassification, and found to have satisfactorily complied with the requirements as provided by law, and therefore recommended the approval of the said application for reclassification; WHEREAS, this Honorable SP Body finds the LZBA Resolution in order and sustains the recommendation of the said SP Committee. Be_it ordained by the Honorable SangguniangPanlungsod of Butuan City in session assembled and by authority of the same that: SECTION 1. AMENDATORY CLAUSE. Per LZBA Resolution No. 025, series of 2018 enacted on April 11, 2018, Section 7, Article IV of SP Ordinance No. 2415-2002 is hereby amended by reclassifying a parcel of land owned by VCDU Realty Corporation, represented by Mr. Victor S. Uy, President/General Manager, described as Lot No. 9-A, Psd- 13-024426, covered by Transfer Certificate of Title No. 157-2016002299 containing a total area of Two Thousand Two Hundred Eighty-Six Square Meters (2,286m’), located in Barangay Libertad, Butuan City, from AGRICULTURAL to RESIDENTIAL. OSIN, DESCRIBED AS LOT NO. 7, PCS- 13-001590, COVERED BY TRANSFER CERTIFICATE OF TITLE NO. 157-2017002731, CONTAINING A TOTAL AREA OF THREE THOUSAND FIVE HUNDRED TWENTY SQUARE METERS (3,520M’), LOCATED IN BARANGAY LIBERTAD, BUTUAN CITY, FROM RESIDENTIAL TO COMMERCIAL, AND FOR OTHER PURPOSES Page two SP Ord.
