II. BACKGROUND/SITUATION ANALYSIS

COVID-19 and no-fault attendance policies

Jon Hyman
09 November 2020

Can you “point” an employee under a no-fault attendance policy for a coronavirus-related absence?
For example, an employee sick with COVID-19 or awaiting test results, quarantined because of an
exposure, or at home because a child needs care?

For the uninitiated, no-fault attendance policies operate by having workers accumulate “points” for
missing work, arriving late or other attendance-related issues; after the accumulation of a pre-
determined number of “points,” employees face discipline or even termination.

During the ongoing COVID-19 pandemic, these policies are not only unnecessarily cruel, but they
also might be illegal.

Generally speaking, if a law protects the absence (i.e., the FMLA or the ADA), then it is unlawful
under such law to assign a point under an attendance policy for the absence. While there have not
been any such cases decided under the IATF, one can safely assume the same logic applies.

The IATF on Covid19 health protocols prohibits close contacts with other people thus workers are
also directed to follow this order. Many workers like teachers need to protect themselves from the
threat of the virus and so the Department of Education ordered the Alternative Work Arrangement of
teacher in reporting to school. There is a two-day work from home and three-day skeletal work force
scheme followed by the teachers so there comes the problem in logging in and out of work in a
week.

This innovation will help teachers complete their attendance in a week without failing to log in and
out after eight hours of service in the school. There are pictures sent on the online form as proof of
the daily accomplishments of the teachers. Doubts on whether the respondents were honest in their
submitted accomplishment reports arises but, the oaths taken by teachers upon entering this
profession is frequently reminded and reiterated as they see the google form description written.

Since the google form is online, teachers may submit their attendance even when they are at home
or in school. No close physical contact may occur during the logging period as the method used is
online where they may use heir cellphones or laptops to answer and submit the online attendance.
This may also help record a perfect attendance in a whole year. A complete accomplishment report
for all teachers is easily gathered without requiring the individual submission of daily AR, thus
benefitting all teachers and relieving them of additional task to do aside from their regular activities
of preparing the modules for distribution and checking of outputs.

Dampe Elementary school

Sir,

Greetings!

The IATF reiterates the minimum health protocol on physical distancing and we teachers
are not excepted from following that. In view of this order, we ELVIE S. GUEVARRA, Teacher III
and GIRLEY E. SAMPANG, Teacher III of this school derived a plan to solve our problem in
attendance when we are in work from home mode. This tool, sir, will help us attain a perfect
attendance at the end of the school year, likewise it will help teachers submit their attendance
whether they are in school or at home. This will also help in monitoring the daily accomplishment of
each teacher.

We request your meritorious approval of this project proposal for the innovation on
teacher’s attendance titled, “MANAGEABLE SECURED ACCESS ON A TWO-WAY REPORTING
SCHEME OF DAMPE ELEMENTARY SCHOOL PERSONNEL FOR SY 2021-2022. We believe
that this innovation will benefit us all.
