Dear Iona,

We are pleased to offer you employment on a casual basis with Lush Australasia Retail Pty Limited
(​Company​) on the terms set out in this letter and the accompanying Terms Sheet.]

Your terms and conditions of employment will be regulated by an industrial instrument. The instrument
which currently applies to your position is the General Retail Industry Award 2010 (​Modern Award​). The
Modern Award will not form part of your contract of employment.

1. Position

1.1 You will be employed on a casual basis as a Sales Assistant or such other position determined by
the Company from time to time. This means that you will be offered a series of casual
engagements, each engagement commencing at the beginning of each shift and ending at the
completion of each shift and being a minimum of three hours.

1.2 You acknowledge that you are employed as a casual employee and that this offer of casual
employment does not involve any representation or expectation of continuing work or regular or
systematic engagement, and that the number of hours that the Company may offer you each
week and the days and times for the performance of work may vary, due to the irregular nature of
casual employment (regardless of rostering arrangements).

1.3 You are not obliged to accept any work offered to you. However, you must use your best
endeavours to accept work as and when the Company offers it to you and wherever possible give
the Company at least 3 working days’ notice of your unavailability.

1.4 You will initially be based at Robina although you ​may


​ be required to work at other locations, as
required by the Company from time to time. You acknowledge that as part of your role, you may
be required to undertake travel.

2. Commencement and Term

2.1 Your employment under this agreement will commence on Monday 9th September
(​Commencement Date)​.

2.2 You will initially be employed on a probationary basis for a period of 6 months from the
commencement of your employment with the Company ( ​Probationary Period​). However, the
length of the Probationary Period is not intended to affect the minimum employment period under
the FW Act.

2.3 Your employment may be terminated in accordance with clause 10 of the Terms Sheet.

3. Duties

3.1 You will report to and work under the direction of the Store Manager or such other position
determined by the Company.

3.2 A position description setting out the initial requirements of your position is attached. The outline is
not intended to be an exhaustive list of the duties you may be required to perform, rather an
indication of the kinds of duties that fall within the scope of the position. The Company may
change these requirements from time to time.

4. Hours

4.1 As a casual employee, you are not guaranteed a regular pattern of working hours. You will be
engaged to perform hours of work in accordance with the operational needs of the business and
subject to your availability.

4.2 You may be rostered to work any day of the week, Monday to Sunday, at times determined by the
Company. Currently our usual business hours are Monday to Wednesday 9:00am-5:30pm,
Thursday 9:00am-9:00pm, Friday 9:00am-5:30pm, Saturday 9:00am - 5:30pm and Sunday
10:00am - 4:00pm, but these hours may change from time to time.

5. Remuneration

5.1 For all ordinary hours of work, you will be paid the base hourly rate of pay of ​$26.76​inclusive of
the casual loading under the Modern Award, provided that this rate of pay may be increased from
time to time if required in order to comply with the applicable Modern Award.

5.2 You will be entitled to any applicable penalty rates, overtime rates or allowances appropriate to
your position as set out in the Modern Award.

5.3 Where your remuneration or any other benefits or entitlements paid to you at any time exceeds
the minimum wage or any other minimum benefits or entitlements payable to you under the
Modern Award or the ​Fair Work Act 2009 ​(Cth) (​FW Act​) (including any penalty or loading,
howsoever described, paid in error) (​Over Award Payments​):

(a) those Over Award Payments will be applied towards and set off against any claims that
you may at any time have against the Company relating to any underpayment or
non-payment of minimum wages, overtime, penalties, allowances, loadings, or any other
monetary entitlement under the Modern Award or the FW Act; and

(b) any entitlement that you may have in respect or wages, overtime, penalties, allowances,
loadings or any other monetary entitlement payable under the Modern Award or the FW
Act will, so far as possible, be calculated by reference to the relevant minimum Modern
Award rate, rather than the Over Award Payment.

Superannuation

5.4 The Company will make contributions for you into a superannuation fund which equals the
minimum level of superannuation contributions which the Company must make for you so as not
to be liable to pay a charge, in accordance with its statutory obligations (as amended from time to
time) (​Contributions​). Upon commencing employment, you must do everything necessary to
allow the Company to make the Contributions.

6. Other Discretionary Benefits

6.1 From time to time, the Company may provide you with additional bonuses and benefits, whether
or not pursuant to a formalised bonus or incentive scheme. Such additional bonuses and benefits
do not form part of your contract of employment and the Company may cease providing them, or
vary the terms upon which they are provided at any time.

6.2 Unless you are advised in writing that a benefit is part of your Remuneration, it will be a
discretionary benefit to which this clause applies.

6.3 The discretionary benefits presently provided by the Company include:

(a) a 50% discount on the full retail price of any qualifying Lush products purchased by you
for your personal use in accordance with Lush policy.

6.4 From time to time, the Company may provide you with additional bonuses and benefits, whether
or not pursuant to a formalised bonus or incentive scheme. Such additional bonuses and benefits
do not form part of your contract of employment and the Company may cease providing them, or
vary the terms upon which they are provided at any time.

6.5 Any bonus or incentive payment will be paid to you monthly, provided you remain employed at the
time the payment falls due and is inclusive of any superannuation which the Company is required
to pay.

7. Public Holidays

7.1 You may be required to work on Public Holidays if the store where you are working at that time is
open for trade on that Public Holiday. ​You may refuse the request if you have reasonable grounds
for doing so.

8. Eligibility

8.1 This offer, and your continuing employment, is conditional upon:

(a) your eligibility to lawfully work in Australia, including gaining and maintaining any
necessary work visas / work permits (​Visa Requirements​); and

(b) the satisfactory results (as determined in the Company's reasonable discretion) of any
background, reference or reasonable medical checks required by the Company,

8.2 If you fail to meet, or fail to continue to meet, any of the Eligibility Requirements, this offer of
employment may be immediately withdrawn by the Company or, if you have already commenced
employment with the Company, ​your employment may be terminated.

8.3 You consent to the Company conducting a Visa Entitlement Verification Online ( ​VEVO​) check with
the Department of Immigration or its successors and must provide all information and documents
(including your passport identity page) to the Company to enable this check to be conducted.

8.4 You will immediately advise the Company if you cease to satisfy the Visa Requirements or are
likely to do so in the future.

9. Terms Sheet

9.1 A copy of the Terms Sheet is attached. The Terms Sheet forms part of your employment
agreement and, read together with this letter of offer, constitutes the entirety of your contract of
employment with the Company.

Please sign the last page of this letter and the Terms Sheet, as confirmation of your acceptance of the
position on the terms set out in this letter and the Terms Sheet, within seven days.
