CONTRACT OF SERVICE

Know All Men By These Presents:

This Contract of Service is entered into this ___ day of ______________ by and between:

___________________, a corporation duly organized and existing under the laws


of the Philippines, with principal office address at __________________
(hereinafter referred to as the “COMPANY”).

___________________________, (hereinafter referred to as the
“PERSONNEL”).

That on the PERSONNEL’s representation and warranties that he is medically and


physically qualified for the work that he applied for, and for submitting the required clearances
and documents, the COMPANY is hereby hiring the services of the PERSONNEL under the
following terms and conditions:

1. There being only a temporary need for the services of the PERSONNEL due to the
current demands of the COMPANY for: ________________________________, the
PERSONNEL’s contract of service will be non-renewable, specifically for the fixed
duration commencing on _____________ and automatically expiring on
_______________.

2. Nevertheless, at any time during the effectivity period of this Contract, COMPANY
may terminate it without benefit of termination pay:
(a) If the PERSONNEL is found not qualified, competent or inefficient in the
above-stated work for which his services was hired;
(b) If the PERSONNEL is found physically or medically unfit for the job;
(c) If the PERSONNEL engages himself in any activity which is directly
competitive with the COMPANY’s business or any part of its operation;
(d) If the PERSONNEL violates any of the COMPANY’s rules and regulations
which shall be the PERSONNEL’s duty to know and study immediately upon
the signing hereof; or
(e) For any of the causes, and under the circumstances and conditions recognized
by law and jurisprudence for the termination of contracts.

3. The PERSONNEL agrees to abide by the prescribed working hours set by the
COMPANY. He shall not perform any overtime work on any weekdays or on
prescribed rest days or legal holidays unless specifically directed by the COMPANY
of his authorized representative in each instance.

4. The PERSONNEL agrees, during the entire period of this Contract, to be assigned to
another work as may be determined by the COMPANY and whenever the operation
thereof requires such re-assignment.

5. For and in consideration of the services rendered, the PERSONNEL shall be paid the
amount of ____________________________________ PESOS (Php_________.00)
per month as compensation, which shall be payable every ________ day of the
month.

6. This Contract does not entitle the PERSONNEL to vacation leave and/or sick leave,
nor to any benefit that is or may be granted to regular and permanent employees of
the COMPANY.

7. The PERSONNEL agrees that all records and documents of the COMPANY and all
information or secret processes pertaining to its business or affairs are considered
confidential and unauthorized disclosure or reproduction of the same shall not be
made by the PERSONNEL at any time during or after this Contract.

8. That the contents of this Contract have been explained and made clear to the
PERSONNEL in the language or dialect known to him.

9. The PERSONNEL’s signature below in the space provided hereunder will signify his
full acceptance of the foregoing terms and conditions.
