CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This agreement is made and entered into and executed at Opol, Misamis
Oriental on this _______day of August 2022, by and between:

The MUNICIPALITY OF OPOL, a Local Government Unit of the

Province of Misamis Oriental, created and established by virtue
of Republic Act. No. 7160 otherwise known as the Local
Government Unit Code of 1991, with principal address at the
Municipal Hall of Opol, Misamis Oriental, in this deed officially
represented by its duly authorized Tourism-designate, the Ms.
RINA A. CALIZA, hereinafter referred to as the “FIRST
PARTY”;

-and-

RUBEN NIÑO S. BALANE, of legal age, Filipino citizen, a

resident of Molugan, Elsalvador City, hereinafter referred to as
“ORGANIZER”.

(Collectively referred to as the PARTIES)

-WITNESSETH-

WHEAREAS, the MUNICIPAL TOURISM OFFICE of the Municipality of Opol

desires to engage the professional and technical services of the ORGANIZER;

WHEREAS, the ORGANIZER has signified his willingness and ability to

undertake the job;

NOW, THEREFORE, for and in consideration of the foregoing and the mutual
covenants of the parties hereinafter specified, the parties have agreed as follows:

1. SERVICES – the ORGANIZER shall provide the MUNICIPALITY OF OPOL

with the following services, to wit:

(a) Production and directing duties and responsibilities:

(b) Event and production management;
(c) Host and Voice over supplier;
(d) Choreography and training;
(e) Video and Photo production;
(f) Graphic designs and decorations;

2. PERIOD – Unless sooner terminated by either party, the ORGANIZER’S

engagement shall commence on July 30, 2022 to September 3,2022 without
prejudice to a renewal thereof upon such terms and conditions as may be
agreed upon by the parties. Any party who decides to terminate the
agreement must notify the party at least one (1) month before the intended
date of termination
 3. ORGANIZER FEE- the FIRST PARTY shall pay the ORGANIZER a
remuneration in respect of the services performed during the Term of
Engagement in the professional fee of One Hundred Ninety One Thousand
Pesos (PhP 191,000.00), exclusive of VAT;

4. CONFIDENTIALITY – All information, papers or documents

processes/gathered/written by the ORGANIZER for purposes of his
assignment may not be reproduced, circulated, published or given to third
parties by him/her without the prior written consent of the First Party.

5. CONFLICT OF INTEREST – Should a conflict of interest arise, the

ORGANIZER shall forthwith disclose the existence and details thereof to the
First Party which may, at the First Party’s sole discretion, continue or
terminate this Agreement.

6. COPYRIGHT – The copyright to the reports, technical papers and other

materials produced by the ORGANIZER shall become the sole property of the
MUNICIPALITY OF OPOL.

7. AMENDMENT – This agreement may be amended or revised mutually by the

parties concerned within the stipulated period and upon such terms and
conditions mutually agreed upon. It is understood that this service contract
does not create an employer-employee relation between the MUNICIPALITY
and the ORGANIZER; that no services rendered hereunder shall be deemed
as government service for the purpose of retirement and other benefits; that
the ORGANIZER may be summoned by the First Party at any reasonable
time to render urgent service to the Municipality or its component Barangays
relative to his tasks, as described under paragraph 1 and its sub-paragraphs
hereof. This contract may be terminated by the MUNICIPALITY for cause
which shall forthwith be communicated to the Organizer and such action shall
take effect one (1) month from the issuance or communication thereof.

8. This agreement shall constitute the complete and exclusive statement of the
terms and conditions between the parties with respect to the subject matter
referred to herein. No statement or agreement, oral or written, made prior to
the execution hereof, and no prior conduct or practice of either party shall
vary or modify the written terms and conditions set forth herein. No
alterations, additions, or variations of the terms and conditions of this
agreement shall be valid unless made in writing and signed by both parties
thereto; and

9. Finally, should any provision of this contract be declared null and void,
inefficacious or ineffectual for any reason whatsoever, the other provisions
shall remain in full force and effect notwithstanding such defect or flaw.
