AN ORDINANCE REGULATING THE OPERATION FLOATING COTTAGES, DESIGNATING


AREA OF OPERATION AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF.

SECTION 1. – NAME OF ORDINANCE.

SECTION 2. – STATEMENT OF POLICY

SECTION 3. – DEFINITION OF TERMS

SECTION 4. – MAXIMUM NUMBER OF FLOATING COTTAGES. No person, juridical or natural


shall own two (2) floating cottages for business shall operate within the Municipal waters of
Laguindingan and within the jurisdiction of Barangay Tubajon.

SECTION 6. – MARKINGS. IDENTIFICATION. Owner/Operators shall legibly inscribe their Business


name and their designated number on the body of the floating cottage/s.

SECTION 7. – AREA OF OPERATION. The area fifty hundred (50) meters, but in, no case beyond two
hundred (200) meters offshore, and two hundred (200) meters away from the marine protected area.

SECTION 8. – UNITS IN OPERATION. LIMITATION. A maximum of Ten (10) floating cottages u


shall be allowed to operate in its respective area of operation within the Municipal waters of
Laguindingan and within the jurisdiction Barangay Tubajon.

SECTION 9. – OPERATION POLICIES. The following operation policies shall be strictly observed.

Foods and/or drinks should not be thrown in the sea waters. Plates, food containers, cups,
utensils and the like should not be washed in the sea waters

Operators shall orient the floating cottage occupants of safety measures.

No floating cottage shall operate outside the approved

SECTION 7 – REQUIRED EQUIPMENT. Every (10) floating cottages shall have the following:

Life jackets (for Adult and Children)

SECTION 8. – PERMIT REQUIREMENTS. The following requirements are pre-requisites for issuance
of Barangay Business Clearance to Operate.

Present Floating Cottage plan to the Barangay Council and secure favorable endorsement from
the majority of the Barangay Council of Tubajon.

Inspection Certificate from the Barangay Tourism Council, or in the absence


thereof, the Barangay Council of Barangay Tubajon for the sea worthiness of the floating
cottage/s used in the business.

Payment of regulatory fees.

SECTION 9. Regulatory Fees.


Floating Cottage - 2,000/Annum/ Cottage

SECTION 10. – PENALTIES. The following penalties shall be imposed to those who violate any
provision of this ordinance.

FREQUENCY RENTER PENALTY OPERATOR/OWNER

First & Second Offense ₱1,000.00 ₱1,000.00 impoundment

Third & Subsequent Offenses ₱1,000.00 ₱2,500.00 and cancellation of Mayor’s


Permit to operate.

SECTION 11. – REPEALING CLAUSE. All other ordinances, rules and regulations, or parts thereof,
whose provisions are in conflict with, or contrary to, the provisions of this ordinance are hereby repealed,
amended or modified accordingly.

SECTION 12. – EFFECTIVITY. This ordinance shall take effect upon approval and proper publication.
