CANCELLATION OF DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Cancellation of Deed of Absolute Sale, made and entered on January 11, 2023, by
and between:

JUDITH B. GOMEZ, of legal age, Filipino, married with postal address at

Himaya, El Salvador, Misamis Oriental, Philippines, hereinafter referred to as the
“VENDOR”;

and

LEO MARIE OCHO FABRE, of legal age, Filipino, a resident of Block 43, Lot 5,
Johndorf Subdivision, Barra Opol, Mismais Oriental, hereinafter referred to as the
“VENDEE” and represented by GOLDIE MARIE O. FABRE, of legal age, Filipino,
residing at Block 43, Lot 5, Johndorf Subdivision, Barra Opol, Mismais Oriental. (A copy
of the said Special Power of Attorney is hereto attached as Annex A)

WITNESSETH: THAT

WHEREAS, on 11 January 2023, the parties executed a Deed of Absolute Sale over a
parcel of land registered as TCT No. 21128, situated in Himaya, El Salvador City,
Misamis Oriental containing an area of more or less Two Hundred square meters. (200
sq. m.) which transaction was entered into in the notarial book of Notary Public Atty.
Dariel Palasan as Doc. No. 239; Page No. 49; Book No. 1; Series of 2023 (A copy of the said
Deed of Absolute Sale is hereto attached as Annex B);

WHEREAS, the parties wish to CANCEL, RESCIND and ANNUL said Deed of
Absolute Sale and declare the same VOID AB INITIO for failure to effect the necessary
consideration;

NOW, THEREFORE, in consideration of the foregoing premises, the parties hereby

unconditionally CANCEL, RESCIND, ANNUL, and declare VOID AB INITIO and
without legal effect whatsoever the Deed of Absolute Sale executed by the parties on 11
January 2023.

WITNESS WHEREOF, the parties have hereunto signed this CANCELLATION OF

DEED OF ABSOLUTE SALE this 23rd day of May 2023 in Cagayan de Oro City.
