Fire afet Act 2021
The Fire afet Act 2021 (the Act) received Roal Assent on 29 April 2021 and
commenced on 16 Ma 2022. The Act amends the Regulator Reform (Fire afet)
Order 2005 (the Fire afet Order).
The Act clarifies that responsile persons (RPs) for multi-occupied residential uildings
must manage and reduce the risk of fire for the structure and external walls of the
uilding, including cladding, alconies and windows, and entrance doors to individual
flats that open into common parts.
The Act applies to ngland and Wales. Information on how the Act applies within

NFCC welcomed the Fire afet Act and its intent. The Act clarifies the areas of a
multi-occupied residential uilding to which the Fire afet Order applies. The PPRU
has worked closel with Government from the Act’s inception. In June 2020, the

Fire Risk Assessment Prioritisation Tool
The PPRU has supported the Home Office Task and Finish Group in the production of
a new Fire Risk Assessment Prioritisation Tool (FRAPT). The FRAPT is an online tool
designed to assist responsile persons to develop a strateg to prioritise their
uildings to review their fire risk assessments, to ensure the take into account the
clarifications outlined in the Act.

The Fire afet (ngland) Regulations 2022
The Fire afet (ngland) Regulations 2022 (the Regulations) have een introduced
as an important step towards implementing the recommendations of the Grenfell
Tower Inquir Phase 1 report. The Regulations are eing introduced under Article 24
of the Fire afet Order and will come into force on 23 Januar 2023.

Most of the requirements set out in the Regulations are imposed on the responsile
person (RP), which RPs need to plan and prepare for ahead of the Regulations coming
into force.
The regulations require RPs in multi-occupied residential uildings to take specific
actions, depending on the height of the uilding:
some provisions appl regardless of height
more are needed once a uilding reaches 11 metres, and
further requirements are introduced when a uilding reaches 18 metres (or 7
further requirements are introduced when a uilding reaches 18 metres (or 7
stores) or more.
