IMPLEMENTING GUIDELINES, RULES AND REGULATIONS ON ATTRITION


SYSTEM IN THE ARMED FORCES OF THE PHILIPPINES (AFP)

2. ' DEFINITION OF TERMS:
a. Active Commissioned Service-In-Grade - . refer/> to the
cumulative years in the active service rendered by an officer in a particular grade on
permanent status.

b. Active Service - refers to the cumulative years of military active


service and civilian government service rendered by an individual. .
c. A year of Active Military Service - refers to 12 months.
d. Attrition - The reduction of personnel asa result of resignation,
retirement, dismissal, separation or death in accordance with the existing laws . .
e. Attrition System - personnel management tool that denotes end
of one's military service. Attrition in the AFP consists of four (4) .mOdes: natural,
voluntary, disciplinary and forced attrition.
f. Deferment - as used in this Circular shall mean the
postponement of promotion or compulsory retirement of an Officer.
g. Discharge - as used in this Circular shall mean that the military
personnel is released from his/her obligation to serve in the military service either
with prejudice or without prejudice in his/her separation benefits.
h. Disciplinary Attrition - is a mode of attrition of any military
personnel who commits an act of mi~conduct, immoral conduct, low potentiality or
sub-standard performance, use of illegal drugs and other substances prohibited by
law; intemperate use of alcohol and drunkenness and insubordination.
i. Dropping from Rolls - as used in this Circular shall mean the
deletion from the lineal list of Officer or Enlisted Personnel (EP) .

j. Enlisted Personnel (EP) - refers to any person regularly enlisted
in the AFP or an enlisted reservist who has been duly accepted and ~worn in for
trainee instruction, pursuant to the provisions of the National Defense Act.
k. Efficiency and Separation Board (ESB) - a board· that
determines the officer not fit for retention in the active service because of
substandard performance, low potentiality, doubtful integrity and/or acts inconsistent
with t he best interest of the AFP.
I. Expiration of Term of Enlistment (ETE) - a specific date after
rendering the initial three (3) years term of Enlistment and Reenlistment.

m. Forced Attrition - is a mode of attrition wherein an officer or EP,


who having been considered for promotion to the next higher grade or have not been
considered for retention pursuant to EO Nr 79 dated 02 December 1986, failed to
qualify on account of hislher own fault, failure or negligence or lack of individual
merit.
n. Grave Misconduct - misconduct that involves the elements of
corruption, clear intent to violate the law or flagrant disregard of established rule.
Corruption, as an element of grave misconduct, consists in the act of an official or
fiduciary person, who unlawfully and wrongfully uses his station or character to
procure some benefit for himself or for another person, contrary to duty and the
rights of others.
o. Gross Immorality - the act that is so corrupt as to constitute a
criminal act, or so unprincipled as to be reprehensible to a high degree or committed
under such scandalous or revolting circumstances as to shock the common sense of
decency.
p. Lateral Attrition - shall mean the separation from the military
service of commissioned Officers who are found unqualified for promotion after
attaining the prescribed active commissioned service-in-grade and age limit as
provided for by law.
q. Line of Duty (LOD) - shall mean that the death, illness or injury
incurred was not due to misconduct, wilful failure, intemperate use of drugs or
alcoholic liquor or vicious or immoral habits.
r. Line of Duty Board - a board that determines whether the death,
illness or injury of an Officer and EP was incurred in relation to the performance of
duty.
s. Military Personnel - refers to Officers, EP, cadets, probationary
officers, trainees (Candidate Soldiers) and draftees who are in the active service
of the AFP.
t. Military Active Service - refers to the actual service rendered by
an individual as a commissioned Officer, EP, cadet, probationary officer, trainee or
draftee in the AFP. •
u. Simple Misconduct - improper or wrong conduct. It is the
transgreSSion of some established and definite rule of action, a forbidden act, a
dereliction of duty, willful in character, and implies wrongful intent and not mere error
in judgment.
v. Natural Attrition - is a mode of attrition upon reaching 30 years
of active service or 56 years of age, whichever is later or when an Officer or EP
incurred death, illness or injury while in the active service.
w. Officer - refers to any commissioned Officer of the AFP,
whether regular or reserve.

x. Perfonnance Management System - refers to an organized or


established scheme or method of evaluating or measuring the performance,
effectiveness and potential of military personnel in the AFP.
y. PhYSical Fitness Test (PFT) - is a set of phYSical exercises used
as a standard measurement of one's ability to function effectively in physical work,
training and other activities.
z. Rank Structure - shall mean the total commissioned Officer and
EP strength in the military service by ranks, as prescribed by law.
aa. Retirement - shall mean cessation of military service with at
least 20 years of active service.
bb, Separation - shall mean cessation of military service by virtue of
a decision or order.
cc. Security of Tenure - shall mean that reserve Officer who has
satisfactorily rendered a total of ten (10) years of continuous active commiSSioned
military service shall not be reverted to inactive status, except upon his own request
or for cause as may be adjudged by a Court-Martial or by appropriate bodies existing
' by provisions of taw or by virtue of the operation of PO Nr 1638, which provides for
the forced attrition of Officers based on exigencies of the service, up to the time he
reaches the compulsory retirement of 30 years of service or 56 years of age,
whichever comes later, but not later than 60 years of age.
dd. Tenure-In-Grade ~ maximum number of years per grade that an
individual can remain in a specific grade.
ee. ' Time-In-Grade - the required number of years per grade that an
individual can qualify for promotion to the next higher grade.
ff, Total Pennanent Disability - status of personnel with P-4 status
or those personnel who could no longer 'perform military duties.
" gg. Voluntary Attrition - is a mode of attrition that is initiated by the
' individual himSelf/herself through hislher own accord or free will.
hh. Zene of Consideration - group of Officers of a particular
promotion list who shall be considered for promotion to the next higher grade,
3. SCOPE:
This Circular promulgates the Attrition System for military personnel in
the active service of the AFP, It establishes the framework governing the different
modes of attrition; and provides the implementing rules, policies and guidelines of all
laws, orders, regulations and directives pertaining to attrition of military personnel.
The provisions of this Circular shall apply to all military personnel in the
active service of the AFP.

4. PURPOSE:

This Circular embodies the rules, policies, procedures and guidelines


governing the attrition of all military personnel in the active service of the AFP. It
aims to guide the members of the AFP with all these rules, policies, procedures and
guidelines so that they may become active participants in the management and
development of their careers in the active military service or even when they go back
to their respective civilian lives.

5. AFP ATTRITION SYSTEM:

a. The AFP Attrition System is a complex system that involves


interrelated and interdependent personnel management functions (like Promotion,
Discipline, Law and Order (DLO), Morale and Welfare and others). These personnel
management functions continually influence one another either directly or indirectly
with the end in view of implementing the AFP Attrition System. Lastly, the AFP
Attrition System is a management function that may be utilized to maintain the
required rank structure of the AFP and in order to maintain efficient and professional
military personnel.

b. PO Nr 1638, otherwise known as the "AFP Military Personnel


. Retirement and Separation Decree of 1979", its amendments, implementing
directives and regulations provide the basic foundation of the AFP Attrition System.
It provides the different modes by which an Officer or EP may be retired or
separated from the service.

c. The AFP Attrition System has four (4) modes: 1) natural; 2)


voluntary; 3) disciplinary; and, 4) forced attrition.

d. The AFP maintains an authorized Officer grade distribution in


accordance with RA Nr 9188 and the Authorized Troop Strength (ATS) provided
under the annual General Appropriations Act (GAA). The Secretary of National
Defense (SND) shall prescribe the authorized number of Officers in the active force
in each grade and in each major, Technical and Administrative Services (TAS)
number in each grade authorized in the Table of Organization (T/O) of units of the
active force. •

6. OBJECTIVES:

a. To provide policy for a rational attrition of Officers and EP in the


active service;

b. To maintain equitable distribution of Officers and EP in the


active service; and

C. To maintain stable force structure.

7. AUTHORITY ON ATTRITION:

a. . The President has the authority to approve the following types of


r~tirement and separation in the AFP:

1) Optional Retirement of Officer;

2) Resignation of Officer;

3) Separation/Resignation of Reserve Officer with Security


of Tenure;

4) Dropping from the Rolls of Officers;

5) Separation with Total Permanent Disability of Officer;

6) Resignation, discharge and grant of separation benefits


of Philippine Military Academy ·(PMA) Cadets, and Candidate Officer of the Officer
Candidate School (OCS); and

7) Separation of Officer pursuant to an Ombudsman


decision.

b. The SND has the authority to approve the following


administrative matters relating to attrition of military personnel:

1) Compulsory retirement of Officers; and

2) Posthumous retirement/separation of Officers.

c. The Chief of Staff; AFP or the Major Service Commanders shall


have the approving and signing authority over the following retirement and
separation of Officers and EP:

. J) Reversion of Reserve Officers without Security of Tenure


and discharge of EP;

2) Dropping from the rolls of EP;

3) Compulsory and Optional retirement of EP;

4) Posthumous retirement/separation of EP; and

5) Separation of EP pursuant to Ombudsman decision.

8. MODES OF ATTRITION:

a. Natural Attrition:

1) Compulsory Retirement - Upon attaining 56 years of age


or upon accumulation of 30 years of satisfactory active service, whichever is later, an
Officer or EP shall be compulsorily retired; provided, that such Officer or EP who
shall have attained 56 years of age with at least 20 years of active service shall be
allowed to complete 30 years of service but not beyond his/her 60th birthday;
provided, however, that such military personnel compulsorily retiring by age 60 shall
have at least 20 years of active service: provided, further, that the compulsory
retirement of an Officer serving in a statutory position shall be deferred until
completion of the tour of duty prescribed by law; and, provided, finally, that the active
service of military personnel may be extended by the President, if in his/her opinion,
such continued military service is for the good of the service.

2) Posthumous Retirement - An Officer or EP with at least


20 years of accumulated satisfactory service, who dies in LOD, shall be considered
retired for survivorship benefits.
3) Posthumous Separation - An Officer or EP with less than
20 years of active service who dies in LOD or on account of any wound, injury or
illness contracted in LOD shall be considered separated from the service in the next
higher grade for survivorship benefits.

4) Retirement with Total Permanent Disability - .An Officer


or EP who, having accumulated at least 20 years of active service, incurs total
permanent physical disability in LOD shall be compulsorily retired.

5) Separation with Total Permanent Disability - An Officer or


EP with less than 20 years of active.service who incurs total permanent physical
disability in LOD shall be separated from the service in the next higher grade than
the permanent grade.

b. Voluntary Attrition:

1) Optional Retirement - Upon accumulation of at least 20
years of satisfactory active service, an Officer and EP may, at his/her own request
and with the approval of the President and the CSAFP or Major Service
Commander, respectively be retired from the active military service.

2) ReSignation - A regular Officer may reSign his/her


commission and shall be separated from the service upon acceptance by the
President of such resignation. A military personnel shall be considered Ipso Facto
Resigned from the military service upon the filing of his/her Certificate of Candidacy
(COC) for elective positions, pursuant to Omnibus Election Code of the Philippines.

3) Reversion - A reserve Officer who has satisfactorily
rendered a total of ten (10) years of continuous active commissioned military service
shall not be reverted to inactive status, except upon his/her own request or for cause
as may be adjudged by a Court-Martial or by appropriate bodies existing by
provisions of law or by virtue of the operation of PO Nr 1638, which provides for the
forced attrition of Officers based on exigencies of the service, up to the time he/she
reaches the compulsory retirement of 30 years of service or 56 years of age,
whichever comes later, but not later than 60 years of age.
4) Honorable Discharge - Honorable discharge is a form of
administrative separation of EP with commendable record from the military service
prior to the ETE. Honorable discharge may be due to Dependency or Hardship,
Convenience of the Government and For the Good of the Service. EP who has been
.honorably discharged is entitled to all furlough and other benefits incidental to
honorable separation from the service.
a) Dependency or Hardship - Dependency may be
availed of upon written request of EP due to death or disability of a member of
hislher family and by reason of which hislher family becomes prinCipally dependent
upon him/her for care and support. The term "member of the family' includes only
the wife, children, father, mother, brother, sister and any relative who has parental
authority over the EP prior to his/her enlistment. Hardship, on the other hand, may
be availed of by an EP upon written request when, under circumstances not
involving the death or disability of a member of his/her family, his or her discharge
will alleviate undue hardship to his/her family as to care and support.
b) Convenience of the Government occurs based on
the following grounds:
(1) To accept appointment as Regular Officer
or .Call to Active Duty (CAD) in the Regular Force as a Reserve Officer;
To accept appointment as cadet of the PMA
(2)
and other military schools/academies and as candidate officer of OCS;
(3) To dispose of cases where the immediate
separation of the EP does not run counter with the existing policy or regulation and
that his/her discharge is deemed most expedient on account of:
(a) Approved petition for
immigration/residence abroad;
(b) Acceptance of a better paying job
outside the service;
(c) Filing of optional retirement prior to
its approval;

(d) Physical and mental rehabilitation of


the EP; and

(e) Any other exceptional circumstances


or conditions that warrant immediate discharge from the service of the AFP in
keeping with a more liberal plan of attrition.

(4) To dispose of cases where immediate


separation due to unfitness, in lieu of discharge after trial by Court-Martial, is
determined to be more a convenient, practical and expeditious mode of separation,
consistent with the requirements of discipline, morale and welfare and the interest of
the service.

c) For the Good of the Service occurs when an EP


whose suitability or desirability for retention in the service has rendered him/her
subject to administrative separation due to unsuitability, may be immediately
discharged "for the good of the service" with his/her consent. An individual may be
discharged by reason of unsuitability, not due to misconduct, when it has been
determined that he is unsuitable for further military service because of:

(1) Inaptitude or ineptness due to lack of


general adaptability, want of readiness or skill, unhandiness or inability to learn;

(2) Character and behavior and personality


disorders due to psychiatric condition; and

(3) Alcoholism or addiction to alcohol.

d) Discharge upon ETE.

c. Disciplinary Attrition:

1) Violation of the Articles of War (AWs) - An Officer or


EP who violate the Punitive Articles under Commonwealth Act. Nr 408, as amended,
may be dismissed if meted the penalty of separation from the service by the

Court-Martial. •

2) Administrative Separation of Officer,

a) Act of Misconduct - An Officer who commits any


act of misconduct of such nature and gravity as to warrant his/her discharge or
separation from the service and/or acts inconsistent with the best interest of the
service shall be separated in the permanent grade he/she holds.

b) Immoral Conduct is an act forbidden under any of
the following circumstances:
Immorality is a ground for discharge, including but
not limited to: 1) maintaining illicit relations with a man/woman who is not his/her
husbandlwife; Provided, That sexual relations between two (2) single, consenting
adults and having no legal impediment to marry each other shall not constitute an
immoral act; 2) Commission of any of the crimes against chastity as defined in the
Revised Penal Code; an<;j, 3) Immoral conduct prejudicial to good order and military
discipline that is defined and punishable under the AWs; Provided further, that an
Officer who becomes pregnant out of wedlock, or sires a child out of wedlock, shall
not be deemed to have committed an immoral act: Provided, That both parties are
unmarried or otherwise legally capacitated to marry at the time of the act/pregnancy;
Provided further, That such act/pregnancy must not be grossly immoral, that is, it
must not be so corrupt and false as to constitute a criminal act or not so unprincipled
as to be reprehensible to a high degree.
c) Low Potentiality - An Officer who is referred to and
found by the AFP ESB or its equivalent in the Major Service not fit for retention or
fails to tlemonstrate satisfactory qualifications and efficiency as an Officer shall be
separated from the military service.
1) Failure in Schooling Duties
All Commanders are directed to refer all
Officers who fail in a formal course, in military or civilian schools, locally or abroad,
without valid reasons to the AFP ESB for determination of their fitness for retention
in ~he service and/or non-consideration for further schooling.
2) Failure in Physical Fitness Test
Any military personnel who fails the
minimum passing requirements after the final remedial PFT (third 13rd] take) shall be
imposed corresponding penalties and sanctions. Regular Officers or Reserve
Officers who have been granted SOT shall be referred to the appropriate ESB to
determine their fitness to remain in the service.
3) Substandard Performance
The Performance Evaluation Report (PER)
provides the AFP With information on an Officer's performance effectiveness and
. value that can be used as a guide for personnel actions, such as promotion,
selection for training, assignment, reassignment, deSignation to . key position,
separation; and to monitor the rated Officer's performance. An Officer who receives
poor performance ratings for two (2) consecutive rating periods shall be referred to
the appropriate ESB to determine his/her fitness to remain in the service.
d) Willful failure to perform his/her duties;
e) Intemperate use of intoxicating substance; and
f) Violation of RA Nr 9165, otherwise known as the
."Comprehensive Dangerous Drugs Act of 2002.

3) Administrative Discharge of Enlisted Personnel:
a) Discharge Authority - The CSAFP, Commanders
of AFP-Wide Support and Separate Units (AFPWSSUs) and AFP Area Commands,
Major Services Commanders and other Unit Commanders whose staff include Staff
Judge Advocate (SJA) may order the discharge of the EP assigned to their
respective commands prior to the ETE.
The discharge authority may designate
subordinate Officer(s) in his/her unit who shall have the function of discharging EP;
provided, however, that the power of approval or disapproval of the discharge of EP
shall remain with the discharge authority.

b) Power of Commanding Officer - Discharge


authorities shall take utmost care that administrative discharge is not resorted to as
an easy and economical substitute for Court-Martial. In cases where punitive action
is clearly called for, the particular circumstance of each case shall be judiciously
weighed to avoid creating the impression that administrative discharge assures one
of an easy escape from punishment for serious offenses and breaches of military
discipline. Discharge is an appropriate procedure for an enlisted person whose
behavior renders him repeatedly vulnerable to punitive or other adverse personnel
action. The fact that an erring individual discharged without honor may be denied
certain benefits or encounter difficulty in securing employment shall be carefully
explained to him/her for his/her own benefit.
c) Discharge Without Honor - Discharge without
hOl'lor is a discharge for cause and deprives the concerned EP of all the benefits due
him/her and disqualifies him/her for reinstatement in the military service.
An EP may be discharged without honor from the
active service on the following grounds:
(1) Absence without leave or desertion from
any of the Major Service of the AFP;
(2) Chronic alcoholism or substance abuse
disorder;
• (3) Prior separation from the AFP or from the
armed services of any foreign country under conditions other than honorable and/or
conditions barring entry into the AFP;
(4) Conviction by the Civilian Court for a crime
involving moral turpitude;
(5) Conviction by the Court-Martial for an
offense involving moral turpitude or for an offense punishable by dishonorable or bad
conduct discharge, and such trial has resulted in the conviction, but the sentence, as
approved, does not include a punitive discharge;

(6) Desertion or absence without leave if the


unauthorized absence has continued for three (3) months or more and trial by
Court-Martial is deemed inadvisable;

(7) Immorality, including, but not limited to: (a)


Commission of any of the crimes against chastity as defined in the Revised Penal
Code; (b) Maintaining illicit relations with a woman/man who is not his/her
husbandlwife; Provided, That sexual relations between two (2) single, consenting
adults and having no legal impediment to marry each other shall not constitute an
Immoral act; and (c) prejudicial to good order and military discipline that is defined
and punishable under the AWs. An EP who becomes pregnant out of wedlock, or
sires a child out of wedlock, shall not be deemed to have committed an immoral act;
Provided, That both parties are unmarried or otherwise legally capacitated to marry
at the time of the act/pregnancy; Provided further, That such act/pregnancy must riot
be grossly immoral, that is, it must not be so corrupt and false as to constitute a
criminal act or not so unprincipled as to be reprehensible to a high degree;

(8) Violation of RA Nr 916, otherwise known as


the "Comprehensive Dangerous Drugs Act of 2002; and

(9) Other misconduct that would warrant


unfitness to remain in the service.
4) Decision of the Office of the Ombudsman dismissing
an Officer and EP from the military service - However, an Officer and EP shall
be reverted/reinstated in the event the decision of the Ombudsman is reversed on
appeal and final in character, unless by reason of other qualifications, he/she is no
longer acceptable in the service.
d. Forced Attrition:
1) Forced Attrition of Officers - Officers who were
considered but failed to qualify for promotion to the next higher grade on account of
their own fault, failures or negligence or who lack the individual merits required for
promotion shall be subsequently separated from the active service. Officers with
contractual service obligations who were recommended for separation shall be
required to refund to• the government the amount equivalent to the cost of training
proportionate to the remaining period to be served as stipulated in the training
contract. The following are the instances of forced attrition of Officers:
a) Deferment of Promotion - An Officer in the grade
of SECOND LIEUTENANT (2lT)/ENSIGN (ENS) Philippine Navy (PN) who is
deferred once shall be s~arated in the permanent grade he/she holds on the
first (1 st) day of the third (3 ) month later after the President shall have approved the
promotion of Officers recommended by the Selection Board, which recommended
the deferment of such Officer for the first time.

b) Twice Deferment of Promotion - An Officer in


the grade of FIRST LIEUTENANT (1 LT)/LiEUTENANT JUNIOR GRADE (LTJG)
(PN) but below that of COLONEL (COL)/CAPTAIN (CAPT) (PN) who is deferred
twice for promotion to the same next higher grade shall be separated in the
permanent grade he/she holds on the first (1 at) day of the third (3'd) month later after
the President shall have approved the promotion of Officers recommended by the
Selection Board. which recommended the deferment of such Officer for the second
time. It applies only to Officers in the primary zone of consideration because helshe
was considered or deliberated upon by the Selection Board but failed to qualify for
promotion to the next higher grade.

c) Lateral Attrition - Officers in the permanent


grades of CAPTAIN (CPT). MAJOR (MAJ) AND LIEUTENANT COLONEL (LTC). or
their equivalent. shall be separated in accordance with the provisions of the existing
laws upon completing five (5). six (6) and seven (7) years of active commissioned
service-in-grade, respectively, or upon attaining 33, 39 and 46 years of age,
respectively, whichever is later. An Officer in the grade of 0-3, 0-4 or 0-5 who, after
having been considered for promotion to the next higher permanent grade, failed to
qualify for promotion to such grade on account of hislher own fault, failure or
negligence, or lacks the individual merits for promotion, or is otherwise deferred of
promotion; and, who has exceeded the limits in service-in-grade and age-in-years as
prescribed by law, and such disqualification for promotion is approved by the
President shall be subsequently retired from the service in the grade next higher if an
Officer has reached at least 20 years of active commissioned service. Further, no
Officer who qualifies for promotion but cannot be recommended for promotion due to
lack of promotion vacancy or such other justifiable reasons shall be recommended
for separation provided that he/she has not exceeded the limits in Time-In-Grade or
Tenure-In-Grade.
d) Maximum Tenure in Grade - The maximum
tenure of Officers in the grades of COUCAPT (PN) and General/Flag Officer in the
AFP are hereby prescribed as follows:

2) Forced Attrition of Enlisted Personnel


a) Low Potentiality - An EP who is referred to and
found by the EP Reenlistment Board not fit for retention or fails to demonstrate
satisfactory performance shall be separated from the military service.
b) Failure of Promotion - An EP who fails to satisfy
the conditions set for promotion to the next higher rank shall be recommended for
evaluation by the appropriate Major Service Promotion Board to the Major Service
Review and Evaluation Board for determination of fitness to be retained in the
service. The following are the grounds for referral to the Major Service Review and
Evaluation Board:
(1) Three (3) times successive failure of
Promotional Examination within the present grade;
(2) Three (3) times successive failure of PFT
within the present grade;
(3) Failure to be promoted and have attained
the maximum allowable Active Cumulative ServiCes (ACS) for the ' present grade
except if occupying a position calling for the ranks of higher grade in the AFP Table
of Organization.

compulsory retirement from the SND through the CSAFP,
(3) Upon approval, TAG, AFP shall issue
retirement orders and copy furnished Major Service Finance Center Chiefs, Major
Service Ones (1s), Major Service Adjutants, TAG, AFP, and Chief, AFPPGMC.
b) Enlisted Personnel
(1) Major Service Adjutants shall prepare the
SOS and Birth Certificate, and shall secure approval for compulsory retirement from
the Major Service Commander. If retirement is with total permanent disability,
confirmation orders shall also be attached.
(2) Upon approval, Major Service Adjutants
shall issue retirement orders and copy furnished Major Service Finance Centers,
Major Service 1s, OTAG and unit assignment of retirees.
2) Posthumous Retirement/Separation

For purposes of processing the posthumous


retirement/separation orders, it is imperative to classify the cause of death of military
personnel into Non-Battle Casualty and Battle Casualty.
a) Issuance of Posthumous Retirement
ISeparation Order for Non·Battle Casualty
(1) Unit concerned shall create LOD Status
Board to determine the LOD Status of Non-Battle Casualty.
(2) Upon its creation, the LOD Status Board
shall conduct deliberation and prepare the LOD Status Report, The LOD Status
Report may be contested or appealed by the legal beneficiaries. The appeal should
be filed within 60 days upon receipt of notice of the LOD Status by the legal
beneficiaries.
Based on the findings of LOD Status Board,

the unit concerned shall submit its request, through channels, for issuance of LOD
status order to TAG, AFPlMajor Service Adjutants with the following attached
documents:

TAG, AFP shall issue said order, copy furnished Major Service Finance Center,
Major Service Ones, Major Service Adjutants, OTAG and AFP Pension and Gratuity
Management Center (AFPPGMC).

(5) Upon receipt of LOD Status Order, Major


Service Adjutants shall secure the Declaration of Legal Beneficiaries from Major
Service Judge Advocate General Service (JAGS) and shall submit request for
issuance of posthumous separation/retirement orders to the Major Service
Commanders with the following attachments:

(a) Death Certificate;


(b) LOD Status Orders;
(c) Casualty Report;
(d) SOS;
(e) Certificate of Legal Beneficiary; and
(1) Application for Death Benefit Claim
with supporting documents by beneficiaries.

(6) In the case of EP, Major Service Adjutants
shall issue posthumous retiremenUseparation orders upon approval. In case of
Officers, Major Service Adjutants shall endorse request to TAG, AFP.

(7) In case of TAS Officers, respective TAS


Chiefs shall submit request for issuance of posthumous retiremenUseparation order

3) Retirement/Separation with Total Permanent
Disability (P-4 Status)
a) Upon determination that an Officer/EP is unfit for
military service, the Disability Separation Board, AFP Health Service Command
(AFPHSC) shall prepare the Certificate of Disability Discharge (COD) worksheet
and secure the approval for issuance of disability discharge (P-4) order from the
Commander, AFPHSC through the Command Adjutant.
b) Upon issuance of disability discharge (P-4) order, .
the Disability Separation Board shall submit request for confirmation of disability
discharge order to The Surgeon General (TSG), AFP with the following attachments:
(1) COD Worksheet (Adjutant General Office
(AGO) Form 40); and
(2) COD Orders
c) TSG, AFP shall review and validate the COD
Worksheet and shall endorse the request for COD confirmation order to the Deputy
Chief of Staff (DCS) for Personnel, J1, AFP.
d) In the case of Officer, the DCS for Personnel, J1,
AFP shall direct TAG, AFP to issue COD confirmation order. In the case of EP, the
DCS for Personnel, J1 shall send directive to the concerned Major Services to issue
COD confirmation order.
e) Upon receipt of the directive, TAG, AFP/Major
Service Adjutants shall issue COD confirmation orders and copy furnished AFP
Finance Center (AFPFC)/Major Service Finance Center Chiefs, Major Service 1s,
and Chief, AFPPGMC.
f) Upon receipt of confirmation orders, concerned .
Officer/EP shall submit thru channel the Personnel Action Form for
retirement/separation with COD to Major Service Adjutants for line Officers and EP
and to TAS Chiefs for TAS officers witlrthe following attachments:
(1) DLO Clearance;
(2) SOS;
(3) COD Orders; and

(4) COD Worksheet.
g) In the case of EP, Major Service Adjutants shall
secure approval of the Major Service Commanders and issue retirement/separation
orders upon approval, copy furnished Major Service Finance Center, Major Service
1s, Major Service Adjutants, OTAG and AFPPGMC.
h) In the case of line Officers, Major Service
Adjutants shall secure the endorsement of Major Service Commanders and shall
endorse the application for retirement/separation to TAG, AFP while the TAS
Commanders shall secure the same for TAS Officers. TAG, AFP shall secure
approval of retirement/separation with COD from the President through the SND and
theCSAFP.

retirement orders and copy furnished Major Service Finance Center Chiefs, Major
Service 1s, TAG, AFP and unit assignment of retirees.
3) Honorable Discharge of Enlisted Personnel
a) Concerned EP shall submit thru channel his/her
Personnel Action Form for resignation/dependency discharge to his/her unit Adjutant
with the following attachments:
(1) DLO Clearance;
(2) SOS;
(3) Duly notarized Affidavit of
Non-Retraction/Non-Extension; and
(4) Settlement of Contractual Service
Obligation,
b) The Unit Adjutant shall secure approval for the
honorable discharge from the Commanding GeneraVOfficer,

discharge orders and request for confirmation orders to the Major Service Adjutant.
4) Upon receipt, Major Service Adjutants shall inform
Major Service Commanders, issue confirmation orders and copy furnished the Major
Service Finance Center Chiefs, Major Service 1s, TAG, AFP and Chief,
AFPPGMC,
c. Disciplinary Attrition
1) Disciplinary Powers of Commanding Officer
a) Whenever the appropriate discharge authority has
determined that there exists sufficient grounds for discharge of any enlisted person
within his/her command, he/she shall immediately order that a summary
investigation be conducted and completed within seven (7) days by an Officer of
his/her command on the circumstances affecting the respondent Enlisted Person's
fitness for retention Tn the service. Board action is not required. Nevertheless, the
respondent shall be given an opportunity to be heard, to present evidence in his/her
behalf and to reMe the evidence against him/her. Where the respondent refuses or
fails without justifiable reason to appear; be heard or present his/her evidence in the
investigation, the investigating Officer shall take note of these facts, and shall
complete his/her investigation with the reception of all pertinent and competent
evidence(s) and make the appropriate findings and recommendations. However,
except in cases of Absent Without Leave (AWOL) or desertion or in cases where
physical control is not effective, the enlisted person shall not be tried in absentia. If
discharge is recommended, the specific provision for the discharge shall be indicated
under a category different from that indicated when he/she first took cognizance of
the case if his/her findings so warrant.

personnel who are to appear before the EP Review and Evaluation Board to deCide
the suitability of their retention in the military service.
b) Major Service 1s shall then furnish the members of the
EP Review and Evaluation Board the records for attrition of personnel for their
individual assessment one (1) week prior to the convening of the Board. This is to
ensure that thorough scrutiny and considerations are taken into account before
decisions are made.
c) Major Service Adjutant through Major Service 1s shall
issue memorandum to concerned EP to appear before the Board. However, issued
listing must be on a staggered basis and in order of priority to be attrited.
d) Upon determination that the EP is unfit for military
service, the Board shall render its report recommending for his/her separation from
the active military service for approval of the respective Major Service Commander.
e) After approval, the Adjutant shall, through the Major
Service 1s, issue a letter informing the concerned personnel that his/her military
service will be terminated on a specific date with the corresponding order. Orders
shall be furnished to OJ1 and Major Service Finance Center and other offices/unit
as necessary for its information, reference and/or appropriate action.
f) Any decision of the Board recommending the separation
of EP from the military service is subject to the approval of the MS Commanders
which is immediately implementable.
g) Those that were considered for retention with specific
conditions shall ba placed on probationary status until they have complied with the
necessary requirements, and upon compliance of which shall allow them to continue
their military service.
h) The concerned unit shall submit within ten (10) working
days a report to the Major Service 1s for further referral to the EP Review and
Evaluation Board any personnel who is not considered by their respective Unit
Reenlistment Board and Promotion Board, citing therein the circumstances of denial
for reenlistment or promotion.
i) Any EP who is deliberated for attrition shall be allowed to
continue with their service until the ETE, unless the EP was further found to be
ineffective and complacent in the performance of his/her job, or was found violating
certain regulations in which case he/she shall be discharged prior to his/her ETE.
Any EP who had reached 20 years in the military service and is recommended for
attrition may be allowed to retire from the service effective upon ETE.

b) Where the discharge authority (other than the


CSAFP, and the Major Service Commanders) approves the recommendation for the
discharge of the respondent enlisted person, the former shall immediately order the
discharge from the servicebf the latter. The orders to be issued shall not, however,
specify the character of the discharge but shall state that the character of the
discharge shall be as determined by the CSAFP or the Major Service Commander
concerned. Thereafter; the records of investigation and/or summary of the incidents
or circumstances leading to discharge must be submitted to the CSAFP/Major
Service Commander (Attn: DCS for Personnel, J1/Assistant Chief of Staff (ACS) for
Personnel) fOr determination of the character of discharge. Thereupon, the CSAFP
orthe Major Service Commander concerned shall issue orders indicating therein the
character of the discharge.

c) When a discharge order has been executed by a


discharge authority other than the CSAFP or a Major Service Commander, the
respondent enlisted person may, within 30 days from the date of publication of
ordi3rs 'appeal histher case to the CSAFP, or the Major Service Commander
concerned, by filling a written notice of appeal with TAG, AFP/Adjutantof the Major
Service to which he/she belongs.

" d) Upon receipt of the Notice of Appeal, TAG,


AFP/Major Service Adjutants shall, without delay, forward/refer all records of
investigation and all other pertinent papers to The Judge Advocate General (TJAG),
~FPlMajor Service Judge Advocate for hislher review and advice. Based on the said
review and advice, the CSAFP/Major Service Commander concerned shall make
his/her final disposition of the case.

e) In the absence of an appeal by the respondent


enlisted person or if an appeal has been filed beyond the period specified in the
preceding paragraph, the case shall be subject to automatic review by the CSAFP,
or the Major Service Commander concerned in this case, where the character of the
discharge shall be determined.
f) The CSAFP or Major Service Commander may
directly act on' the recommendation of the investigating Officer and ·· the
characterization of t~e mode of discharge by the DCS fOr Personnel, J1/ACS for
Personnel and order the immediate discharge of the EP.
g) For acts of misconduct committed by an EP within
his/her command, subordinate Commanders may, upon their own initiative, or as
may be ordered by higher authorities, conduct an investigation of the charge or
charges against the erring EP and make appropriate recommendation on the basis
of their own findings and evaluation of the evidence presented during the
proceedings to the superior Commander authorized to order his/her discharge. The
discharge authority may order the reinvestigation of the case of an EP based , on
hislher own deCision on the outcome of the investigation conducted.

j) Any EP who is separated with less than 20 years in the


military service shall receive his/her accumulated unused leave balances. It is the
responsibility of the Major Service to facilitate the immediate release of leave credits
and other entitlement deemed appropriate to separated personnel.

k) Any military personnel who is laterally attrited may avail


of the Transition Assistance Program (TAP) of the AFP.

10. APPEALS:

Nothing in this Circular shall deprive the affected AFP personnel from
appealing to this Department on any decision affecting his/her attrition in the military
service.

11. IMPLEMENTING GUIDELINES:

The Major Service Commanders shall issue the necessary


implementing guidelines within 60 days from issuance of this Circular.

12. REPEALING CLAUSE:

All Circulars, rules and regulations inconsistent with the provisions of


this Circular are hereby repealed or modified accordingly.

13. EFFECTIVITY:

This Circular shall take effect upon publication and shall have
prospective application.

MS EP REVIEW AND EVAL UATION BOARD

The MS EP Review and Evaluation Board are tasked to review the list of
enlisted personnel recommended by PMC due for attrition, in order to determine their
fitness and eligibility for retention in the military service. The MS EP REB shall have
the following composition:

Command Surgeon - Member
Command Judge Advocate - Member
Command Sgt Major/CMCPO, PN - Member
Dir, Career Mgmt Br, MS Ones - Member

Head, Career Management Br, PMC - Member/Recorder
Chief Clerk, MS Ones - Member

The Board may cause the creation of additional guidelines for the objective
and consistent implementation of attrition policies and procedures.

The Board aside from Sec 2 of DO Nr 31 dated 22 Nov 2006 (Age


Rationalization), may promulgate its own criteria in the deliberation of EP with the
following parameters as general considerations:

a. Preference for those Active Cumulative Service (ACS) of 20


years and above.
b. Prioritize those with longer Tenure-In-Grade in present rank
c. Prioritize those with lower EPEM evaluation rating.

The Board 'shall also deliberate personnel with low potentiality and
enthusiasm to continue with the service.

The Board shall ensure a sound, gradual, deliberate but continuous


implementation of attrition based on the operational and administrative requirements
of Major Services in conjunction to efficient personnel management system .

The Board shall meet every month as the Chairman may direct to deliberate
personnel for retention in the service. A secretariat may be created from among
. Senior Enlisted personnel coming from MS Ones, PMCs, Adjutant and Office of the

Command Sergeant Major to collate and update data of personnel for use of the EP
REB.

Attendance to Board meeting must be given preferential importance.


Representatives of primary members are discouraged, only if to send concrete
message that the AFP is serious in improving its manpower capacity towards
professionalism.
