ABOUT THE UNIVERSITY
The Public Petition dated 11-11-1839 initiated the
establishment of Madras University. It was in January 1840 with Mr.
George Norton as its President, that the University Board was
constituted. In 1854 after a lapse of 14 years, the Government of
India formulated a systematic educational policy for India and as a
sequel to this on 5th September 1857 by an Act of Legislative
Council of India, the University was established. The University was
organised in the model of London University.
Madras University is the mother of almost all the old
Universities of south India. The University area of jurisdiction has
been confined to three districts of Tamil Nadu in recent years. This
is consequent to establishment of various universities in the State
and demarcation of the University territories. This University has
been growing from strength to strength while widening its teaching
and research activities. The University also offers teaching and
research programmes in its four campuses. The 68 University
Departments of study and research are spread over four campuses
organised into 18 Schools each of which offer Post Graduate
Courses in respective specialisation, part time and full time Ph.D.
Programmes, Diploma and Certificate Programmes.
The University has been accredited by National
Assessment and Accreditation Council (NAAC) with the five star
rating first, and later with an A rating. The UGC has recognised the
University as one of the centres for "potential for excellence" in the
country.
ABOUT THE DEPARTMENT
The Department of Legal Studies, a heritage Department of
the University of Madras was established in the year 1951.
Prof.C.H.ALEXANDROWICZ was the Head of the Department
from 1951 to 1961. He started M.L. Degree in International Law &
Constitutional Law, the first of its kind in India. Prof.T.S.Rama Rao
another great international jurist was the Head of the Department till
1988. After his retirement Prof.N.Radhakrishnan became the Head
of the Department and from 1995, he was succeeded by
Prof.(Dr.).N.Balu, who is the first Ph.D. in Law from University of
Madras. After his retirement Prof.(Dr.).A.David Ambrose became
the Head of the Department. Presently renowned Legal Scholar Prof.
(Dr.). B. VENUGOPAL Heading the Department of Legal Studies
from 2020.
The Department has since its inception been a centre for
excellence for advance studies in International Law and
Constitutional Law. At present apart from Ph.D. Programme, the
following LLM courses are offered:
1. International Law and Organisation (CBCS)
2. Constitutional Law and Legal Order (CBCS)
The Department has an enviable distinction of producing
celebrated Scholars and well known International and National
Jurists. The Department of Legal Studies accounts for the bulk of
scholarly legal writing in the South. Alumni of the Department are
either scaled or in the process of scaling newer heights in Judiciary,
Ministry or Teaching.
CONCEPT OF THE SEMINAR
Law is the ultimate aim of every civilized society
and a key system in a given era, to meet the needs and demands of
its time. One should remember that the Constitution is a
Fundamental Law which lays down the basic goals for Democracy
and Social Justice. Social democracy is a way of life which
recognises liberty, equality and fraternity as the values of life.
Political democracy cannot last unless it lies at the base of social
democracy.
The Democratic society is bed rocked on the values of
social justice. Social justice is a dynamic concept which provides
meaning and significance of the legal system of any country. It is
a blanket term that includes social, economic and political justice
within its ambit.
In a democracy governed by the rule of law, it is not
possible to change the legal basis of Socio-Economic life of the
community without bringing corresponding change, in law. Thus,
it becomes a need to harmonize the individual interest with the
paramount interest of the community maintaining with realities of
ever changing social and economic life of the community
envisaged in the Constitution.
India is one of the largest democracies of the world.
Indian Democracy is a progressive, active and positive democracy
as opposed to a static, passive or negative democracy. The new
society after independence is to be achieved through a socio-
economic revolution pursued with a democratic institution. The
Constitution of India is operating diligently for 72 years. The
Preamble of the Indian Constitution epitomes Justice, Social,
Economic and Political, Equality i.e., equality of status and of
opportunity with dignity of person and fraternity. As such, it seeks
to deliver justice to all its citizen. In other word, it can be said that
India is an unequal society from time immemorial.
Generally, a democratic system has to ensure the social
development in tune with democratic values and norms reflecting
equality of social status and opportunities for development, social
security and social welfare. The ideal of a welfare state postulates
perpetual pursuit of the doctrine of social justice. India as a welfare
state is under an obligation to create a legal order to address the
issue of multitude of unsatisfied desires. Social justice is a ocean
of rights and balancing wheel between the largely represented and
unrepresented population of the Indian masses.
In order to ensure a substantial decree of social,
economic and political equality, both the Legislature and the
Judiciary is taking continuous effort to remove all kinds of
inequality by affording equal opportunity in social as well as
economic affairs to all of its citizen. But many a time it is a
ritualistic formula or a magical charm. Realizing the need of
greater good to a large number of masses, the Department of Legal
Studies proposed to organize a two day national seminar on
“Democracy and Social Justice : Consensus and Controversies” on
27th and 28th January 2023.
OBJECTIVE OF THE SEMINAR:
The objective of the Seminar is to identify the gaps, issues and
recommending proper solution for them by means of Round Table
discussions and also effective deliberations in the Technical
sessions.
