COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This agreement is entered into by and between:

JUAN DELA CRUZ., of legal age, Filipino citizen and residing at Lower
Irasan, Pres. Manuel A. Roxas, Zamboanga del Norte, hereinafter referred to as
the FIRST PARTY;

-and-

RICARDO P. DALISAY, of legal age, Filipino citizen and a resident of Brgy.

Uno, Katipunan, Zamboanga del Norte, hereinafter referred to as the SECOND
PARTY.

-WITNESSETH-

WHEREAS, on September 10, 2022 at around 4:00 o’clock in the

afternoon, the SECOND PARTY involved in a vehicular accident using the 4x4
Pick-up of his employer, the FIRST PARTY, which causes damage to the said
vehicle with an estimated damage of Twenty Thousand Pesos (Php20,000.00);

WHEREAS, the SECOND PARTY filed a complaint against the FIRST

PARTY for driving the said vehicle on the said incident while on drunk, for which
he subsequently withdrawn the same by reason of settlement of the parties and
to settle amicably the damage of the said vehicle;

NOW THEREFORE, by reason of the afore-mentioned circumstance, the

FIRST and SECOND PARTY hereby agrees the following stipulations and
covenants:

1. That the SECOND PARTY shall pay the amount of Php20,000.00,

representing the estimated damage of said vehicle, to be paid in
installment basis of not less than FIVE HUNDRED PESOS
(Php500.00) per month;

2. That the SECOND PARTY may pay more than the above-mentioned
monthly installments until full payment;

3. That the SECOND PARTY undertakes not to drive anymore the FIRST
PARTY or employer’s vehicle while under the influence of alcohol;

4. That the FIRST PARTY undertakes to execute the necessary Affidavit

of Desistance to any complaint filed in relation to said incident or not
to file any more complaint in connection therewith;

5. That the SECOND PARTY undertakes also not to file any complaint,
of whatever nature, against the FIRST PARTY by reason of his
employment;

6. That both parties hereby undertake to comply the stipulated

covenants/agreements honestly, faithfully and in good faith.

 IN WITNESS WHEREOF, the parties have unto set their hands this 20th
day of September 2022 in the City of Dipolog, Philippines.

persons who have executed the foregoing instrument and that acknowledged to me that
the same is their free act and deed.
