DEED OF ABSOLUTE SALE OF A PORTION OF LAND

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Absolute Sale of a Portion of Land is made and executed by:

JUAN DELA CRUZ, Filipino, of legal age, married to Maria Dela Cruz, and
a resident of Lower Irasan, Pres. Manuel A. Roxas, Zamboanga del Norte;
hereinafter referred to as the SELLER;

- in favor of -

RICARDO P. DALISAY, Filipino citizen, of legal age, single, and a resident


of Brgy. Uno, Katipunan, Zamboanga del Norte; hereinafter referred to as
the "BUYER";

WITNESSETH:

WHEREAS, the SELLER is one of the lawful co-owners and possessor of a


portion of land embraced by Transfer Certificate of Title No. T-4000, registered
under the name of PEDRO PENDUKO, married to ANA PENDUKO, which is more
particularly described as follows:

“A parcel of land (Lot 27) of the subdivision plan, Psd-09-000000 being a


portion of Lot 28, situated in the Brgy. Dos, Katipunan, Province of
Zamboanga del Norte, Island of Mindanao. Bounded on the North lines 3-4
by Lot 28, lines 4-8 by Lot 26, Pls-5, on the East line 8-1 by Lot 20, on the
South line 1-2 by Lot 24, on the West line 2-3 by Lot 25, all of the
subdivision plan. Containing an area of TWENTY-SIX THOUSAND SEVENTY-
EIGHT (26,078) SQUARE METERS. xxx”

WHEREAS, the SELLER acquired ownership over of a portion of the above-


described parcel of land, being one of the legal and surviving heirs of the late NARDO
CRUZ and VALENTINA REYES, who acquired ownership by virtue of a Deed of
Absolute Sale of a Parcel of Land dated 01 September 1989, which was duly
acknowledged before Notary Public Buzz V. Sy and recorded in his notarial register
as Doc. No. 45; Page No. 17; Book I; Series of 2009; who died without any last will
and testament, and without any known debts; thus, hereby warrants that she has
the power to sell her inchoate share;

WHEREAS, the BUYER has offered to buy from the SELLER portion of said lot
which they already pre-identified, subject for subdivision plan and approval, with an
area of ONE HUNDRED (100) SQUARE METERS, including all improvements found
thereon, under the terms and conditions herein set forth below;

NOW, THEREFORE, for and in consideration of the sum of FIFTY ONE


THOUSAND PESOS (Php51,000.00), Philippine currency, to SELLER in hand paid
in cash to his full and entire satisfaction, receipt of which is hereby acknowledged
from the BUYER, who is duly authorized to make payment of the purchase price, the
former hereby SELLS, CEDES, TRANSFERS AND CONVEYS absolutely and
unconditionally unto the latter, his successors-in-interest and assigns, portion of the
above-described parcel of land, with an area of ONE HUNDRED (100) SQUARE
METERS, including all improvements found thereon, for which the parties hereto
already identified, subject to official subdivision plan.

The SELLER warrants that said pre-identified portion of land is free from any
liens and encumbrances and that said SELLER shall defend the title and rights of the
BUYER from any claims of whatever kind or nature from third persons, including real
estate taxes.

IN WITNESS WHEREOF, we have hereunto signed this Deed of Absolute
Sale of a Portion of Land, this 16th day of August 2022, in Dipolog City, Philippines.

above-mentioned parties personally appeared, with their competent proofs of
identity as per data indicated below their names, known to me to be the same
persons named in and who executed the foregoing deed and they acknowledged to
me that the execution of the same is of their own free and voluntary act and deed,
and of the corporation the buyer represents.

This Deed, consisting of two (2) pages, including this page on which this
acknowledgment is written, has been signed on the left margin of each and every
page thereof by the parties and their witnesses and sealed with my notarial seal.
