अनिननयम ची कलमे ८९क व ८९ख य मां ध्ये ननर्देश के लेल्य
र्दस्तऐर्ज च्ां य सत्यप्रती आनि नोनिस र्द खल करण्य स ठी पढु ील
ननयम करीत आहे:
No. RGN. 2013/993/C.R. (171)/M-1. In exercise of the
powers conferred by section 89D of the Registration Act,
1908 (16 of 1908) (hereinafter referred to as "the said Act")
and of all other powers enables on this behalf, the
Government of Maharashtra hereby makes the following
rules, for the filing of true copies of documents and notices
referred in sections 89A and 89B of the said Act, namely:

ननयम 1 (Rule 1)
य ननयम ांन " महाराष्ट्र दस्तऐवजाांच्या सत्यप्रती आधण These rules may be called as the Maharashtra Filing of
नोधिसा दाखल करणे धनयम, 2013 " असे सांबोिण्य त येईल. True Copies of Documents and Notices Rules, 2013.

ननयम 2: व्याख्या Rule 2: Definitions.

(एक) या नियमाांमध्ये, निषय नकांिा सांदर्भ यामध्ये काहीही प्रनिकूल िसेल िर, (I) In these rules, unless there is anything repugnant in the
- subject or context
a. अधिधनयम " य च अर्थ, नोंदणी अधिधनयम, 1908 अस आहे.
b. नोधिसा दाखल करणे य च अर्थ, ई-फ यनलांग मोड् युलद्व रे नोनिस
ऑनल इन र्द खल करिे अस आहे.
c. दस्तऐवज य च अर्थ, कलम ८९क मध्ये नर्नननर्दथष्ट के लेले र्दस्तऐर्ज
अस आहे.
d. “ई-फायधलांग मॉड् यूल " य च अर्थ, य ननयम ख ली नोनिस र्
र्दस्तऐर्ज ांच्य सत्यप्रती ऑनल ईन र्द खल करण्य स ठी, नोंदणी
महाधनरीक्षक य ांच्य क य थलय ने नर्कनसत के लेले सॉफ्िर्ेअर मोड् यूल अस
आहे.
e. " नमुना " य च अर्थ, य ननयम ांसोबत जोडलेल नमनु अस आहे.
f. “ दस्तऐवजाांच्या सत्यप्रती दाखल करणे " य च अर्थ, ई-फ यनलांग
मोड् यूलद्व रे ऑनल ईन ई-फ य थलगसह दस्तऐवजाांच्या 4 सत्यप्रती र्द खल
करिे अस आहे.
g.“ नोिीस " य च अर्थ, अनिननयम च्य कलम ८९ख ख ली नननर्दथष्ट
के लेल्य हक्क लेख ननक्षेप द्व रे गह ि सांबांिीची सूचन र्देि री नोिीस अस
आहे.
a) “Act" means the Registration Act, 1908;
b) "Filing of notices" means the online filing of notices,
through the e-filing module.
c) "Documents" means the documents specified in section
89A.
d) e-filing module" means a software module developed by
the office of the Inspector General of Registration for
online filing of notices and true copies of documents, under
these rules;
e) “Form” means the form appended to these rules.
f) "Filing of true copies of documents" means the filing of
true copies of documents, including online filing through
the e-filing module.
g) "Notice" means notice of intimation of the mortgage by
way of deposit of title deed referred under section 89B of
the Act.

(र्दोन) य मध्ये र् परलेले परांतु व्य ख्य न के लेले शब्र्द र् शब्र्दप्रयोग य ांन
अनिननयम मध्ये आनि माधहती तांत्रज्ञान अधिधनयम, 2000 (2000 च
21) मध्ये अनुक्रमे जे अर्थ नेमनू नर्दलेलां असतील तेच अर्थ असतील.
ननयम 3:
a) अनिननयम च्य कलम ८९ख मध्ये नर्नननर्दथष्ट के लेल्य नोनिस a) The notices specified in section 89B of the Act shall be
सांबांनित र्दय्ु यम ननबांिक क य ल थ य त एकतर प्रत्यक्ष ज ऊन नकांर् filed using the e-filing module; and
ई-फायधलगां मोड्यल ू द्वारे आनि
b) (ब) अनिननयम च्य कलम ८९क मध्ये ननर्देश के लेल्य
र्दस्तऐर्ज ांच्य सत्यप्रती ऑनलाईन पद्धतीने र्द खल करण्य त
येतील.
ननयम 4:
ऑनलाईन फायधलांगच्या प्रयोजन र्थ, य ननयम ांन जोडलेल्य
प्रपत्र त नर्दलेल्य नमुन्यामध्ये नोधिसा तय र करण्य त येतील.
ननयम 5:
सत्यप्रती प्रत्यक्ष र्द खल करण्य च्य प्रयोजन र्थ उक्त अनिननयम च्य
कलम ८९क मध्ये ननर्देश के लेल्य र्दस्तऐर्ज ांच्य सत्यप्रती ह्य
न्यायालयाने नकांर् सांबांधित कायाालयाच्या प्राधिकृत
अनिक ऱ्य कडून तय र करण्य त येतील, त्य र्र स्वाक्षरी करण्य त
येईल आनि त्य मोहोरबांद करण्य त येतील आनि ;
र्दस्तऐर्ज ऑनल ईन र्द खल करण्य च्य प्रयोजन र्थ असां दस्तऐवज
स्कॅ न करून आनि पीडीएफ / नमन्ु यात नकांर् राज्य शासनाने
प्रश सकीय आर्देश द्व रे र्ेळोर्ेळी नर्नननर्दथष्ट के लेल्य नमन्ु य त जतन
करण्य त येतील आनि न्यायालयाच्या धकांवा सबां धां ित
क य थलय च्य प्र निकृ त अनिक न्य कडून त्य र्र इलेक्रॉधनक
पद्धतीने स्र् क्षरी करण्य त येईल.
ननयम 6:
र्दस्त ऐर्ज ांच्य सत्यप्रती आनि नोनिस ऑनल ईन र्द खल
करण्य ची क यथपद्धती महाराष्ट्र ई-नोंदणी आधण ई-फायधलगां
धनयम, 2013 मध्ये नमर्दू 'के ल्य प्रम िे असेल.

II) The words and expressions used but not defined herein
shall have the same meaning as are respectively assigned to
them in the Act and in the Information Technology Act,
2000 (21 of 2000).
Rule 3
b) The true copies of the documents referred to in section
89A of the Act shall be filed, either physically in the
concerned Sub-Registrar’s office or online using the e-
filing module.
Rule 4
For the purpose of online filing, the notices shall be
prepared online, in the format given in the Form appended
to these rules.
Rule 5
For the purpose of physical filing, the true copies of the
documents referred to in section 89A of the said Act shall
be prepared, signed, and sealed by the authorized officer
of the Court or concerned office,
and for the purpose of online filing, such documents shall
be scanned and saved in the pdf format or in the format
specified by the State Government by administrative
order, from time to time, and electronically signed by the
authorized officer of the Court or concerned office.
Rule 6
The procedure for online filing or the true copies of
documents and notices shall be the same as mentioned in
the Maharashtra e-Registration and e-Filing Rules, 2013.

ननयम 7:
र्दस्तऐर्ज ांच्य सत्यप्रती आनि नोनिस र्द खल के ल्य नांतर,
a. दुय्यम धनबांिक, र्दस्तऐर्ज ांच्य सत्यप्रती नकांर् नोनिस ह्य
त्य च्ां य क य लथ य तील अधतररक्त नोंदवही क्रमाांक-1 मध्ये
प्रत्यक्षपणे ठे वील नकांर् कॉपी करून ठे र्ील.
Rule 7
After filing the true copies of the documents and
notices,
a) the Sub-Registrar shall paste or copy, the true
copies of the document and notices in the
Additional Register No. 1 kept in his office

b. र्दस्तऐर्ज ांच्य सत्यप्रती र् नोनिस ांन वर्ााअखेरीस b) the true copies of the documents and notices
सांपण्याजोगे स्वतांत्र सलग अनुक्रमाांक देण्यात येतील आनि य shall be given separate consecutive serial numbers
प्रयोजन र्थ क य ल थ य त एक स्वतत्रां दैधनक नोंदवही ठे र्ण्य त terminable at the end of the year and a separate
येईल. Day Book, shall be maintained in the office for
these purposes;
c. र्दय्ु यम ननबांिक, अश प्रक रे र्द खल के लेल्य र्दस्तऐर्ज ांच्य c) the Sub-Registrar shall endorse on each true
सत्यप्रती र् नोनिस ांच्य प्रत्येक प्रतीवर पुढीलप्रमाणे पृष् ांकन copy of the documents and notices so filed, as
