Re: Letter of Offer

Further to our recent discussions, we are pleased to confirm the terms of your employment with Probe.

Probe is a leading business process outsource provider made up of a team of passionate, diverse and talented people. Our
aim is to be the go to BPO in the markets within which we choose to operate and to build strong, enduring and valued
relationships - with our clients, our people, our investors and the communities in which we operate.

This letter outlines the terms and conditions of our offer of employment. We look forward to you making a positive
contribution to our team.

1. Commencement

Your employment will commence on the Commencement Date set out in the First Schedule (Commencement Date), and
will continue in force until terminated in accordance with the terms of this agreement.

2. Position

You have been appointed to perform the Position set out in the First Schedule (Position), and are required to meet the key
performance indicators (KPIs) which will be provided by your Manager. You are required to perform these duties and any
other duties and key performance indicators Probe may assign to you, which are within your reasonable capability having
regard to your skills, training and experience. The reporting requirements of this role, your duties, KPIs and Position
Description may be varied from time to time in accordance with the needs of Probe.

You agree to devote all of your working time, attention and abilities to the performance of the Position. You will not engage
in any activity (including other employment) which affects your ability to carry out your responsibilities or which places you
in competition with Probe or which benefits others in competition with Probe. The reason for this requirement is to protect
Probe’s legitimate interests in its confidential information, intellectual property rights and commercial reputation. You agree
that this is a genuine reason based on reasonable grounds for including this provision.

Pre-employment statements

All information provided by you to Probe prior to your appointment must be accurate and complete. Probe relies upon the
accuracy of the information contained in your employment application, resume, recruitment interview(s) and any other
documentation or data that you provided to it in the recruitment process (collectively the “Recruitment Information”). Any
false, inaccurate, misleading and/or deceptive information (including, but not limited to false claims and omissions) in the
Recruitment Information may result in the immediate withdrawal of this offer of employment or, if the inaccuracy is not
discovered until after your employment has commenced, the immediate termination of your employment. If you consider

that any of the Recruitment Information is or may be false, inaccurate, misleading and/or deceptive, you should contact
your supervisor as soon as possible.

3. Term
Your Employment will commence on the Commencement Date and continue until the date specified in the First Schedule.

4. Location

At the Commencement Date you will be located at the Primary Work Location specified in the First Schedule (Primary Work
Location) but you may be directed/required to move to any other location within the same city in accordance with the needs
of Probe.

You may also be required to travel to and/or perform your duties at other Probe sites or locations during the course of your
employment and you will not be entitled to any further remuneration other than that set out in this agreement for doing so.

In the event that it is necessary for us to transfer or relocate you within Probe to meet operational or business needs, we
reserve the right to transfer you to another location and/or subsidiary, or division of Probe on terms no less favorable.
Should the transfer or relocation require that you permanently change your place of residence any transfer will be
undertaken with your agreement.

5. Hours of Work

To meet Probe’s operational requirements, you are required to work the hours specified in the First Schedule (Hours of
Work).
In order for you to perform your role effectively and to meet Probe’s obligations to its clients and customers, you may be
required to work reasonable additional hours that are necessary to fulfill your duties or as otherwise required by Probe.

6. Probationary and Qualifying Period

If specified as being applicable in the First Schedule your employment is subject to a probationary period. At any time
during the Probationary Period specified in the First Schedule, your employment may be terminated by either you or Probe
giving 1 (one) week’s notice. Probe may choose at its discretion to pay you an amount in lieu of all or part of the period of
notice.

7. Duties and Performance

As a Probe employee, you agree that during your Employment you will:

Act in accordance with Probe’s values and behaviours and the Code of Ethics and Conduct;
Perform your duties faithfully and diligently and in a proper and efficient manner exercising all due care;
Act at all times in Probe's best interests and not intentionally do anything that is or may be harmful to Probe or its
related entities;
Use your best endeavours to protect and promote the reputation and interests of Probe and its Related Entities and
the reputation of our clients;
Use your best abilities and knowledge to perform the duties assigned and at all times display a thorough and
professional manner, upholding Probe's goodwill and customer relationships;
Display the highest professional standards of service delivery towards Probe and its clients and their customers;

Comply with all lawful and reasonable directions of Probe (including from Directors, senior executives and your
Manager), especially those relevant in the performance of your duties;
Ensure you do not discriminate against, harass or bully co-workers, prospective co-workers, Probe sub-contractors,
visitors, clients or customers and ensure you treat people with fairness and respect in the performance of your
duties.
Achieve key performance indicators and standards set by Probe and our clients or as established in performance
reviews which may be conducted from time to time.
Comply with all relevant laws including, but not limited to, the Privacy Act 1988 (Cth), the Competition the Consumer
Act 2010 (Cth) (including the Australian Consumer Law) and applicable occupational health and safety laws.
Recognise the importance of protecting the privacy and data rights of individuals in relation to their personal
information and comply with applicable Probe and client data protection, information security and privacy policies
when handling personal data in the performance of your duties.
Perform such work as may be reasonably necessary to fulfil your responsibilities under the terms of this Agreement.
Disclose to Probe any facts which might involve a conflict between your interests and the interests of Probe.

8. Standard of Dress

You are required to dress neatly and tidily and to maintain a professional standard of dress in keeping with standards and
guidelines required by Probe and by its clients and may be required to wear the uniform of one of our clients whose work
you are performing when requested to do so.

9. Remuneration

You will receive the Remuneration and any benefits set out in the First Schedule.

Your Remuneration will be credited into your nominated bank account each fortnight or at such other frequency nominated
in the First Schedule.

Unless specified in the First Schedule of this agreement or where an Enterprise Agreement or Award applies, the
remuneration specified in the First Schedule is payment for all work performed in satisfying the duties of the position.

10. Superannuation

Probe will make superannuation contributions in accordance with the Superannuation Guarantee (Administration) Act 1992
and Probe’s Superannuation Policy. Contributions will be paid on your behalf into either Probe's superannuation fund, or
another complying fund nominated by you. If you wish to nominate another superannuation fund, please complete a
Standard choice form and return it to us.

You should obtain independent advice on the nature, effect and extent of insurance cover contained in the Probe
Superannuation Scheme, as the nature of that insurance cover will vary according to your category of employment.

The superannuation contribution may form part of your overall remuneration package, if provided in the First Schedule.

11. Policies

Probe has in place a Code of Ethics and Conduct, policies, guidelines and procedures which set out the expected conduct
and behaviour of its employees. These policies and procedures are introduced, amended, cancelled or varied from time to
time at Probe’s discretion. A copy of Probe’s current policies and procedures are available to you on Probe intranet or

common drive or by request from your local People Team member. You must familiarise yourself with Probe's policies and
procedures and at all times abide by them.

While you are required to comply with Probe’s policies and procedures, as in force from time to time, they do not form part
of this agreement and do not create any contractually enforceable rights in you or obligations on Probe.

To the extent that a rule, policy, plan or procedure of Probe requires you to do or refrain from doing something, it constitutes
a lawful and reasonable direction from Probe with which you must comply. Any breach by you of lawful directions, including
Probe policies or procedures may result in disciplinary action, including the termination of your employment.

12. Initial Training

It is a condition of your employment that you successfully complete any training reasonably required for the performance of
the role and pass each training assessment. If you do not satisfactorily complete such required training within the allocated
training period or satisfactorily complete each training assessment, and unless otherwise advised in writing by Probe, your
probationary employment with Probe will come to an end. In such circumstances, you will be entitled to payment in lieu of
notice of termination, together with all other accrued entitlements (if applicable).

If at any time after the Commencement Date you are involved in training as part of your employment with Probe you will use
best endeavours to successfully complete the training course in a competent and timely manner and at the least cost to
Probe. You should be aware that, from time to time, training courses may be held out of the Primary Work Location and
outside regular work hours.

13. Confidentiality and Intellectual Property

13.1. Confidentiality

As part of your normal duties you may obtain or have access to Confidential Information concerning both clients and
Probe’s affairs. It is a term of your employment that you will:
a. Keep Confidential Information confidential, except where disclosure is permitted by this clause;
b. Not, except in the proper performance of your duties, divulge or use any Confidential Information obtained
during the course of your employment; and

c. Take whatever measures are reasonably necessary to maintain confidentiality of Confidential Information,
including but not limited to:
(i) complying with all security measures established to safeguard confidential information from
access or unauthorised use;

(ii) keeping Confidential Information under your control;


(iii) not removing confidential information from Probe or Probe client’s premises or computer
system (including, but not limited to, downloading data to a USB device) without its prior approval;
and
(iv) immediately notifying Probe if you suspect or are aware that confidential information is being

used, copied or disclosed without authorisation.

You may:

(a) use Confidential Information solely for the purpose of your employment; and

(b) disclose Confidential Information only to persons who:


(i) have a need to know for the purposes of carrying out their employment duties (and only to the extent that
each has a need to know); and/or
(ii) have been approved by Probe, prior to the disclosure.

These obligations continue after termination of your employment with Probe including by resignation.

As part of your employment with Probe, you may from time to time be required to sign a confidentiality agreement with
Probe and/or a client of Probe. You agree that you will sign this confidentiality agreement as required and abide by its
terms. You must follow procedures or reasonable and lawful directions stipulated by Probe’s Privacy Officer, relating to the
collection, storage, security, access to, correction or use and disclosure of personal information.

If Probe suffers any loss or damage, you may be required to fully indemnify Probe (where it suffers such loss or damage)
where it arises as a result of your being in breach of your duty to keep information confidential or otherwise in breach of
this agreement or your duties as an employee.

You must provide assistance reasonably requested by Probe in relation to any proceedings taken against any person for
unauthorised use, copying or disclosure of confidential information.

On the termination of your employment, you must follow all instructions from Probe and/or allow Probe to do all things
necessary to secure all Confidential Information which may be on your personal electronic devices such as but not limited
to home computers, laptops, tablet devices, data storage devices or mobile phones.

"Confidential Information" in this agreement, includes (but is not limited to):


(a) information that is designated by Probe as confidential;
(b) information by which if its nature or circumstances or its disclosure may be reasonably understood to be
confidential;

(c) the terms and conditions of this agreement;


(d) information not lawfully or properly available to the public at large including, technical data, trade data, trade
secrets, know-how and confidential information relating to the businesses, finances, accounts, dealings,
transactions, methods of operation, assets or affairs of Probe or Probe's clients and our people.

13.2. Intellectual Property

All Intellectual Property rights of any nature in any intellectual property developed or created by you using Probe or Probe
Client resources, on Probe or Client premises or in the Course of your Employment, whether such Intellectual Property was
created during business hours or not, will vest in Probe (or its members or customers or other third parties if so agreed by
Probe) upon creation, and you will have no claim to or interest of any nature in such Intellectual Property. You acknowledge
that your
remuneration includes compensation for all Intellectual Property created by you.

Any Invention must immediately be disclosed to Probe. All Inventions will be confidential information, and you by this
agreement assign and, to the extent necessary, will at the request of Probe confirm the assignment of your entire right, title

and interest in and to each Invention (including any intellectual Property rights and protection that exists or is obtained in
respect of the Invention) to Probe.

You also agree that you will, at Probe's expense, execute all documents and do and execute all such further acts, matters
and things as may be necessary or reasonable to:
a. Protect and keep confidential all the Inventions; and

b. Confirm or perfect the assignment required above.

You irrevocably consent to any and all acts or omissions committed by Probe or its client (whether committed before or
after the date of this agreement) in relation to each Work of which you are an author (whether in whole or in part) and which
has been or is in the future created or made by you in the course of your employment where, without this consent, those
acts and omissions constitute or might constitute an infringement of your Moral Rights in such Work.

You shall not make any claims in respect of such matters relating to and shall execute any acknowledgements, waivers,
Intellectual Property agreements, confidentiality agreements or other documents which Probe may reasonably require in
relation to such matters if called upon. To the extent necessary you assign to Probe all present and future Intellectual
Property rights in all Inventions, Work and Intellectual Property developed or created by you using Probe or Probe client’s
resources, on
Probe premises or in the course of or incidental to your employment.

For the purpose of this section of this agreement the below terms shall have the following meanings:

a. “Intellectual Property” includes all copyright, designs, design rights, patents, rights in databases, technology,

source code, software, confidential information, trade secrets, know how, techniques, brand names, trademarks,
trade practices, inventions, developments, improvements or concepts or other intellectual property whether
existing at the commencement of this agreement, subsequently acquired by Probe, or gained through or
attaching to any work carried out by you as part of or in connection with your duties and responsibilities under

this agreement including any Inventions, and whether at Probe’s premises or on other premises, and whether
using Probe’s equipment or your or other equipment;

b. "Invention" includes any discovery, design, invention, idea, concept, technique, secret process, improvement in
procedure or Work created in the course of your employment whether or not they are capable of being protected
by copyright, letters patent, registered design or other protection;

c. “Moral Rights” means the right of attribution of authorship, the right to prevent false attribution of authorship
and the right of integrity of authorship granted to authors under the Copyright Act 1968 (Cth), and any similar
rights existing under any other laws; and

d. "Work" means any copyright material in which copyright subsists under the Copyright Act 1968 (Cth).

e. “Probe” means the Probe entity listed in the First Schedule and its related entities.

14. Media Statements and Outside Articles

You must not:

a) make any statements to media representatives relating to Probe or its business or its clients or their
customers; or

b) arrange or allow the outside publication of any material in the name of (or referring to the name of) Probe or
its business or its clients or their business or customers, without the express prior approval of a senior manager
of Probe.

15. Health and safety

As part of your duties you are required to comply with all work health and safety statutory obligations (and any other
relevant legislation that may apply from time to time).

You must also comply with any work health and safety requirements of any other company or organisation at any place
where you are required to perform duties for Probe. In addition, you are required to take all reasonable and necessary
precautions for your own health and safety and that of fellow employees. You are required to observe all safety precautions
and procedures including the wearing of protective clothing and use of protective equipment (where applicable).

You must report all accidents and near misses to Probe immediately in accordance with Probe’s Work Health and Safety
Policy.

16. Conflict of Interest

While your employment with Probe continues you are required to disclose to your Manager any potential conflicts of
interest including concurrent employment outside of Probe which may impact negatively on either Probe performance or
personal performance.

17. Termination of Employment

Either you or Probe may terminate your employment by giving the other party the written notice specified under Employee
or Probe Notice Period of Termination set out in the First Schedule.

If notice is given by either party, Probe may elect to:


(a) require you to continue to work for part or the whole of that notice period;

(b) require you to continue to attend for work from another place for part or whole of that notice period but to
perform duties that are different to those you were required to perform at times during your employment,

providing you have the necessary skills and competencies to perform those duties;

(c) require you not to attend for work during the notice period and proceed on gardening leave for the balance of
your notice period; or

(d) in its absolute discretion, effect the termination immediately and make a payment in lieu of the whole or any

part of the notice.

Where you do not give the required minimum notice you will be liable to forfeit your salary for the period for which notice is
not provided or the period specified in an applicable industrial instrument.

Probe may terminate your employment without notice or payment in lieu if:
(a) You become bankrupt;

(b) You are convicted of any criminal offence, other than an offence which in the opinion of Probe does not

affect your position as an employee representing Probe or you are not able to comply with any security
clearance requirements required to perform your role;

(c) Your continued employment would be in breach of any visa conditions or you do not hold a valid visa
authorising work at the Primary Work Location;

(d) In the opinion of Probe you commit any act of misconduct or gross default, neglect in the discharge of your

duties or any serious or persistent breach of any of the provisions of this agreement (including, but not limited
to theft, fraud or assault);

(e) You misrepresent to a member of the public the nature, terms, or use, of any service, promotion, offer,
incentive or goods being offered by Probe, or on behalf of a client or customer of Probe;

(f) You make a false or misleading representation or fraudulent misrepresentation on behalf of Probe or any

client including, without limiting the foregoing, forging communications or issuing unauthorised
communications as from either Probe or the client as if they were authorised;

(g) You have committed any serious breach (whether by one or more several acts or omissions) or repeated or

continued any material breach of your obligations under your agreement having already received warning from
Probe or you are guilty of any conduct tending to bring yourself, Probe or its clients or the Probe Group into

disrepute.
(h) You refuse to comply with a lawful and reasonable direction of Probe as to the performance of any of your

duties;

(i) You engage in physical or verbal abuse, assault or intimidation of any officers, employees, staff member,
client, customer or supplier of a person associated with Probe or a member of the public at Probe’s premises or

while on Probe business;


(j) You disclose confidential information in breach of your terms of employment;

(k) You attend work under the influence of alcohol or illegal drugs or are in possession of illegal drugs;

(l) In the opinion of Probe you consistently act in a manner which may tend to injure the reputation and interest
of Probe; or

(m) You commit any act or omission justifying summary dismissal at common law.

Any remuneration which has been paid in advance to you at the time of termination may be applied by Probe towards any
entitlements payable on the termination of your employment subject to compliance with relevant legislation.

Upon termination of the Agreement (or sooner as required by Probe) for whatever reason, you must immediately return to
Probe all property in your possession or control that belongs to Probe and/or Probe’s clients. This property includes but is
not limited to confidential information, whether in soft copy or hard copy, and (where applicable) computers, mobile phones,
documents and motor vehicles.

You shall be subject to any applicable Post-Employment Restraints as set out in the Schedule(s) to this agreement, which
will survive termination of this agreement.

18. Suspension/Scale Down

Probe may suspend you with pay while it investigates any concerns in relation to your performance or conduct.

Probe may also scale down or shut down its operations for a specified period of time. In the event of a scale down or shut
down, Probe may direct you to take any accrued annual leave for the period of the scale down or shut down.

19. Workplace Surveillance

Your use of Probe’s premises, equipment, computers, systems and facilities may be monitored in accordance with Probe’s
Physical Security and Surveillance Policy and the Electronic Communications and Monitoring Policy and applicable
legislation.  Surveillance may be in the form of camera or electronic monitoring, or in certain business divisions, by way of
tracking devices (such as a GPS device).  This may extend to email and web based interaction which you should be aware
may be monitored and/or recorded in accordance with Probe’s policies and applicable legislation.  Surveillance is
continuous and ongoing.

20. Security Requirements

You must not remove or allow, assist or acquiesce in any other person to remove any equipment, property,  records, stock,
documents, tools or other Probe property from the workplace by any means (including electronically) unless this is
reasonably necessary for you to perform your duties.  Probe may, through its officers, and if reasonably necessary to
preserve the safety and security of any person or their property on its premises, request to inspect your personal property
while you are on Probe's premises and it is a condition of your employment that you consent to such inspection.  Such
inspection will be conducted with due attention to your right to dignity, respect and privacy. Refusal to comply with a
reasonable request to inspect your personal property may result in disciplinary action, including termination of your
employment.

You are responsible for the security and maintenance of all company property that you use in the course of your
employment which belongs to Probe. By signing this agreement you undertake to ensure that the property/equipment is
appropriately operated, secured and stored at all times including when outside the workplace and to use such
property/equipment in accordance with Probe’s policies and procedure.

Should you lose or damage any such company property, you agree that you may be required to pay Probe  the cost of
replacing it, or repair any damage caused, less an appropriate reduction for fair wear and tear.

You must not retain copies of any of Probe’s information (including electronically recorded information) except with the
express prior written consent of Probe.

21. Security/Police/Medical Clearance

Your employment may be subject to the satisfactory completion of any security, police or medical clearance required for
the performance of this role.  If you are unable to satisfactorily complete any such required clearance, your employment
with Probe is void from commencement. In that case you will be paid any accrued entitlements.

You acknowledge and agree that our client may request a copy of the results of any screening, including, but not limited to,
the results of your security or police clearance and you hereby consent to Probe disclosing the results of your screening to

the client for the purpose of assisting the client to verify the adequacy of quality assurance processes and the suitability of
employees engaged on the client’s project at Probe.

To ensure that we are able to meet our obligations to our clients with respect to security protocols and security clearance
requirements, you are required to immediately disclose to Probe any matter that may have an effect on your ability to meet
the requirements to obtain a security clearance.  These matters will include but are not limited to being charged or
convicted with a criminal offence of any kind or where you are subject to any proceedings (however described) relating to
bankruptcy or insolvency. 

During the course of your employment with Probe you may be required to complete additional or further clearances due to
the requirements imposed on the company by clients.  It is a condition of your employment that you be able to meet any
security clearance requirements imposed on you both at the time of your engagement and at any time during your
employment.  Probe will notify you of any circumstances that require additional or new checks to be completed.  If at any
time you are unable meet the requirements to obtain a security clearance required to perform your role, your employment
may be terminated.

In any circumstances where Probe reasonably believes it to be necessary (including for the reasons set out below), Probe
may direct/require you to be medically examined by a medical practitioner nominated by Probe at Probe’s expense, and
Probe will direct/require a report from the medical practitioner on the outcome of such examination. Probe may direct you
not to perform some or all of your duties pending the consideration of the assessment.  Such medical examinations and
tests may be required for a number of reasons, including:

a)             To assess your ability and capacity to work and perform the inherent requirements of your position properly
and/or safely;
b)            To ascertain whether the work or work environment may affect your health and safety; and
c)             To assess your ability to perform the inherent requirements of your position  after you suffer an injury or illness
that may be work-related or may potentially result in you being off work for a reasonable period of time.

22. Health Information

You are required to maintain fitness to safely undertake your role.

Probe may direct you to provide medical certificates or reports as required to verify absence due to illness or injury and/or
to reasonably assess your capacity to work and any measures to comply with Probe’s safety obligations.

You agree that a written authority enabling Probe to discuss your fitness for duty with the examining medical practitioner
will not be unreasonably withheld.

Probe acknowledges that all information obtained in relation to your health under this clause will be kept confidential, to the
extent possible, and will only be used for the purpose of considering your capacity to perform the duties of the Position,
Probe’s workplace health and safety obligations and/or for purposes directly related to your employment.

23. Driver Licence

If during the course of your employment you are required to drive a motor vehicle, you must maintain a current driver
licence. You must notify Probe immediately if you are charged with any driving offences or if your licence is or is likely to be
suspended or cancelled. The suspension or cancellation of your licence may result in the termination of your employment
without notice.

24. Company provided Property/Equipment

To assist in undertaking work-related duties, Probe may provide you with a mobile phone, lap-top computer, motor vehicle
or other property/ equipment. You agree to use the property/equipment in accordance with Probe’s policies and procedures
as amended from time to time. In particular you will ensure that the property/equipment is appropriately operated, secured
and stored at all times including when outside the workplace.

25. Waiver and Severance

No waiver of any breach of any term of this agreement shall be effective unless that waiver is in writing and signed by the
party against whom the waiver is claimed. No waiver of any breach shall be or be deemed to be a waiver of any other or
subsequent breach.

If any term, clause or provision of this agreement or the application thereof is or is deemed to be judged invalid or unlawful
for any reason whatsoever, it shall not invalidate the validity or application of any other term, clause or provision, and shall
be deemed severed from this agreement without affecting the validity of this agreement.

26. Governing Law

Your employment will be governed by the laws of the State nominated under Governing Law in the First Schedule.

27. Entire Agreement

This letter records the agreement between us.  No previous negotiations, understandings, contracts, agreements,
representations, warranties, memoranda or commitments will affect the terms and conditions of your employment by
Probe.  Any variation to this agreement or its Schedules must be recorded in writing and agreed to by both parties.

28. General

No failure, delay, relaxation or indulgence by a party in exercising any power or right conferred upon it under the Agreement
will operate as a waiver of that power or right.  No single or partial exercise of any power or right precludes any other or
future exercise of it, or the exercise of any other power or right under the Agreement.

If any provision of the Agreement is invalid, void or unenforceable, all other provisions which are capable of separate
enforcement without regard to an invalid, void or unenforceable provision are and will continue to be of full force and effect
in accordance with their terms.

The terms of the Agreement and any subsequent amendments are confidential and may not be disclosed by you to any
other person, other than for the purpose of obtaining legal or accounting advice, without the written consent of Probe.  This
includes, but is not limited to, details regarding your Remuneration.

The Agreement binds and inures for the benefit of the Parties, their respective successors (including, in the case of natural
persons, their legal personal representatives) and permitted assigns.

 The Agreement may not be varied except by written instrument executed by the Parties.

Probe may assign the rights, benefits and obligations under this Agreement to a different Probe entity and you hereby
irrevocably consent to any such assignment.

Probe: For the purposes of this Agreement, Probe means:

Probe Operations Pty Ltd.

Position: You will be appointed to the role of Customer Service Agent.

Enterprise Agreement: Your role falls within Next Gen BPO Band 1 - Customer Service/Sales Agent - Probe Enterprise
Agreement - Band1 Level2 of the Agent classification of the Probe Next Gen BPO Enterprise Agreement  (Enterprise
Agreement).  The Enterprise Agreement applies to your employment as a matter of law and does not form a part of this
agreement.

Manager: Your immediate Manager at the Commencement Date will be Elisha Keepa.

Hours of Work:
You will be employed on a part-time basis, to work between 20 - 30 ordinary hours per week. You may be required to work
additional reasonable hours from time to time to fulfil your duties. Additional hours worked up to 38 hours per week will be
at ordinary time.

Spread of Ordinary Hours of Work


Ordinary "core" spread of hours is between:
Monday to Friday; 8am to 8pm
Saturday: Midnight on Friday and Midnight on Saturday
Any hours worked outside the above core spread of hours are deemed to be non-core hours and will attract the applicable
non-core hour penalty rate under the Award

Primary Work Location: 485 La Trobe St Melbourne


You may be offered the option to temporarily work from home as required by Probe (at its absolute discretion).

Probationary Period Applicable: Yes


Duration of Probationary Period: 6 months

Project/Fixed Term Employment:


Your employment is for a fixed period up to 30/06/2023 or when the CBA Direct Concierge project is completed, whichever
occurs first.

This Agreement shall be deemed to be completed, and employment terminated, when the specified duration of employment
is reached and you will not be entitled to notice or any additional payment on termination. Nothing in this agreement shall
be interpreted or understood to give you any expectation of continued employment after the expiry of the fixed term and no
assurance or agreement for a further term shall bind either party unless agreement is in writing and signed by both parties.
Whilst Probe will endeavour to provide you with advance notice of any early cessation of the Project, upon expiration of the
fixed term you will not be entitled to notice or any additional payment.

Employee Notice Period for Termination:


Written notice in accordance with the Probe Next Gen BPO Enterprise Agreement and the Fair Work Act 2009.

If the Employee’s employment is terminated within four months of the commencement date of employment by either party
and Probe has during the currency of this agreement paid on behalf of the Employee a fee or fees relating to the issue of a
provisional commercial sub-agents licence under the Private Agents Act 1966 or like. To the extent permitted by law, Probe
may withhold from the Employee from any payment otherwise due to the Employee on termination, an amount equal to the
licence fee and the Employee hereby irrevocably agrees to that occurring.

Probe Notice Period for Termination:


Written notice in accordance with the Probe Next Gen BPO Enterprise Agreement and the Fair Work Act 2009. 

Remuneration:
You will be paid an hourly rate of $26.00 by electronic funds transfer on a fortnightly basis in arrears.

Reimbursement of Expenses:

Provided you produce evidence satisfactory to Probe, and obtain your Manager's prior written approval, Probe will
reimburse you for all reasonable business expenses that you properly incur in the performance of your duties. This clause
expressly excludes travel to and from work.

Leave:

You are entitled to leave (e.g. annual leave, personal leave, carer’s leave, compassionate leave, parental leave, community
services leave and long service leave) in accordance with the National Employment Standard and any applicable Award or
Agreement listed in this schedule.

If, during the course of your employment, you have a large accumulated leave balance, Probe may in its discretion direct
you to take annual leave at any time in accordance with the National Employment Standard and any applicable Award or
Agreement listed in this Schedule.

If you are absent from work on paid or unpaid personal/carer's leave for two (2) or more consecutive days, greater than
three (3) days in any year or on either side of a weekend, rostered day off or public holiday, you must produce evidence
satisfactory to Probe that the non-attendance was due to ill health, injury or emergency affecting you or a member of your
immediate family or household.

If you are absent from work due to paid or unpaid personal/carer's leave you must take all reasonable steps to notify Probe
of your absence from work at least two (2) hours prior to the commencement of each day's work.

If at the time your employment ends you have untaken accrued paid personal leave, you are not entitled to any payment in
respect of that untaken leave.

Special Terms Clause: In accordance with clause 21 of this Agreement, your employment is conditional upon satisfactory
completion of a national police check and/or Pre-engagement Integrity Check (PEIC) and government baseline clearance to
the satisfaction of our client. Upon completion of training, your ability to commence employment with Probe is conditional
upon you providing a national police check and/or satisfactorily passing the client’s required clearance. You acknowledge
that your

employment with Probe cannot commence without timely provision of these clearances and in the event these clearances
do not satisfy our client's requirements your employment may be voided from commencement.

AGREEMENT to Letter of Offer and employee declaration

I declare and warrant that:


●        I have read, understood and agree to the terms and conditions of my employment as contained in this
letter and have received a copy of this agreement, the Schedule(s) and Position Description;
●        I acknowledge that I fully understand the provisions in these documents; did not rely on the employer’s
skill, care or advice when entering into this agreement; was not induced to enter into this agreement by
oppressive means, undue influence or duress by Probe; and before entering into this agreement was given a
copy of the intended agreement and had the opportunity to take independent advice as to the nature, effect and
extent of these terms and conditions;
●        I further warrant that I am aware that Probe is relying upon that I understand that:
(a)     Probe's policies and procedures are available to me if I require any clarification of any of the
matters set out in the Policies and Procedures; and
(b)    I must familiarise myself with and comply with the obligations on me, set out in Probe's policies
and procedures.
●        I confirm that I have been provided with a copy of the Position Description which sets out the duties and
responsibilities associated with the Position. I understand that Probe may update this Position Description at its
discretion, however any such updates will be in consultation with me;
●        I was given the opportunity to seek explanations of any term or condition which I did not understand prior
to signing the agreement;
●        I do not have any disability, medical condition, injury or illness which could affect my ability to carry out
the performance of the Position; and
●        The information provided by me when applying for this position is true and correct to the best of my
knowledge and belief.
●        I have not deliberately failed to disclose any matter which may have materially influenced Probe’s
decision to employ me.
●        I am not prevented by any contract or legal obligation with another employer, person or entity from
performing my obligations under this Agreement.
●        I am entitled to work lawfully in the Primary Work Location.
●        I do not have a criminal record or conviction for an offence that would in any way be relevant to the
Position with Probe.
