Deed of Usurfruct
WITNESSETH; That:
WHEREAS, The OWNER is the true and registered owner of a parcel of land
covered by Transfer Certificate of Title No. ______________________ of the
Registry of Deeds of Calamba City, Laguna, located at
_________________________________, _________________, containing an area of
80 square meters.
WHEREAS, The OWNER, by these presents offers for the use of the
USUFRUCTUARY the above-mentioned property where the business establishment
named _________________________________ will be erected.
1. That the term of this usufruct shall be for ___________ (______) YEARS
commencing from ___________________ and ________________, however if the
Owners needs the said premises they may cancel this Deed of Usufruct so long as she
gives the Usufructuary a one (1) month notice before the affectivity of the cancellation of
this contract;
4. That the water and electrical consumption, telephone, internet and any other
bills in the premises shall be shouldered by the Lessee;
5. That the Usufructuary cannot sub-lease the property subject of this Deed or
any portion thereof or otherwise assign its right under this contract to a third person
without prior knowledge and written consent of the Owner;
8. That the Usufructuary shall not keep, deposit or store in the leased premises
any obnoxious or inflammable materials or substance that might constitute a fire hazard
or cause detriment to the surroundings;
9. That upon expiration of this Deed, the Usufructuary undertakes to vacate and
surrender to the Owner the subject premises peacefully and in the same good, clean
and tenable condition as when it first occupied;
10. That should the Owner decide to sell the leased premises to another person,
other that the Usufructuary or they have other intention/project or he needs the
premises for personal or family purpose, the Owner shall terminate this Deed but shall
notify the Usufructuary at least 15 days in advance of the upcoming sale or other
Owner’s intention/project or Owner need the property for personal or family purpose;
11. That should the Usufructuary decide to abandon the leased premises and
terminate this Deed, he/she shall notify the Owner at least 15 days in advance.
12. That the parties hereto bind themselves to faithfully comply with the terms
and conditions of this Deed;
