BUILDING CONSTRUCTION AGREEMENT

Building Construction Agreement entered at Chennai on this the 5 th July 2011.

BETWEEN

Mr. E.PONNAMBALAM son of Mr.S.ELANGOVAN aged about 41 years residing & having
office . at plot no 143-B, Kamarajar street, Parvathy nagar,Old perungalathur, Chennai 600 063,
hereinafter referred to as the "BUILDER", which terms shall mean and include wherever the
context so requires or permits his heirs, legal representatives, executors, administrators,
nominees and assigns of the ONE PART.

Mr. ……………………. (Pan no……) son of Mr.Vedhachalam aged about … years,


residing at ........, Chennai, hereinafter referred to as the "LAND OWNER", which term shall mean
and include wherever the context so requires or permits his heirs, legal representatives,
executors, administrators, nominees and assigns of the OTHER PART.
WHEREAS the Owner is the true and absolute owner of all that piece and parcel of the
Land, more fully described in Schedule hereinafter referred to as the "LAND".

WHEREAS the Owner proposes to construct a residential house as per the plan attached
wth this agreement in annexture-I, hereinafter referred to as “HOUSE” more fully described in
Schedule-A in the Land and has offered the job of construction of the house to the Builder and
the Builder has also accepted to construct the House.

WHEREAS the Parties hereto have desired to reduce in writing the terms for the construction of
the House agreed between them, into an agreement.

Now the two paries hereto mutually agree and convenient as follows and this agreement of
construction WITNESSETH:

DETAILS OF THE VENUE TOBE CONSTRUCTED, COST & MODE OF PAYMENT OF THE
BUILDING CONSTRUCTION

1. The owner hereby appoint the Builder to construct the House measuring about
1340 Sq.ft. as mentioned in the Schedule-A land hereunder as per the details of working
given below.

i. Cost of Construction :

a. Ground floor Plinth area with


basement upto 4’-0” high : Rs.2400 x 1340 sqft. Rs. 32,16,000/-

2. The Parties agree to the payment terms as follows:


a. First Installment 25% Till completion of basement
b. Second Installment 15% Till completion of first roof
c. Third Installment 15% Till completion of all brickwork & headroom
d. Fifth Installment 15% Till completion of electrical, plumbing and
plastering
e. Sixth installment 20% Till completion of joinery, electrical & sanitary
fittings, tiling and painting
3. The contractor agrees to complete the entire construction within a period of nine months
and can be extended through three months with the consent of the owner, from the date
of commencement of the construction which shall be, provided, the Owner makes the
stage payments without any default.
4. The owner can point out errors, if any, at the respective stages of the House to enable
the Contractor to rectify the work, should it be reasonable.
5. The completion of the House is expected in all human efforts to be within the time
stipulated herein. Abnormal condition of nature and other factors beyond the control of
the Contractor shall be treated as force majeure.
6. The owner shall inform the contractor well in advance if she would like to add or delete
extra works / amenities apart from the specifications mentioned elsewhere.
7. The Contractor will indemnify the owner for all claims of injury caused to any person
whether a workman while in or upon the works, and the owner shall not be bound to
defend any claim brought under the workman’s Compensation Act.

SCHEDULE-A

SPECIFICATION
1. Foundation:
The foundation to be made by isolated column footing foundation. Sizes of footings, steel will be
in accordance to the structural drawing.
2. Plinth Beam:
Plinth beam size ……." and it is rested by making proper bed in the ground level by making P.C.C.
3. Basement:
The basement height to be raised by 3’ from the Ground level by brick work with C.M. 1:6. This is
inclusive of a tie Beam of size 4” x 9” at the top of basement. Anti-termite treatment will be
done.
4. Flooring:
The flooring concrete will be laid by using P.C.C. 1:4:8 of 4" thick Concrete (one part of
cement 4 part of sand and 8 part of 40 mm metal).
5. Brick Work:

The 9" BW for main walls will be constructed by using chamber burnt bricks or fly ash brick using
C.M. 1:6. 4 1/2" thick brick work for partition wall will be constructed by using chamber burnt
brick or fly ash brick using C.M. 1:4 1/2"
6. Lintel and Loft:
Cut lintel will be provided on top of all doors and windows at a height of 7’0” from the floor level.
All the windows will be covered with sunshade of width 2' 0" from the building outer wall with 6"
bearing on either side of the opening. In bed rooms, walk-in wardrobes and kitchen, loft of width
of 2’ will be provide on any one side of the room.(Generally above the door side of bed rooms
and kitchen- or as per design)

7. R.C.C. Roof:

The roof to be laid at a height of 9' 7.5" clear from the basement level and the thickness will be
4 ½” to 5” thick (or as per structural drawing). First floor roof level will be 10’ 7.5” clear. The
RCC concrete would be 1:2:4 (one part of cement, two part of sand and four parts of 20 mm
blue metals free from dust).

8. Parapet Wall:

Height to be 3 '0" from the roof level, 4 ½” thick parapet wall and will be supported by 9" brick
pillar at 9' c/c. Enough provision with metal rings for cloth drying poles will be made.

9. Tiles:

2’ X 2’ vitrified tiles flooring of rate not exceeding Rs.50/sqft will be done in all areas excluding
Kitchen and bathroom. Kitchen will have ceramic tile of rate not exceeding Rs. 50/sq.ft.

All toilet walls will have ceramic tiles till a height of 7’ or top of the ventilator level of size
approved by the owner and rate not exceeding Rs 30/sq.ft. Toilet floors will be laid with 1’x1’
anti skid ceramic tiles of similar rate. Car parking area will be done with antiskid cement block
paving.

Kitchen wall will have tiles for a height of 2’ above the counter. Counter will be finished in
granite with half nosing.

10. Joineries:
A). Main Door: Main door with a Maximum size of 3’3”x7’ will be done with teak wood frame of
size 4”x2” and teak wood panel door with varnish finish.
(Charges of any ornamental carvings on the door: extra)
B) Other Doors: Frame size 3”x3” with country wood or plywood as per architectural drawing with
flush doors or panel doors (not more than 1.5 inch thick) with paint finish and will have 3 hinges,
2 tower bolts and 1 aldrop or a cylinder lock

C) Bathroom Doors: All bathroom doors will be done using PVC of syntex or equivalent quality
with hinges, tower bolts complete.
D). POOJA ROOM DOOR: In country wood with paint finish and provision for bells.
(Charges of any ornamental carvings on the door: extra)
E) Charges for UPVC windows to be borne by the owner. Provision for window grills is made
inclusive of the quote. All windows to have 3” concrete at sill level.

11. Electrical

Anchor switches and electrical conduits all are concealed with switch box properly fixed in level.
The wiring will be made by using copper wires of ISI quality.

12. Plumbing:

All the inside plumbing lines are concealed of ¾” dia. For hot water line G1 pipe of lSI standard
be used. For Cold water ¾” of PVC pipe used. For attached bathroom and common bathroom hot
water provision will be provide. All the fittings are made of Waterman. For attached bathroom
EWC and wash basin (16" x 20") will be provided. All other outer plumbing work will be done by
using PVC pipes. For waste water and soil lines of 4 KG / CM2 used.
13. Painting:
A) Internal walls: All the inner walls are covered by wall putty and two coats of tractor emulsion.
B) Ceiling: To be painted with a coat of primer and two coats of tractor emulsion.
B) Exterior walls: Exterior wall will be applied with a coat of white cement and weather proof
paint.

10. Window glass : 4mm pin headed

11. Wall finishing inner : Tractor Emulsion

12. Wall finishing outer : Ace

13. Wood finishing & Grill work : Asian Enamel paint

TERMS AND CONDITION

A) EXCLUSIVE (not included)


1. Construction plan approval from Municipality or any other authorities
2. EB Connections from TNEB or others
3. Main Board items, cables, earthling for the same.
4. Elevation works
5. Low level area filling apart from plinth area.
6. Bore well.
7. Water and Drainage connections.

B) CONDITIONS
1. If any additional provisions need apart from the specification will be charged extra as per
the mutually agreed rates.
2. If any structural modification after completion of works will be charged extra.
3. Measurement will be taken as per the actual including sunshades, balconies and others
4. Total project shall be completed within 12 months from the start of Construction.

C) DETAILED SPECIFICATIONS

1. STRUCTURE:
Framed structure over existing columns and foundation as per Specification.
Outer walls 9”thick (in C: M 1:6) and inner partition walls 4.5” thick with C: M 1:4
The floor to Roof bottom height is 9’7.5”.Slab thickness is 4” to 5” thickness.

2.CENTERING:
Supplying, erecting and centering for plain surface such as RCC columns using mild steel
column boxes, shuttering for plain surface such as RCC slabs, sunshade, loft ,lintel and plinth
beams, etc. complete using mild steel sheet with silver oak, planks including scaffoldings and
removal after completion

3. BRICKWORK:
Brickworks in cement mortar 1: 6 using chamber brick/fly ash bricks of standard sizes for
ground floor, First floor and parapet wall including lifting, curing, finishing, etc… complete.

4. REINFORCEMENT CEMENT CONCRETE (RCC) 1:2:4


Reinforcement cement concrete 1:2:4 using 20mm down graded cursed metal (HBG),
Cement, steel TMT Bars including curing, finishing etc, for all works such as:-
 Column (1:1.5:3)
 Sunshades as per agreement drawings and elevations
 Roof slabs as per agreement drawings and elevations
 Lintel, loft and cupboard slabs as per agreement drawings

5. PARAPET WALL
Parapet wall 4.5” thick using bricks / fly ash bricks in cement mortar 1:4 including curing,
finishing etc. complete to a height of 3 ft. from roof slab.
6. WOOD JOINERY
 Doors: Frame size 4”x3” with red padak wood with flush doors (1.5 inch thick)
 Fittings: BEDROOM DOORS- Hings 3 nos, Tower Bolt 2 nos. and 1 aldrop.
 POOJA ROOM DOOR: Bell, Tower bolt 2 nos, Aldrop 1no, brass Handle.
 Window frames size is 3”x1.5” (Red padak wood or equivalent wood)
 Window glass -4mm pin headed or other equivalent.

7. MS GRILL
Windows & Ventilators made of grill of 12mm square rod and 6mm flat of conventional design
and detail.

8. CEILING PLASTERING
Surface of R.C.C plastering with cement mortar 1:3 -12mm thick including necessary hacking,
chipping, curing etc. complete

9. WALL PLASTERING
In side and outside surface of walls in cement mortar 1:4 – 6-12mm thick including
scaffolding, chipping, curing, finishing, etc. complete.

10. SUNSHADE
All sunshades shall have ordinary flat finish.

11. FLOORING AND TILES WORKS


Vitrified tile flooring for all main rooms at the cost of Rs.50/-per Sq.Ft.
Toilet walls tiled up to 7 feet height, and floor with anti skid tiles.
Kitchen wall tiles above granite platform 2’ height.
Toilet and utility flooring with tiles at the rate of Rs.30/-per Sq.Ft.

12. STRUCTURAL FABRICATION


Providing, fabricating and placing in position of TMT rods for all RCC works as per structural
design including cost of steel and binding wire as per the structural drawing Of the
contractor.

13. COLUMN, BEAMS &ROOF SLAB


As per the contractors structural drawings only.
14. PRE-CAST SLABS
Supplying & fixing R.C.C pre –cast slab using cement concrete 1:2:4 including cost of 6mm
mild steel, fabrication including curing, fixing, finishing, etc. complete for Bedrooms, and
kitchen shelves.

15. PLUMBING WORKS


a).Two toilets- two EWC, two wall mixer, two taps,
b).Wash basin (Basic) – 2 nos size is 20”x16” complete set.
c).Extra 2nos Taps will be provided at wherever necessary.

16. ELECTRICAL INSTALLATION


The complete electrical installation for all lights, sockets, telephone using PVC pipe, PVC
copper wires, switches, sockets, etc. by chipping chasing etc complete with Finolex cables and
Anchor brand (or equivalent) switches and sockets as per drawing.

17. WALL PAINTING


External with 2 coats of ACE of ASIAN Paints after 1 coat of suitable primer
Internal – Ceiling with 1 coat of Primer with white cement paint.
Interior walls with 1 coat of primer and 2 coats of tractor emulsion paint.

18. Joineries PAINTING


18.1).Wood work
Main door with oil polishing and all other doors painting with two coats, using Asian enamel
paints of approved colour and quality over a primary coat (totally 3 coats)
18.2).Grill painting
One coat of primer & 2 coats of ENAMEL paint with approved colour

E. Electrical Works
All wiring to be concealed and conduits in PVC pipe with copper wires. The minimum required
electrical points shall be provided as per contract.
Any extra points required by owner will be provided at extra cost.
5 amps one point Rs.750 /point
15 amps one point Rs.1000/point
20 amps one point Rs.1250/point.

F. NOTE:
1. Electricity and water to be provided by owner free of cost.
2. If the payments are released in stages, there will be delay and even hold in
progress of works accordingly.
3. Owner shall bear the difference in cost of materials (Marbles, tiles, wood
works, grill etc) to be paid at the time of purchase. Any changes or alteration
during the construction will only be done at additional cost.
4. All electrical fittings and fixing are not included in the scope of work, will be
done at rates mutually agreed upon.(fans, lights, chimney ,heaters and others)
5. Rain water Harvesting is extra.
6. Staircase Flooring and hand rails with Blaster will be charged as per actual and
is not included in the rate quoted above.
7. Mode of payments and project schedule to be planned and mutully agreed after
conformation of the work order.
