DEED OF SATISFACTION OF A DECREE

(Made under Order XXI Rule 2(1) of the Civil Procedure Code CAP.33 RE 2002)

THIS DEED OF SATISFACTION OF A DECREE is made this _____ day

of June, 2020 by and between G5 TECHNICAL SERVICES & GENERAL
SUPPLY – the Plaintiff, (herein referred to as Decree Holder), of the one
part and ZAMBIA CARGO & LOGISTICS LTD - Defendant, (herein referred
to as the Judgment Debtor) on the other part.

WHEREAS the D/Holder had instituted a suit against the J/Debtor and
was claiming against her for the following:-

1. That the Defendant be ordered to pay the Plaintiff specific damages

to a tune of Tshs. 29,915,130.00.
2. That the Defendant be ordered to pay general damages to a tune of
Tshs. 53,000,000.

3. Costs of this suit.

4. Any other relief(s) that the court may deem fit to grant.

AND PURSUANT TO WRITTEN STATEMENT OF DEFENCE filed by

J/Debtor she prayed that the suit be dismissed with cost.
AND WHEREAS the D/Holder and J/Debtor are agreeable to settle the
Decree passed by this Court on the 30 th September, 2015 and are further
agreeable that this Deed of Satisfaction of a Decree be recorded in Court in
adjustment of the decree,wholly and in full satisfaction thereof, as against
each one of them.

NOW THEREFORE the D/Holder and J/Debtor herein agree the

following:-

1.0 That ,the D/Holder shall be paid a total sum of Tshs. 23,152,870.-
being outstanding balance for the air conditioning services
rendered to the J/Debtor.

 2.0 That, the sum hereof shall be paid directly to the D/Holder and not
later than thirty (30) days counting from the date of registration of
this Deed of Adjustment of a Decree in Court.

3.0 That, the D/Holder agrees that to have no further claims against the
J/Debtor after payment of the sum mentioned in para 1.0 above.

4.0 That the parties herein submit this Deed of Satisfaction of Decree
for registration and upon registration, the same shall constitute
adjusted decree of the Court capable of execution.

THIS DEED OF SATISFACTION OF DECREE is signed by the parties on

the dates and year as here under appearing:-
