Shyam Narayan Chouksey v. Union of India. (Civil Appeal No.


855/ 2016); (Article 32 of Indian Constitution)

FACTS:

The petitioner moved to the Supreme Court under Article 32 of


Indian Constitution for the Supreme Court to provide additional
information to public for a proper sense of patriotism. He
believed that the National anthem is disrespected in many
levels.

ISSUE:

Whether it is compulsory for the people to stand up while the


National anthem plays in a movie theatre?

JUDGEMENT:
The Hon’ble Supreme Court on January 9, 2020, by a three-
judge bench of Justice Dipak Misra, Justice D.Y. Chandrachud
and Justice A.M. Khanwilkar held while relying upon the
decision given in Union of India vs Navin Jindal case that
National Anthem cannot be disrespected the people and every
citizen is obliged to show respect, however, cinema halls may
not be the suitable place as people come there for
uninterrupted entertainment. It shall be left on the discretion of
concerned person to stand up or not.
