COUNTER-AFFIDAVIT

I, Pedro Munsasu, of legal age, Filipino, married, and a resident of

Baguio City, Philippines, after having been duly sworn to in accordance
with the law do hereby depose and say that:

1. I am the respondent in the instant criminal complaint for Libel a

violation under Section 4 of R.A 10175 or Cybercrime Prevention
Act of 2012

2. That I may be served with copies of the subpoenas, orders,

resolutions, and other processes of this Honorable Office at the
New Lucban Extension Rd, Baguio City

3. That I personally know the complainant BEN BERTING who is of

legal age, Filipino, and a resident of Baguio City, Philippines

4. The complainant BEN BERTING is accusing me of violation under

Section 4 of R.A 10175 for libel for a Facebook post

5. On the 10th of March 2023, around 6:00 o’clock of the afternoon I

went to a computer shop near Barangay to print the
CONFIDENTIAL Document

6. Although it is a fact that BEN BERTIN the complainant convicted

my son Penduko Munsasu, I don’t have any resentment toward the
complainant

7. There’s indeed a Facebook post defaming the complainant but I’m

not the author of the post and I’m unaware that my account was
used to defame a person which is the complainant, it is merely a
coincidence where the post and the conviction of my son happen
at the same day
 8. I am executing this affidavit to attest to the truth of the foregoing
facts and for the purpose of causing the dismissal of the libel
complaint filed against me by BEN BERTING.

In the interest of justice, it is respectfully prayed that the instant

criminal complaint be DISMISSED for the lack of foundation or evidence.
