Instructions to students
1. Form a group (as a legal firm) consisting of 5 members (unless otherwise approved by the lecturer)
from the same tutorial section.
2. A leader shall be appointed among the five members in the presentation group. Each member shall
contribute towards the work and presentation.
3. Each presentation group shall choose only ONE (1) question (first come first serve basis). However,
each presentation group in the same tutorial section shall choose a different question. Therefore,
presentation groups in the same tutorial section may discuss or negotiate among themselves on the
selection of the presentation question.
4. This Presentation will be carried out during the tutorial in weeks 5 and 7. Each presentation is limited
to 20 minutes, followed by 8-10 minutes of Questions and Answers session.

QUESTION 1
Wan Der Foo passed away leaving a will in which he named his wife, Chin Swee Swee and
his sister, Wan Der Ling as the executrices. His will provided, among other things, the
instructions as follows:
His property held under Geran No.123, Lot 123, Town Area VII, District of Melaka
Tengah, State of Melaka together with a double storey house known as No.123, Jalan
Satu, 75300 Melaka is given to his wife, Chin Swee Swee and his son, Wan Jia Foo
(currently 15 years old) in equal shares
His Honda Civic car no. MCD1234 is given to his daughter, Wan Li Siang (currently
23 years old)
All his savings and fixed deposit are to be given to Chin Swee Swee, Wan Jia Foo and
Wan Li Siang in equal shares
His residuary estate is given to Chin Swee Swee
(a) Prepare the relevant legal documents to apply for the suitable type of grant of
representation for this scenario.

Question 2
Ting Tong Teng passed away leaving his wife (Ling Leng Leng), his daughter (Ting Theng
Theng) and his mother (Lim Poh Poh). Ting Tong Teng did not execute any will during his
life time. He owns the following properties:

Gombak, State of Selangor together with a three storey bungalow house known as
No.321, Jalan Besar, 68000 Ampang Selangor worth RM2 million

Question 3
Harry Mao passed away leaving some movable and immovable properties.
His brother, Mickey Mao filed a petition for probate for the estate of Harry Mao based on
Harry Mao’s will executed on 29/9/2022, in which Mickey Mao was named as the executor.
Winnie Poo entered a caveat against the issue of grant in favour of Mickey Mao on the
ground that she is the beneficiary under the last will and testament of Harry Mao executed
on 28/9/2013. Mickey Mao issued a warning and subsequently Winnie Poo entered the
appearance.
(a) Prepare the relevant legal documents starting from the stage of application for caveat
until the appearance to warning for this scenario.
(b) Present the procedure relating to entry of Caveat for contentious probate proceedings.

QUESTION 4
April Foo passed away on 19/12/2022 leaving only her sister, May Foo. The grant of
probate was extracted recently. For some years before her death, she had been infirm in
health and under the care of a nurse by the name of Jojo Tan. On 16/12/2022, April Foo
executed, in the presence of two witnesses, a document purporting to be her will, in which
she bequeathed everything she possessed to her nurse, Jojo Tan and appointed her as the
sole executrix.
Subsequently, May Foo issued a citation calling upon the executrix and sole beneficiary
under the purported will of April Foo to bring into the Registry and prove the same, or to
show cause why a grant of letters of administration, as upon an intestacy, should not be
made to May Foo. Jojo Tan entered appearance.
1) Prepare the relevant legal documents starting from the stage of citation to the entry of
appearance by the citee for this scenario.
2) Present the procedure relating to the issuance of citation until the citee’s entry of
appearance.
