Dear Mr Gall,

Employment contract with The Basement

I am pleased to offer you the role of Food and Beverage Attendant, grade 4, at The Basement
entertainment venue in Fortitude Valley.

1. POSITION AND RESPONSIBILITIES

1.1 You will be employed as a Food and Beverage Attendant at The Basement, Fortitude
Valley, Queensland. Your position will involve the duties and responsibilities set out in
schedule 1, plus other such dities as the Employer may allocate to you from time to time.

1.2 Your supervisor on appointment is Waldo Watkins

1.3 The nature of your role, duties, levels of responsibility and reporting lines may be
changed during the term of this agreement at the discretion of the Employer.

2. COMMENCEMENT DATE

2.1 Your employment commences on 14 December 2022 and is ongoing, part-time.

3. REMUNERATION

3.1 Your salary is in accordance with the Hospitality Industry (General) Award [MA000009]

3.2 Your classification under the award is Level 5

3.3 Your commencing rate is $26.31 per hour.

4. SUPERANNUATION

4.1 The Employer will, in addition to the salary, make superannuation contributions in
accordance with the Employer’s obligations under the Superannuation Guarantee
(Administration) Act 1992 and any regulations made pursuant to that act.

5. CONDITIONS OF APPOINTMENT

5.1 This offer is conditional upon:

a.) Your eligibility to work in Australia, including gaining and maintaining any
necessary work visas, and Your right to enter Queensland, Australia for work; and

b.) Satisfactory completion of a one (1) year probationary period.

ii During the probationary period either you or The Basement may terminate
this contract by providing 2 months’ notice.

iii Upon satisfactory completion of the probationary period, your employment


will continue in accordance with the provisions of this agreement.

6. INTELLECTUAL PROPERTY

6.1 Any intellectual property created or discovered during your employment must be
disclosed to the Employer and will belong to and be the absolute property of the
Employer or such one of its subsidiary companies as may be nominated by the Employer
for that purpose.

7. CONFIDENTIALITY

7.1 In this clause:

Confidential Information means all information which is confidential to The Basement,


including trade secrets, information concerning the market within which The Basement
operates, and information about The Basement’s financial performance, business
projections, business plans and business forecasts concerning its performance or likely
future activity.

7.2 You agree that you will not at any time either during the continuance of your employment
or after the termination of employment for any reason divulge any of the confidential
information, affairs or secrets (including trade secrets) of the Employer to any other
person or persons without the previous consent in writing of the Employer. You will not
use or attempt to use any information which you may acquire in the course of your
employment in any manner which may injure or cause loss or be calculated to injure or
cause loss to the Employer.

7.3 You must immediately notify your supervisor of any suspected or actual unauthorised
use, copying or disclosure of Confidential Information.

8. NON-COMPETITION

8.1 Non-competition during employment

You agree that you will not, during the course of your employment, directly or indirectly,
in any capacity whatsoever, carry on, advise, provide services to or be engaged,
concerned or interested in or associated with any business or activity which is
competitive with any business carried on by the Employer or its subsidiaries.

8.2 Non-competition after conclusion of employment

You agree that you will not, without the written consent of the Employer, during the
period of 2 years after the termination of your employment and anywhere within 20km of
Fortitude Valley:

a.) undertake, carry on, be employed or engaged in, whether directly or indirectly, any
business or activity that is the same or similar to the part of the Employer’s
business in which you worked during employment; or

b.) solicit, interfere with or endeavour to entice away from the Employer any
employee, contractor or consultant of the Employer.

9. ENTIRE CONTRACT

9.1 The terms and conditions contained in this contract represent the entire agreement
between you and The Basement with respect to your employment.
Please sign and return the enclosed copy of this letter to confirm acceptance of this offer of
employment.
