DEED OF ADJUDICATION WITH

WITH WAIVER OF RIGHTS


“A parcel of Land Lot No. 1478 covered by Tax Declaration No. 20-024-00014, located at Brgy. #27, Mumulaan,
Paoay, Ilocos Norte, Philippines containing a total area of EIGHTEEN THOUSAND FOUR HUNDRED AND
TWENTRY SEVEN (18,427) SQUARE METERS”

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, SEVERINO LORBES, died intestate at Paoay, Ilocos


Norte on __________, leaving neither will nor debts settled to date but
leaving a parcel of land;

WHEREAS, at the time of his death, he left as forced heirs, the


following and to wit

We, HELEN LOBRES DAFUN, PRECILA L. MAGALING, JESUSA


L. CAGAT, NELLY L. JIMENEZ, EUSEBIO L. ABUT, ANTONIO L.
ABUT, MARILINE L. OALLESMA and LEOPOLDO L. ABUT, all
resident of Brgy. #23 Bacsil, Paoay, Ilocos Norte, Philippines and all of
legal age, Filipino citizens, do hereby freely and spontaneously:

WITNESSETH:
THAT we are the legitimate heirs respectively, of SEVERINO
LORBES, who died on ___________ in Paoay, Ilocos Norte, Philippines;

A copy of his death certificate is hereto attached as Annex “A”

THAT said deceased died without any will or testament and


without any outstanding debts in favor of any person or entity;

THAT said deceased, at the time of his death, left a certain real
property, situated in Brgy. #27, Mumulaan, Paoay, Ilocos Norte,
Philippines, and more particularly described as follows:

“A parcel of Land Lot No. 1478 covered by Tax Declaration No. 20-
024-00014, located at Brgy. #27, Mumulaan, Paoay, Ilocos Norte,
Philippines containing a total area of EIGHTEEN THOUSAND FOUR
HUNDRED AND TWENTRY SEVEN (18,427) SQUARE METERS,
bounded on the NORTH by: 1477; on the SOUTH by: 1479; on the
EAST by: 1332; 1333; 1331; and on the WEST bby: SANDY LAND”

NOW THEREFORE, in view of the foregoing premises and


invoking the provisions of Section 1 of Rule 74 of the Rules of Court, and
subject to Section 4, Rule 74 of the same Rules of Court, we, hereby
adjudicate unto ourselves the above-described estate of the said deceased;
-DECLARETH FURTHER –

That for and in consideration of our love, concern and other valuable
considerations, We, HELEN LOBRES DAFUN, PRECILA L.
MAGALING, JESUSA L. CAGAT, NELLY L. JIMENEZ, ANTONIO L.
ABUT, MARILINE L. OALLESMA and LEOPOLDO L. ABUT,
hereinafter called the ADJUDICATEES/DONORS hereby WAIVE, CEDE,
TRANSFER and CONVEY all our rights and interest, pro indiviso or
aliquot share by way of this donation above-described property in favor of
our co-heirs EUSEBIO L. ABUT,.

That the DONORS do hereby state, for the purpose of giving full
effect to this donation, that we have reserved unto ourselves in full
ownership other properties to support us in a manner appropriate to our
stations in life.

That the DONEE do hereby ACCEPT the foregoing Donation of the


pro indiviso or aliquot share of parcel of land described above and for
which he express his sincerest appreciation and gratitude for the kindness
and liberality shown by the DONORS.

That the Adjudicatees/Donors, hereby warrant valid Title to and


peaceful possession of the above-described a parcel of land herein donated
and conveyed free from any liens, encumbrances whatsoever, and we will
defend the same from any lawful claims of any person whosoever.

That the pertinent provisions of the New Civil Code regarding the
giving of prior written notices to all possible redemptioners and pre-
emptioners as well as the Comprehensive Agrarian Reform Law were
complied with.

The parties hereto have agreed to register this instrument with the
proper authority in the Province of Ilocos Norte.

IN WITNESS WHEREOF, We have hereunto set our hand this


December 29, 2022 at Paoay, Ilocos Norte, Philippines.
