EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER AND QUITCLAIM

KNOW ALL MEN BY THISE PRESENTS:

This Extrajudicial Settlement of Estate is executed and entered into

this____
day of _________________ in Dulag, Leyte, by and among;

1. ROGELIO T. MALBAS, of legal age, married and a resident of

Barangay Calubian. Dulag, Leyte, Philippines.

W i t n e s s e t h:

That the above-named parties, all of legal ages, are the children and
surviving heirs of the late CIPRIANA TAGABE who died on September 11,
1985 at Dulag, Leyte, without any will;
That the said deceased, at the time of her death, left one (1) parcel of
land located at Barangay Calubian, Dulag, Leyte, more particularly described
as follows:

Parcel No. 1

"A parcel of land designated as Lot 8129 situated at Barangay Calubian,

Dulag, Leyte Bounded on the North by Lot 7670, on the East by Lot 8068, on
the South by BO ROAD; and on the West by Lot 7672 & 7671 containing an
area of TWO HUNDRED FIFTY NINE SQUARE METERS (259 sq. m.), more
or less, covered by Tax Declaration No. 08-13-0021-00307 issued by the
Municipal Assessor of Dulag, Leyte."

That no personal properties are involved in this extrajudicial settlement

of estate;

That to the best knowledge and information of the parties hereto, the
said deceased left no debts;

That the parties hereto being all of legal ages and with full civil capacity
to contract, hereby by these presents agree to divide and adjudicate, as they
hereby ADJUDICATE to ANTONIA CAIMEN-ALMIANO, her heirs, assigns
and successors-in-interest, the above-described one (1) parcel of land.
 That the rest of herein parties hereby waive, quitclaim and renounce any
nights, interests and participation over the parcel of land above-described not
adjudicated as them.

IN WITNESS WHEREOF, the parties have hereunto set their hands this
