RECONSTITUTING THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN

WHEREAS, Section 17 of Republic Act 7160, also known as the Local Government Code,
mandates that the barangays shall endeavor to provide for an effective and efficient provision of
basic services and facilitities which includes programs and projects for children and youth welfare;

WHEREAS, Republic Act No. 7160, otherwise known as the Special Protection of Children
Against Child Abuse, Exploitation and Discrimination Act, provides for stronger difference and special
protection against child abuse, exploitation and discrimination and its corresponding penalties;

WHEREAS, Articles 359 and 360 of the Civil Code of the Philippines provides that “the
government shall establish Councils for the Protection of Children”;

WHEREAS, Article 87 of Presidential Decree (PD) 603 (Children and Youth Welfare Code)
states that “every barangay council shall encourage the organization of a Local Council for the
Protection of Children LCPC) and shall coordinate with the Council for the Welfare of Children (CWC)
in drawing and implementing plans for the promotion of Child and Youth Welfare”. There is
therefore a need to organize LCPC not only in barangays but also in all other local government units
(LGUs), to ensure synchronization and integration of policies, programs and projects for children;

WHEREAS, Section 15 of Republic Act 9344, also known as the Juvenile Justice and Welfare
Act of 2006, mandates the LGUs to establish Local Councils for the Protection of Children and
allocate one percent (1%) of their Internal Revenue Allotment for strengthening and implementation
of programs and projects of said council;

WHEREAS, DILG Memorandum Circular 2002-121 dated August 5, 2002 enjoins all Local
Chief Executives to organize/re-organize their respective Local Council for the Protection of
Children;

NOW, THEREFORE, I, HECTOR E. ENAJE, Punong Barangay of Balogo, Bacon District, Sorsogon
City, by virtue of the powers vested in me by the Local Government Code of 1991 and other existing
laws, do hereby order;
 Section 1. Reorganization of Barangay Council for the Protection of Children (BCPC). The
Barangay Council for the Children of Barangay Balogo, Bacon District, Sorsogon City, is hereby re-
organized,

Section 2. Composition. The BCPC, otherwise referred to as the council, shall be composed
of the following:

Section 3. Functions and Responsibilities. The council shall have the following functions and
responsibilities:

1. Provide learning opportunities on the adequate rearing of children and positive parent-child
relationship.
2. Promote wholesome entertainment in the community, especially in movie houses.
3. Advocate for the establishment and maintenance of playgrounds, dauy care centers and
other facilities necessary for child and youth development.
4. Protect and assist Children in Need of Special Protection and refer cased filed against child
abusers to proper agencies/institutions.
5. Prepare AWFP for children and recommend appropriations to the Sangguniang.
6. Provide coordinate linkages with other agencies and institutions in the planning, monitoring
and evaluation of plans for children.
7. Establish and maintain database on children in the barangay.
8. Advocate for the passage of barangay resolutions/ordinances responsive to child-related
issues and concerns and ensure inclusions of children’s programs in the executive.
9. Monitor situational reports on children and quarterly updates including the implementation
of Children’s programs and make recommendations to the City CPC for consideration and
nationwide application
10. Perform such other functions and other child related laws, especially in matters of child and
parent education, health, entertainment, etc.,

Section 4. Secretariat. The Secretariat shall be responsible for providing technical support,
documentation of proceeding,, preparation of reports, and such other assistance as may be required
in the discharge of its functions. The Secretariat shall be composed of the following:

Section 5. Funding. Upon recommendation of the LCPC, funding shall be provided for
programs/projects/activities on children and ensure that these are implemented.

Section 6. Monitoring and Evaluation. Regular monitoring shall be conducted to determine

the functionality of the CCPC and the Barangay Councils for the Protection of Children and find out
their accomplishments. Including implementation problems and issues.

Section 7. Effectivity. This Executive Order shall take effect immediately.
