Dear Sir,

We refer to Contractor Notice cited above on the subject issue and would like to inform Contractor as below:

1. The Order issued by MHA dated 27th May 2021 is self-explanatory to under the circumstances it has
been issued.
2. The West Bengal restriction measures in terms of the provisions of DM Act 2005 was issued on
dated 27th May 2021.
3. The Order dated 27th May 2021 is self-explanatory for the reason to its issuance (please refer para 3
of preamble).
4. Even the Order dated 31st May 2021 was issued under the DM Act 2005 and the powers subsist
therein.
5. In the Order of 31st May 2021, the Employers mentioned therein is not mean to refer GCC Clause
1.1.2.5.
6. With regard to vaccination of workers at workplace, the said Order was issued by DM Authorities
under their authority and Employer does not have any control over the same. It may please be noted
that based on Liberalised Pricing and Accelerated National Covid-19 Vaccination Strategy that
would come in effect from 1st May 2021 (exclusively for the age group 18 – 45 years), Central &
State Govt. are providing the vaccine free of cost to all categories. The Contractor should have
availed the facility for its workmen from the various vaccination centres set up by State Govt.
Considering the same, the intent to claim the cost w.r.t vaccination is unwarranted and not
justifiable.
