VACANT POSSESSION AGREEMENT

This Vacant Possession Agreement is made on the ____________

BETWEEN John Doe of _____________________________________ as the Administrator of


the estate of ABC (“Administrator”) AND Jane Doe of ______________ (“Occupier”).

WHEREAS:

(1) The Administrator is the administrator for the estate of ABC the owner of the property
under Title No. <description of Title> (“Property”).

(2) There is an illegal house bearing address No. __________________built on the Property
(“House”).

(3) The Administrator has sold the Property and is required to give vacant possession of the
Property to the purchaser of the Property.

(4) Occupier has reached a settlement with the Administrator to vacate and demolish the
House and provide vacant possession to the Administrator under the following conditions.

IT IS HEREBY AGREED as follows:

Notice To Vacate

1. The Administrator has given the Notice to vacate to the Occupier to deliver vacant
possession of the house on the said Property.

Agreement to Give Vacant Possession

2. Occupier has acknowledged receipt of the Notice to vacate from the Administrator and
agreed to deliver vacant possession of the House erected on the Property on a date fixed
by the Administrator, that is on or before two (2) months from the date this vacant
possession agreement or on such extended period as the Administrator may extend
(hereinafter referred to as the Exit Date) and will also demolish the House and clean up
the area where the House has been erected at the cost and expense of the Occupier.

Consideration

3. In consideration for the delivery of vacant possession and demolishing the said House by
the Occupier, the Administrator agree to pay the Occupier RM 27,500 only as a full and
final compensation without admission of liability (hereinafter referred to as
Compensation).

4. The Administrator will give 7 days’ notice within the Exit Date as soon as the
Compensation has been prepared for payment to the Occupier and will pay RM_____
which is an advance and part of the Compensation to the Occupier and the Occupier will
at the expense of the Occupier himself vacant the House and demolish the structure
thereof and clean up the area of the House including building materials of the said House.

Notice After Vacant Possession

5. After the House is demolished, the Occupier will give notice to the Administrator or
Administrator’s solicitors Messrs. ___________who will conduct an inspection of the
Property to determine if the Occupier has demolished the House and cleared the area.

6. After inspecting the Property and the Administrator or Administrator’s solicitors confirm
that the Occupier has demolished the said House, the Administrator shall immediately
pay the Compensation and after the Occupier receives the Compensation, the Occupier or
Occupier’s heirs or personal representative shall have no claim against the Administrator
or new owner of the Property.

Occupier’s Indemnity

7. The Occupier indemnifies the Administrator and the new owners of the Property upon
any claim to the said House by any third party.

8. This Agreement shall be binding on the Administrator and Occupier and their respective
personal representatives, heirs and successors-in-title.
