DEED OF PARTITION
WITH MEMORANDUM OF AGREEMENT

This DEED OF PARTITION with MEMORANDUM OF AGREEMENT,

made and entered into by and among:

NINFA T. TEMBREVILLA-ANLAP, deceased, Filipino, represented by

her daughter, GENEVIEVE ANLAP-DAYUCOS, of legal age, married, Filipino
and with residence address at Brgy. Bulwangan, Hinoba-an, Negros
Occidental;

FEDERICO T. TEMBREVILLA, of legal age, married, Filipino and with

residence address at Brgy. 2 Poblacion, Hinoba-an, Negros Occidental;

LINDA T. TEMBREVILLA-OLIVEROS, deceased, Filipino,

represented by her daughter CARLYN T. OLIVEROS, of legal age, single,
Filipino and with residence address at Sta. Queteria, Caloocan, Metro
Manila;

SALOME T. TEMBREVILLA-ESTARES, of legal age, married, Filipino

and with residence address at Brgy. 2 Poblacion, Hinoba-an, Negros
Occidental;

CAMILO T. TEMBREVILLA, of legal age, married, Filipino and with

residence address at Brgy. 2 Poblacion, Hinoba-an, Negros Occidental;

EDITHA T. TEMBREVILLA-GERSANIB, of legal age, married,

Filipino and with residence address at Sta. Queteria, Caloocan, Metro
Manila ;

DINA T. TEMBREVILLA-ALFARO, of legal age, married, Filipino and

with residence address at Ayaman, Cabtuan, Iloilo;

NORMIE T. TEMBREVILLA, of legal age, single, Filipino and with

residence address at Brgy, Sum-ag, Bacolod City, Negros Occidental;

JOAQUIN T. TEMBREVILLA JR., of legal age, married, Filipino and

with residence address at Brgy. 2 Poblacion, Hinoba-an, Negros Occidental;

RHONA T. TEMBREVILLA-ANGEL, of legal age, married, Filipino and

with residence address at Brgy. 2 Poblacion, Hinoba-an, Negros Occidental;

DOLCENA T. TEMBREVILLA, of legal age, married, Filipino and with

residence address at Brgy. 1 Poblacion, Hinoba-an, Negros Occidental;

WITNESSETH:

WHEREAS, the above-named parties are the co-owners of that certain

parcel of land registered under the name of their late (deceased) father,
JOAQUIN TEMBREVILLA, Filipino, married to Narcisa Tiples, and is
situated at, Hinoba-an, Negros Occidental, and more particularly described
as follows:

TRANSFER CERTIFICATE OF TITLE NO. T-71398

A parcel of land (Lot 3954-M of the Subdivision plan

(LRC)Psd- 109877, being a portion of Lot 3954 of the Cadastral
Survey of Cauayan LRC (GIRO) Cad. Record No. 980), situated
in the Poblacion, Municipality of Hinoba-an, Province of Negros
Occidental, Island of Negros. Containing an area of Four
thousand six hundred six (4,606) square meters, more or less.

WHEREAS, the above-named parties voluntarily and freely agree

among themselves to divide and partition the herein described co-owned
property they have inherited upon the death of their father, JOAQUIN
TEMBREVILLA, through “Bunot-bunot or raffle” of the aforementioned
subdivided lots among themselves;

WHEREAS, it is to the convenience and advantage of the said parties

that the existing community of ownership between them be terminated, and
their respected shares and participation determined by mutual agreement;

WHEREAS, for purposes of this partition agreement, the parties

hereto caused the above-described property to be subdivided into Twelve
(12) Sub-divided lots with the Old House to remain and into Lot Nos. 1-A
to 12-A and another set of Twelve (12) subdivided lots with Lot Nos. 1-B
to 12-B, a copy, trace, blue print and technical description if the
aforementioned subdivided lots is herewith attached as ANNEX “A” and
made part of this agreement;

WHEREAS, the parties hereto have mutually and voluntarily agreed,

to partition and adjudicate between themselves their common property as

above-described after a duly agreed upon “Bunot-bunot or raffle”, in the
following manner:
