ORDER

For consideration is the alleged failure to use the correct pictogram

advisory and superimpose the correct classification rating of the
program "Kuha Mo" aired on 24 February 2020 over Jeepney TV DTT
Channel 43 in violation of Section 2, Chapter IV, of the 2004
Implementing Rules and Regulations (IRR) of P.D. 1986.

After having been required to show cause, Respondent, through its

authorized representative, Ms. Katia Elisa M.Pla, submitted a Position
Paper for "Kuha Mo" and "Pangako Sa 'Yo" dated 02 July 2020 which
the Board received on 09 July 2020. Respondent admitted that the 24
February 2020 episode of "Kuha Mo" exhibited a "PG" pictogram
instead of an "SPG" because it was inadvertently assumed that the
program was given a "PG" classification. She furthered that what
happened was an honest mistake and provided a plan to avoid
committing the same mistake again.

 Section 2, Chapter IV, of the 2004 Implementing Rules and
Regulations of P.D. 1986 provides that all television programs must
strictly comply with the classification rating prescribed. A program with
a rating of "PG" may only contain some adult material that may be
permissible for children to watch but only under the guidance and
supervision of a parent or adult. A program with an "SPG" rating, on the
other hand, may contain a more serious topic and theme which may
not be advisable for children to watch except under the very vigilant
and presence of a parent or an adult. Failure to use the correct
pictogram advisory and superimpose the correct classification rating
constitutes a very serious matter as it negates the Board's objective to
ensure age-appropriate entertainment for the viewing public. The
established principle in this jurisdiction is that where television is
concerned, a less liberal approach calls for observance because
television reaches every home where there is a set. The vulnerable and
imitative in the young audience might misunderstand the scenes
shown in the program.

Foregoing considered, a fine of Five Thousand Pesos (Php 5,000.00)

is being imposed for the failure to use the correct pictogram advisory
and superimpose the correct classification rating of the program "Kuha
Mo" aired on 24 February 2020 over Jeepney TV DTT Channel 43 in
violation of Section 2, Chapter IV, of the 2004 Implementing Rules and
Regulations (IRR) of P.D. 1986.
