STUDENT OBLIGATIONS AND AGREEMENT


The following is an agreement between BROWNS English Language School Pty Ltd (“BROWNS”), trading as
BROWNS English Language School and BROWNS Professional, and an intending student (including the
parent/guardian who has signed this agreement). Please make sure that you understand and sign this agreement
before completing your enrolment by paying your fees. Ensure you keep a copy for your records. As an applicant
for enrolment at BROWNS, I agree to abide by the following:

- I understand that I will be assessed during my studies.


- It is a condition of my enrolment to maintain satisfactory progress and attendance at a rate that will
enable me to finish my course within the nominated duration.
- I agree to pay course fees and other charges on the due dates as outlined in my Offer Letter and Invoice. I
agree that BROWNS may alter tuition and non-tuition fees from time to time and that BROWNS will notify
me in writing of any changes that affect my enrolment.
- I understand a whole week of tuition is payable in weeks that contain a public holiday, and classes are not
held on public holidays.
- I understand if my fees are overdue at any time during my course, I may be suspended from class or have
my enrolment cancelled. In addition, BROWNS will report Student Visa holders to the Department of
Home Affairs (DHA).
- I understand BROWNS must have my accurate visa details at all times and may need to notify any changes
to the Australian Department of Home Affairs (DHA).
- I am required to meet the course requirements and abide by BROWNS rules and regulations. If I breach
any of these rules or my behaviour is deemed unacceptable, BROWNS reserves the right to cancel my
enrolment. I may not be eligible for a refund of any fees paid.
- I am responsible for my books, equipment and materials provided and for replacing them if I lose or
misplace them, as they are a required part of my course/s.
- I agree all lessons and any related material supplied by BROWNS are copyrighted, remain the property of
BROWNS, and in some cases, must be returned to BROWNS upon completion of my course.
- I understand I may be required to attend excursions organised by BROWNS as a part of my course/s,
which will be arranged at no additional cost.
- I understand that BROWNS, and its representatives and staff, will not be held liable for any loss, damages,
death, illness or injuries to people or property whilst on any activity or excursion organised by BROWNS. It
is my sole responsibility to take out insurance against such risks. Therefore, BROWNS recommends that I
take out comprehensive travel, accident and medical insurance in my own country before travelling
abroad.
- I understand it is my responsibility to keep a copy of this written agreement as supplied by BROWNS and
receipts of any payments of tuition fees or non-tuition fees.
- I agree that I will comply with all BROWNS policies and procedures related to my enrolment. These
policies and procedures are available from the BROWNS website.
- I consent to study online in the event of health and safety conditions at the campus or circumstances
outside the control of BROWNS prevent the course from being delivered face to face.
- I am aware of the estimated cost of my stay in Australia and understand that I am responsible for
meeting all living costs associated with my stay. (Information relating to indicative costs of living in

- This written agreement, and the right to make complaints and seek appeals of decisions and action
under various processes, does not affect the rights of the student to take action under the Australian
Consumer Law if the Australian Consumer Law applies.

Refund Policy Outline

- Cancellations are only effective once they are received in writing.


- All requests for a refund must be made in writing via the refund request form available on the website or
from reception. Email the form to apply@browns.edu.au.
- If you are not granted a visa all fees, except the Application Fee, will be refunded within 4 weeks of
receiving written notification.
- Cancellation means the Application Fee, or its equivalence is non-refundable.
- If you cancel your course 4 weeks or more before your course commencement date, all fees received
except the Application Fee will be refunded. If you cancel your course less than 4 weeks before your
course commencement date, a cancellation fee of 50% of paid tuition fees will also apply. BROWNS will
refund all other fees except the Application Fee. If you advise cancellation on or after your course
commencement date, BROWNS will refund no tuition fees.
- If you defer your course's commencement date and then later cancel your course before the new
commencement date, the refund policy will apply from the original course state date, not the deferred
start date.
- You will be offered a refund of the unused portion of course fees paid if we do not offer an advertised
course or withdraw the delivery of the course before its completion. Alternatively, you may be offered a
suitable alternative course at no extra cost. You have the right to choose a refund or the offer of
placement in another course.
- Once the Placement Confirmation is issued, the Homestay, Apartment/Residence fees are not refundable
if you advise us less than 2 weeks before your commencement date that you wish to cancel the service
unless BROWNS can find a suitable replacement.
- Any refunds payable under this policy will be made within 4 weeks of receiving the written refund
application.
- All refunds will be paid to the person who has entered the contract with BROWNS unless the person gives
a written direction to pay the refund to someone else.
- In all cases of suspension and expulsion due to non-compliance with the Student Code of Conduct, no
refund of monies paid to the School will be made unless required by law.

Complaints and Appeals Policy Outline

BROWNS is committed to providing effective, efficient, timely, fair and confidential complaints and appeals
handling procedures for all Students. This policy covers both academic and non-academic complaints and appeals.
Students can make a complaint or appeal regarding their dealings with BROWNS, our education agents or any
related party BROWNS has an arrangement.
Students can sometimes be dissatisfied with their study, agent or some other part of their experience. We
encourage you to talk to someone who can try to assist. BROWNS will always help you resolve your issue
promptly, respectfully, and courteously. If BROWNS cannot assist, students can contact the International Student
Ombudsmen.

ELICOS Applicants Only:

- I understand some courses require a prerequisite level of English for entry. BROWNS will test my English
language ability and place me at a level accordingly.
- I understand the BROWNS Statement of Achievement will state that my “Overall attendance was
unsatisfactory” if my attendance is below 80%.

Student Visa Holders Only:

- I understand BROWNS must monitor my course progress and attendance throughout my enrolment at
BROWNS. Failure to make satisfactory progress or maintain a minimum attendance percentage of 80%
may result in BROWNS notifying the Department of Education of my inability to meet the conditions of
my Student Visa.
- I understand that temporary suspensions will only be granted under compassionate/compelling
circumstances after I commence my enrolment.
- I understand I cannot transfer to another provider within the first 6 months of my principal course of
study without a written letter of release from BROWNS.
- I understand that any school-age children or other dependents accompanying me will be required to
attend school and pay full fees at an Australian private or government school.
- I understand I must have a current Overseas Student Health Cover (OSHC) policy for the entire duration of
my visa.
- I understand I must notify BROWNS within seven (7) days of any change of address or contact details in
Australia. I also understand that BROWNS will notify the Department of Home Affairs (DHA) of this
change.

Disclaimer: BROWNS has the right to alter its fees, terms and conditions, defer its courses and alter class
timetables in line with applicable regulations and legislation.
Non-tuition fees may be incurred, such as having study outcomes reassessed, deferral of study, late payment of
tuition fees ($200), or other circumstances in which additional fees may apply. Changes will be provided to me in
writing.
Consent to Publication of Imagery: Students or parents/guardians (for those under 18) agree that a student’s
photos, video footage, testimony and achievements may be used for promotional purposes by BROWNS. If a
student disagrees, they must advise BROWNS in writing.
Privacy Policy

The circumstances in which personal information about the student may be disclosed by the provider, the
Commonwealth, including the TPS, or state or territory agencies, in accordance with the Privacy Act 1988.
