JOINT AFFIDAVIT

WE, BENEX N. DUCA, DANREB B. BELLEZA, both of legal age and

ESTEPHEN A. LUNA, 17 years old, all Filipino citizens and residents of Barangay
Sabang, Legazpi City, after having been duly sworn in accordance with law, hereby
depose and state that:

1. On 21 May 2009, about 10:15 PM, we were asked by FRANCIS S.

ALMAYDA to help the him bring to the hospital his wounded brother
BENITO S. ALMAYDA;

2. We noticed that BENITO S. ALMAYDA had a stab wound in his

abdomen;

3. We used the tricycle driven by WILLIAM RODRIGUEZ to bring BENITO

S. ALMAYDA to the hospital.

4. On the way to the hospital, FRANCIS S. ALMAYDA asked his wounded

brother who stabbed him. BENITO S. ALMAYDA answered that it was
“MIC” who stabbed him.

5. We noticed that after answering the question of his brother, BENITO

S. ALMAYDA became unconscious.

6. We are executing this affidavit to affirm the truth of the foregoing

statement and for any legal purpose this may serve.
