WHEREAS, the PNP FG Board of Survey was created in this Unit under PNP
FG Admin Letter Orders No. 21-204 dated November 2, 2021;
WHEREAS, based on the Memorandum dated August 30, 2021, that on May
7 and 8, 2021, the personnel of Logistics Section, led by Fideliz Lourdes Albento
Sabit, SAO, FG, conducted actual comprehensive inventory on the equipment of
RCLO 7 and it was found out that the two (2) Hytera Handheld Radios, Four (4)
Hytera Li-on Battery pack and Four (4) Hytera MCU Charger were missing;
WHEREAS, on June 24, 2021, RFU7 has made a memorandum for Pat Jonil
Sumalpong to explain in writing in affidavit form since he was the designated supply
PNCO on that time.
WHEREAS, that on July 7, 2021, PCpl Johncin Caballes found one (1)
Hytera Handheld Radio, two (2) Hytera Li-on Battery Pack and one (1) Hytera MCU
Charger at the Medico-Legal Section. He promptly turned it over to Pat Jonil A
Sumalpong, who subsequently reported the incident to the Duty OD, PMAJ
JESHRELL P CRUDA;
WHEREAS, that after due investigation of RCLO7, the lost items were one (1)
Hytera Handheld Radio with serial number 17927A0230, two (2) Hytera Li-on Battery
pack and three (3) Hytera MCU Charger;
WHEREAS, based on the affidavit of loss dated March 23, 2023, Pat Jonil A
Sumalpong states that he was the designated Supply PNCO of RFU7 when one (1)
Hytera Handheld Radios, two (2) Hytera Li-on Battery pack and three (3) Hytera
MCU Charger were found to be missing.
WHEREAS, upon discovering that said items were lost, Pat Jonil A
Sumalpong with the help of PCPT Mervin Brinquez and PCMS Thomas D Domael
diligently searched and exerted effort to locate the same but to no avail.
WHEREAS, on May 3, 2023, the PNP Forensic Group Board of Survey
(PNPFG BOS) convened to review and determine said accountability pursuant to DL
Circular No. 002-02;
WHEREAS, the PNPFG BOS shall conduct an investigation and evaluation of
the facts and circumstances about the loss or damage of any PNP property and
likewise shall determine if the person requesting relief shall be held liable or not for
the lost property/properties;
WHEREAS, the PNPFG BOS is constituted of five regular members with
PLTCOL FERDINAND MARIA A SERAPIO as Chairman/Presiding Officer; PMAJ
CHE MAYO M GUEVARA, PLT AVEGAEL A BILIBLI, NUP Fideliz Lourdes A Sabit,
PMSg Mary Ann A Bacsal as members;
WHEREAS, with the presence of PLTCOL FERDINAND MARIA A SERAPIO,
as Chairman/Presiding Officer, and the members of the Board, PMAJ CHE MAYO M
GUEVARA, PLT AVEGAEL A BILIBLI, NUP Fideliz Lourdes A Sabit, PMSg Mary
Ann A Bacsal, thus, a quorum was declared;
PNPFG BOS convened in a conference to investigate the facts and
circumstances of the alleged lost items and evaluate the submitted documents
pertaining to one (1) Hytera Handheld Radio with serial no.17927A0230, two (2)
Hytera Li-on Battery pack and three (3) Hytera MCU Charger and to determine the
extent of property accountability of subject PNCO based on the submitted supporting
documents;
WHEREAS, submitted during the conference are the following documents:
1.Incident Report; 2.Property Acknowledgement Receipt; 3.Investigation Report;
4.Affidavit of Loss; 5. Affidavit of Two Disinterested Persons.
WHEREAS, Section 73 (1) of PD 1445 or the “Government Auditing Code of
the Philippines” states that “When a loss of government funds or property occurs
while they are in transit or the loss is caused by fire, theft, or other casualty or force
majeure, the officer accountable therefore or having custody thereof shall
immediately notify the Commission or the auditor concerned and, within thirty days
or such longer period as the Commission or auditor may in the particular case allow,
shall present his application for relief, with the available supporting evidence.
Whenever warranted by the evidence credit for the loss shall be allowed. An officer
who fails to comply with this requirement shall not be relieved of liability or allowed
credit for any loss in the settlement of his accounts.”
WHEREAS, based on official documents, investigation report, and other allied
documents submitted before this Board, it is clear that Pat Sumalpong did not
deliberately lose the said radio set nor he have been negligent to cause the loss of
said items;
WHEREAS, there is a clear showing that no deliberate intent on the part of
Pat Sumalpong or any indication that he was grossly negligent that resulted to the
loss of radio set since he ________________________;
Further, this Resolution shall be forwarded to the Office of Director, Forensic Group
for the approval.
