3. Background of the Incident

LAW ENFORCEMENT OPERATION: SERVICE OF WARRANT OF ARREST

What : Implementation of Warrant of Arrest

Where : Boundaries of Barangay Gligli and Macabual, Pikit, Cotabato
When: February 19, 2022 @ 9:40 in the Morning
Who : Accused/Suspect:Mosim Manebped Dalanda (DIPO)
Victim: Erwin Besana Doctolero (Fatal)
Operating Team: Joint Task Force of PRO 12, CIDG 12, RID 12, PDEA 12 and
 90IB, 602nd Bde, 6ID, PA.
How:
- The approaching Operating Team onboard of a marked vehicles were shot
by the accused/suspect
and his armed cohorts;
- The Operating Team defended themselves by firing back to repel the
imminent danger;
- The encounter lasted for more or less 3 hours;
- Accused/suspect and the Action agent sustained gunshot wounds but were
declared DOA at the
hospital by their attending physician; and
- The pieces of evidence recovered from the possession of accused/suspect
were as follow:
1) One (1) Unit 5.56mm M16 Colt AR 15 Rifle, chamber loaded and
with defaced SN;
2) One (1) piece steel Magazine; and
3) Twenty-Two (22) pieces ammunition of 5.56mm Caliber.

HOT PURSUIT OPERATION

What : Arrest of a Suspect (Cohort)

Where : Sultan Kudarat Doctors Hospital, Purok 11, Barangay Poblacion,
Tacurong City, Sultan Kudarat
When: February 19, 2022 @ 8:00 in the Evening
Who : Suspect – Brahim Manibped y Kabuyao Alias “Brown”
Operating Team: Joint Elements of Tacurong CPS, RID 12, CPMFC,
1st SKPMFC,
Pikit MPS and SKPPO led by PCOL TOM P TUZON,
Provincial Director.
How:
- The suspect was confined due to a sustained gunshot wound at said
Hospital;
- The operating troops conducted a follow-up operation;
- The suspect was arrested when he was positively identified as one of the
armed
men and cohort who engaged the operating Team; and
- The arrested suspect was guarded by PNP Personnel SKPMFC and Pikit
MPS.

4. Chronology of Events

February 19, 2022

9:40 AM: The Operating Team entered in the Boundary of Barangay Gligli and
Barangay Macabual, Pikit, Cotabato, to implement the warrant of arrest against
Mosim Manebped Dalanda, but upon approaching to the resident of the
accused/suspect, they were shot by the accused/suspect and his armed cohorts -
Firefight lasted for more or less three (3) hours.
12:56 PM: The Seizing Officer recovered from the possession and control of the
suspect the following pieces of evidence - One (1) unit 5.56mm M16 COLT AR 15
Rifle with defaced serial number, chamber loaded, and with inserted one (1) steel
long magazine loaded with twenty-two (22) live ammunition for the same caliber.
1:00 PM: Action agent identified as Erwin Besana Doctolero and the suspect
Mosim Manebped Dalanda were brought to Cruzado Medical Clinic and Hospital,
 Poblacion, Pikit, Cotabato, due to their sustained gunshot wounds but was
declared DOA by the attending physician at around 1:25 PM. 1:30 PM: The
Personnel of Provincial Forensic Unit, Kidapawan City conducted a post mortem,
paraffin and finger print examination to the accused/suspect. Waiver was also
signed by his immediate family and he was turned-over for Islam Burial Rites. (See
attached request for Post Mortem and Paraffin Examination; and the Waiver of the
Family)
2:00 PM: The Seizing officer properly turned – over the recovered pieces of
evidence to the IOC. Spot Report was prepared and submitted to CPPO.
2:30 PM: A request for of a Firearm and ammunition records verfication was sent
to RCSU 12, General Santos City.
2:56 PM: Certification of Orderly conduct of Law Enforcement Operation was
secured from Barangay Official of Barangay Gligli, Pikit, Cotabato.
8:00 PM: An information was received that the Joint Task Force of PRO 12
Personnel conducted a Hot Pursuit operation at Tacurong City and arrested the
suspect Brahim Kabuyao Manibped alias “Brown (See attached Spot Report of
Tacurong MPS)
8:50 PM: The IOC submitted the recovered pieces of evidence to PNP North
Cotabato PFU for ballistic examination.

February 20, 2022

9:40 AM: IOC and COP Pikit MPS attended a Case Conference at Conference
Room, CPPO, Amas, Cotabato.
12:56 PM: The COP together with the IOC of Pikit MPS made a follow up to
Tacurong MPS on the arrested suspect in a Hot-pursuit operation. A letter request
for medical confinement certification was sent to Sultan Kudarat Doctors Hospital.

February 21, 2022

11:30 AM: A Coordination was made at the Prosecutor Office, Midsayap,
Cotabato, and filed a criminal complaint through inquest proceedings at Provincial
Prosecutors, Midsayap, Cotabato against the respondent Brahim Kabuyao
Manibped for MURDER and ATTEMPTED MURDER with docket number XII-06B-
INQ-22B-00054 and XII-06B-INQ-22B-00055. The COP Pikit is the Nominal
complainant for Murder case while Patrolman Ariola for the attempted murder.

February 24, 2022

10:00AM: The IOC of Pikit MPS received a copy of resolution order of respondent
Brahim Kabuyao Manibped for the crime of Murder and Attempted murder.

March 4, 2022,
10:30 AM: PMAJ SUNNY R LEONCITO, PMAJ JEREK KENT FLORES
CAPADOSA, PLT DIOMEDES G BARUC and Pat Nabil N Mohammad filed a
criminal complaint through Regular proceedings for FOUR (4) Counts of
ATTEMPTED MURDER against the respondents Brahim Kabuyao Manibped,
Mosim Manebped Dalanda and identified cohorts as follows:

March 15, 2022

3:30 PM: The accused Brahim Kabuyao Manibped alias “Brown” was committed to
North Cotabato District Jail, Brgy Amas, Kidapawan City for the charged of
MURDER and ATTEMPTED MURDER.

5. ACTION TAKEN AFTER THE INCIDENT

1) Immediately conducted investigation and coordinated the other concerned
PNP units:
a) Provincial Forensic Unit, Kidapawan City;
b) Regional CS Unit, General Santos City;
c) Tacurong MPS, Tacurong City;
d) Provincial Investigation and Detection Management Unit, CPPO;
e) Regional Investigation and Detection Management Division, PRO12;
f) 1st Mobile Company, Cotabato Province Mobile Force Company,
g) Regional Intelligence Division, PRO12;
h) Provincial Intelligence Unit, CPPO; and
i) Regional Operation Division, PRO12

2) Subsequently a case was filed against the suspects:

a) Inquest: Brahim Manebped alyas Brown - Murder and Attempted Murder
b) Regular Filing: 16 Respondents (Cohorts)

6. Results

Accused was commited to BJMP, Amas, Kidapawan while a case of 4 counts

attempted murder were also filed to the 16 cohorts/respondents.

7. Lessons Learned

In the conduct of Law enforcement operation, it his highly recommend that the
following must deliberately be undertaken:
1) Planning;
2) Tasking;
3) Unity of Command;
4) Contingency Plan;
5) Standby Medical Team; and
6) There shall be a debriefing after the operation.

While in the Investigation, there shall be a:

1) Established Command Post;
2) Standby Investigation support Unit/Team; and
3) Focal Person to serve as a liaison between the Territorial Unit and Other
PNP units;

8. Suggestion/Recommendation
a. Standby ambulance and medical team;
b. Sustained the practice of full investigators during the conduct of
investigation;
c. Prior coordination to Provincial Forensic Unit before the operation;
d. Protected equipment should be provided to all operating units and action
agent/s; and
e. Action agent should leave the area after identifying the suspect/target;
