JUDICIAL AFFIDAVIT

I, ROBERT O. DIAZ, of legal age, Filipino, married, and a resident of

Poblacion I, Oroquieta City, do hereby state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Kent Rickx S. Pede inside his office in
Purok 4, Independence St., Poblacion II, Oroquieta City.

The examination is being held at the same address.

I am answering his questions fully conscious that I do so under oath

and may face criminal liability for false testimony and perjury.

Question (Q) and (A) Answer:

Q1: What is your occupation?

I am the Operation Manager of GT Distributor- Globe.

Q2: Do you have proof of that fact?

Q3: How long you have been an Operation Manager of GT Distributor-Globe?

I started on 2012 until present. It is about 11 years already.

Q3: What is the nature of business of GT Distributor-Globe?

The company sells AutoloadMax, Sim Cards, and Globe BroadBand.

Q4: How is the transaction of the company done?

 The business transaction is over the air which is controlled and
governed by a system. The company hired a so called Direct Sales Personnel
(DSP)/Sales Agent who have their own Mob Tel Number Registered in the
system.

Q5: What is the function of the DSP/Sales Agent?

The DSP/Sales Agent is the one who sell the AutoloadMax, Sim Cards,
and BroadBand.

Q6: How is the selling conducted by the DSP/Sales Agent?

The DSP/Sales Agent will recruit retailers of AutoloadMax, Sim Cards,

and BroadBand. Once the DSP/Sales Agent already had one, the DSP/Sales
Agent will request the AIS to enroll the retailer’s Sim Card and to be tagged or
registered under the DSP/Sales Agent Mob Tel Number.

Q7: What happened if the retailer’s sim card is not enrolled and tagged under
the DSP/Sales Agent Mob Tel Number?

The DSP/Sales Agent cannot request to the system to give load to the
retailer. In short, DSP/Sales Agent cannot sell a load to someone else unless
registered or tagged under his Mob Tel Number.

Q8: Once the retailer’s sim card was tagged already to a certain DSP/Sales
Agent, how is the selling of load from the DSP/Sales Agent to the retailer be
done?

When the retailer wants to buy a load to his/ her DSP/Sales Agent, the
latter will request the system to give a load to the retailer’s sim card,
depending on the amount of load to buy, and then the system will send a code
to the DSP/Sales Agent Mob Tel Number for confirmation and right after the
system will give a load to the retailer.

Q9: How then is a payment of the load bought by the retailer be made?

The payment shall be collected by the DSP/Sales Agent right there and
then.

Q10: After all the days’ payment has already been collected by the DSP/Sales
Agent, what happened next?

The system starts to open at 7:00 o’clock in the morning and the cut-off
time is until 2:00 o’clock in the afternoon. The DSP/Sales Agent should have
to account all his sales within that day until 2:00 o’clock in the afternoon so
that he has still time to deposit his collections in the bank which had a cut-off
time of 3:00 o’clock in the afternoon.

Q11: How is the accounting of the sales of the DSP/Sales Agent be done?

 The system through the AIS will send the total sales of a certain
DSP/Sales Agent before the cut-off time of 2:00 o’clock in the afternoon and
the same sales of the DSP/Sales Agent shall be deposited by him/her to the
bank under the bank account of the company.

Q12: After the collection was already deposited to the bank, what shall the
DSP/Sales Agent do next?

The company shall give to the DSP/Sales Agent a ___________ form which
he will fill up all his sales with his corresponding deductions which will then
be matched to his deposit slip and then submit it to the Hub in charge in the
area for verification.

Q13: After the verification of the sales of the DSP/Sales Agent, what
happened next?

The ______________ form together with all its attachments such as deposit
slip, ___________________, are all compiled and placed in a safety box for auditing
purposes of the company.

Q14: By the way, do you know a certain DSP/Sales Agent named Ronie
Alfanta?

Yes sir. When I became the Operations Manager on 2013, he was

already a Sales Agent of the company.

Q15: Where was he assigned?

He was assigned in Ozamiz City.

Q16: How was he as a DSP/Sales Agent?

I did not hear anything from him. He had no infraction in the company
not until it was discovered that he had anomalies that led to the filing of this
case. However, there were times before that he did not remit his sales
because he declared that he was being held-up of which the company
understands.

Q17: Do you have something else to say?

None sir.
