This Memorandum of Agreement is entered into this day of at the City of Catbalogan,
Province of Samar, Philippines, by and between:
The Department of Education, Division of Samar, an agency of the national government of the Republic of the
Philippines, created by virtue of Batas Pambansa (B.P.) No. 232 “ The Education Act of 1982” as amended by Republic
Act (R.A) No. 9155 otherwise known as “Governance of Basic Education Act of 2001”, with office address at DepEd,
Division of Samar, Arteche Blvd., Catbalogan City, Samar, represented by its Schools Division Superintendent,
Carmela R. Tamayo, EdD, CESO V herein referred to as “DepEd Samar”;
-and-
Provincial Government of Samar, with office address at Samar Capitol Building, Catbalogan City, Western
Samar represented in this Agreement by the Provincial Governor, Hon. Reynolds Michael T. Tan herein after referred
to as the “PLGU”.
WITNESSETH: That
WHEREAS, Republic Act 8525, otherwise known as “An Act Establishing the Adopt-A-School Program which
was enacted to encourage Local Government unit to assist in the delivery of better quality education to public schools
in the country;
WHEREAS, the DepEd, Division of Samar, hereafter referred to as DepEd Samar is mandated to implement
DepEd Order No. 39, s. 2016 known as the Basic Education Research Agenda;
WHEREAS, in furtherance of said mandate, DepEd Samar strengthen the culture of research and provide
directions on research initiatives in the division and at the school level and to give highlight on the result-based
researches input to policy recommendations and to address pressing issues confronting nowadays in order to achieve
the maximum academic performance of the learners;
WHEREAS, Section 272 of R.A. No. 7160 provides that a portion of the SEF shall be allocated to address all
the activities related to Research and Development Program in the Division of Samar;
WHEREAS, the Provincial School Board convened on March 18, 2022 for the purpose of discussing the Legal
Bases on the utilization of the Provincial Special Education Fund (SEF) as provided in the Joint Circular (JC) No. 1, s.
2017 otherwise known as REVISED GUIDELINES ON THE USE OF THE SPECIAL EDUCATION FUND (SEF) and
discussed the details of the proposed budget for 2022 Special Education Fund (SEF);
WHEREAS, in compliance with Section 5.4 of said Joint Circular, the Provincial School Board has signed
Resolution No.01 s. 2022 approving the 2022 Provincial Special Education Fund (SEF) Budget;
WHEREAS, a portion of said Provincial Special Education Fund (SEF) amounting to Two-Hundred Fifty
Thousand Pesos (Php250,000.00) has been allotted to finance all the activities related to Research and Development
Program.
NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIES thereby agree as
follows;
1. RESPONSIBILITIES OF THE PARTIES
A. Joint Responsibilities
1. Create a joint working group that will prepare the action plan to operationalize the partnership;
2. Form a joint steering committee to monitor the progress of the partnership and to make sure that the
provisions of this Memorandum of Agreement (MOA) are met;
3. Develop a monitoring tool and strategy that would help sustain the project; and
4. Conduct scheduled convergences and discuss evaluative strategies as well as decide on the
sustainability of the project.
1. Conduct a training on mental health research and other activities related to research and development,
governance and teaching and learning;
2. Assign members of monitoring teams to conduct regular monitoring as to the effective use of the project;
3. Provide the PLGU evaluation tools and other tracking documents re: conduct of training on mental health
research and other activities related to research and development;
4. Ensure that the fund is utilized solely for the purpose of the implementation of activities related to
research and mental health advocacies;
5. Be responsible for all activities related to research and development;
6. Conduct procurement pursuant to the provisions of R.A. 9184 otherwise known as the Government
Reform Act;
7. Submit its liquidation report together with the supporting documents upon completion of the project.
C. Responsibilities of the PLGU
1. Assign a focal person to liaise with the DepEd Division of Samar for the preparation of the release of the
fund for research and mental health development activities, and to ensure efficient utilization of the fund;
2. Download the amount of ₱250,000.00 taken from the 2022 Provincial SEF into the DepEd Samar;
3. Conduct its own monitoring and evaluation as to the proper utilization of the funds;
2. EFFECTIVITY:
This agreement shall hold for the duration of CY 2022 and 2023 during which time the fund is utilized.
