KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL SETTLEMENT OF ESTATE of the late DARISAY

TAGWALAN, married to CAHAL SAWER is made and entered into by and
NHUR RHEA G. SAWER

among his legal heirs, namely;

IVY ELSA G. SAWER, Filipino, married, of legal age and a resident of

Purok Calolong, Binuangan, Maco, Davao de Oro;

NOVA JOY S. MAG-ASO, Filipino, married, of legal age and a resident of

156 Kms,Buhangin, Davao City;
CARLOS BENZHAR G. SAWER, JR., Filipino, single, of legal age and a
resident of Purok Tagumpay, Binuangan, Maco, Davao de Oro;
NHUR RHEA G. SAWER, Filipino, single, of legal age and a resident of
Purok 2, Tambongon, Pantukan, Davao de Oro;
CARLOS BENZHAR G. SAWER, JR

WITNESSETH:

That the late DARISAY TAGWALAN died on September 9, 1962, in

Tambongon, Pantukan, Davao de Oro, and her husband CAHAL SAWER died
on November 9, 2003 in Davao del Sur Provincial Hospital, Digos City, leaving as

heirs, the aforesaid IVY ELSA G. SAWER, NOVA JOY S. MAG-ASO, CARLOS
BENZHAR G. SAWER, JR, and NHUR RHEA G. SAWER, all of legal age as her
surviving grandson and granddaughters;

That the late DARISAY TAGWALAN, upon his death left a real property
consisting of TEN THOUSAND (10,000) SQUARE METERS, more or less,
particularly described as Lot B-4, portion of Lot B, Psd-3591.

Bearing true.

That to the best of the knowledge of the parties hereto, the deceased left no
debts nor any will, but this is without prejudice to any obligations or any will,
which may hereinafter come to the knowledge of the parties.

That aforesaid IVY ELSA G. SAWER, NOVA JOY S. MAG-ASO,

CARLOS BENZHAR G. SAWER, JR, and NHUR RHEA G. SAWER, agree to
adjudicate and divide the above parcels of land, in co-ownership among
themselves, in equal shares

NOW THEREFORE, pursuant to Section 1, Rule 74 of the Rules of Court

IVY ELSA G. SAWER

of the Philippines, the herein parties, in person, possessing full civil capacity, do
hereby settle, adjudicate and partition between and among themselves the
above-described estate of the decedent in the manner above-stated.

The foregoing inheritance is subject however to the liabilities imposed by Section

4, Rule 74 of the Rules of Court of the Philippines regarding the right of any heir
or creditor who might have been deprived of his/her lawful participation in the
estate of the decedent for a period of two (2) years.
