ORDINANCE NO. 14187~2021

AN ORDINANCE INSTITUTIONALIZING THE CAGAYAN DE ORO CITY GOVERNMENT


EMPLOYEES HOUSING PROGRAM, AND FOR OTHER PURPOSES

WHEREAS, Section 16 of the Republic Act. No. 7160, otherwise known as the Local
Government Code of 199 l mandates "every local government unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as powers necessary,
appropriate, or incidental for its efficient and effective governance, and those which are
essential to the promotion of the genera! welfare";

WHEREAS, Republic Act No. 7279 or the Urban Development and Housing Act of
1992 declares as a policy of the State the improvement of the capability of loca 1government
units in undertaking urban development and housing programs and projects;

WHEREAS, it is a declared policy of the State to promote and encourage the


development of housing projects in order to make available adequate units for average and
low~incorne earners in urban and rural areas:

WHEREAS, the City Government intends to apply the provisions of Republic Act I\Jo.
7279 as the "mother law" of the COO City Government Housing Program in harmony with the
declared State Policies of the 1987 Constitution, Local Government Code of 1991 , local
ordinances and the housing framework established in other national framework and the
Agenda 2030 for Sustainable Development by the United Nations;

WHEREAS, the City Government of Cagayan considers housing and resettlement as


crucial social services programs;

WHEREAS, the City Government is committed in upholding the housing framework


established in the Comprehensive Development Plan 2020~2025 specifically on Housing and
Resettlement Plan as provided in the Comprehensive Land Use Plan 2019~2027 in the
implementation of the City Government Employees Housing Program;

WHEREAS, many City Government employees have no housing facilities of their own
are forced to rent house/rooms or live with relatives and family friends;

WHEREAS, the City Government is extending assistance to the City Government


employees by providing decent housing facilities and resettlement sites at an affordable cost
as part of the benefits of its employees;

NOW, THEREFORE:

BE IT ORDAINED by the 19th City Council (Sangguniang Panlungsod) in session


assembled that:

SECTION I. Title - This Ordinance shall be known as the "CAgayan de Oro City /
Government Employees Housing Program Ordinance." a/
SECTION 2. Declaration of Policy. ~ It is the Policy of the City Government to
undertake a comprehensive socialized housing and resettlement program, which involves
establishing the employees' housing program that caters to the need of its homeless
employees and Job Orders as a gesture of gratitude for their services to the local government
unit.

SECTION 3. Objectives r The City Government aims to determine aggregate housing


demand for socialized and economic housing which includes beneficiaries from the rooster of
its employees. Jt aims to do land banking through yearly acquisitions of land and be able to
rationalize a comprehensive housing program to its employees, which shall:

a) Uplift the conditions of its employees by making available decent housing at


affordable cost with basic services;
b) Provide security of tenure to employees who do not have homes of their own and
contribute to the poverty alleviation measure of the City Government;
c) Inspire commitment and dedication among the employees in the performance of work
and in providing services to the City's residents the best way possible; and
d) Outline the programs of the City Government in undertaking urban development and
housing programs and projects.

SECTION 4. Definition of Terms - The following terms shall be defined as:

a) Applicant - an employee of the City Government who is interested in availing of the


City Government Employees Housing Program;
b) Beneficiary - an applicant who has been deemed qualified and eligible and has been
selected as beneficiary of the City Government Housing Program;
c) Application and Selectiott Committee - the main committee that handles all
application, registration and monitoring on the housing program including its
associated services;
d) Employee of the City Government - any person employed by the City Government of
Cagayan de Oro, whether as Permanent. Co-terminus or Temporary and Casual
employees, including Job-Orders and elected officials;
e) Point System - a reasonable standard adopted by the Application and Regist ration
Committee in order to arrive at a list of prioritizations;
0 Unitized Titles - the separate units issued for the purpose of redistribution of the
subject subdivided piece of land for a specific housing program or project.

SECTION 5. Scope - The ordinance shall apply to all bona fide Regular. Elected
Officials, Co-Terminus, Temporary, Casual employees and Job Orders of the City Government.

SECTION 6. Disqualification - The following shall be dlsqualified from the coverage


of this Order:

a) Those who are already beneficiaries of the regular housing program of the City Housing
and Urban Development Department;
b) Those who are already beneficiaries of the Housing Programs of National Agencies and
non~government agencies;
c) Those who have landholdings in Ca.gayan de Oro City; j
d) Those who have landholdings outslde Cagayan de Oro City, unless reconsidered by
the Application and Selection Committee, subject to the guidelines that will be
adopted by the Application and Selection Committee; and
e) Other analogous instances as the Application and Selection Committee may declare
as such.

SECTION 7. Requirements for Application - The applicants are required to submit the
following documents or proof of:

a) Filipino citizenship;
b) Income and Capacity to Pay;
c) Service Record; Job Order not less than 6 years of service
d) No Landholding/s;
e) No record of syndicated squatting:
D Certification from the City Legal Office that the applicant has not been administratively
held liable of a wrongdoing by finality of an offense involving moral turpitude;
g) Marriage Certificate for married applicants;
h) Solo Parent Certification from the City Social Welfare and Development Department.
if applicable;
i) Affidavit of no pending loan obliiations.

SECTION 8. Application and Selection Committee- The City Hall Employees Housing
Application and Selection Committee (hereinafter referred to as Committee) shall be
constituted to act as the main repository of all applications, registrations, the conduct of
evaluations and other related activities. which shall be composed of the following:

a) Chairperson CHUDD Department Head


b)Vice-Chairperson HRMO Head
c} Members One ( 11 Representative from the following offices:
(i) City Council - Committee Chairman on Urban &
Rural Poor and Housing Development
(ii) City Legal Office
(iiil City Administrator's Office
(iv) City Accounting Department

The Chairperson shall appoint the Secretariat of the committee from City Housing and
Urban Development Department.

SECTION 9. Func.tions and Responsibilities of tfre Application and Selection


Committee~ The Committee shall have the following responsibilities:

a) Prepare and establish the points system as a mode of determining the prioritization
of applicants fm the City Hall housing program;
b) Prepare the forms and documents needed for the application and registration
process;
c) Facilitate the development of the online application and registration system;
d) Receive the application and registration from the employees;
el Evaluate the documentary requirements of the applicants;
f) Collate all the data to produce the master list of eligible beneficiaries; ,I
g) Adopt rules and measures to validate the list;
h) Conduct regular meetings as needed and established by internal guidelines;
i) Conduct special meetings as may deemed necessary;
j) Conduct interview and other verification process with the applicants or registrants;
k) Maintain the database of the registrants;

]) Facilitate in the processing of the individual Deed of Sale for the awarded units;
m) Evaluate the application and deliberate the qualifications of the applicants; and
n) Endorse the qualified beneficiaries to the City Mayor.

SECTION 10. Availment of Mortgage Program - The applicant-beneficiary may avail


of the mortgage program of:

a) Pag-JBIG Fund or Home Development Mutual Fund (HDMF);


b) Social Housing Finance Corporation (SHFC}; and
c) National Home Mortgage Finance Corporation (NHMFC)

Available mortgage program from other financial institutions may also be availed as
long as it must be duly approved by the Application and Selection Committee.

The Application and Selection Committee may release a list of pre-approved housing
loan program by private financing institutions and banks.

SECTION 11. Titling - The City Housing and Urban Development Department shall
provide technical assistance to the Application and Selection Committee in the process of
titling and documentation.

The housing projects that shall be developed into unitized parcels of lots and/or
tenement types of building shall be made available to the beneficiaries of the City Hall
Employees Housing Project.

SECTION 12. Applicant and or Beneficiary Basic Rights. The City Government of
Cagayan de Oro respects any decision a beneficiary may have durin.g its application for any
City Socialized Housing Program and shall have the freedom to observe the following rights:

a) Right to Withdraw - The beneficiary may cancel or withdraw his or her entitlement to
the benefits of the City Hall Housing Project subject to the condition that he or she
must sell or assign his or her rights over the property to another person, subhect to
the right of first refusal of the City Government; and
bl Right to Acceleration - The beneficiary shall have the right to pay in advance any of
the installments or the full unpaid balance of the property's purchase price. This can
be done any time without incurring interest. This full payment may also be annotated
in the certificate of title over the property. This is subject to the separate rules and
regulations of the financial institution involved, if applicable.

SECTION 13. City Government's Right. The City Government shall exercise the
following rights in accordance to this City Ordinance:

a) Right to Rescind - The City Government may cancel the contract based on the
following:
(i) Submission of falsified documents;
(ii) Misrepresentation;
(iii) Grave breach of obligation under the Contract, Master Deed or Homeowners
Association Rules and Regulations. ,/
b) Right to RepFace -The city Government has the sole authority to take over the units
of beneficiaries who withdrew or cancelled their award under the City Government

Employees Housing Program. It shall be redistributed the same to other qualified


beneficiaries awaiting available units for award.

SECTION 14. Implementation; IRR - The committ ee shall undertake the


implementation of the provisions of this ordinance. It shall also prepare the Implementing
Rules and Regulations thereof, which shall then be duly approved and issued by the City
Mayor.

SECTION 15. Separability Clause- If, for any reason, any portion or provision of this
Rules shall be inconsistent with or contrary to, or to have gone beyond the provisions of any
existing Jaw, rules or regulations, the remaining provision not affected t hereby shall continue
to be valid and remain in full force and effect.

SECTION 16. Repealing Clause - All ordinances, local issuances, rules and
regulations or parts thereof, which are inconsistent or in conflict with t he provisions of this
ordinance are hereby repealed or modified accordingly.

SECTION 17. Effectivity Clause-This Ordinance shall take effect upon its approval.
