Attached are two documents provided as CFTC staff technical assistance. In their regard, Dan provides
the following notes:

With respect to the insider trading provision, the technical assistance would greatly expand the
scope of the prohibition on insider trading with respect to exchange insiders to cover any
nonmaterial public information received from any source. This would appear to apply a far
more restrictive provision on trading against exchange employees than anyone else.

With respect to the clearing requirement, we are considering proposing our own revisions to
both the clearing requirement and the transparency requirement, but will transmit those
separately when they are ready. The two proposals we are sending now are purely technical
assistance as a result of our last meeting.

We noted reports of progress at Senate Banking (click here), but don't have any details. If you have any
news you can share, please let me know.
